<br />An Ordinance vacating the following described area, to-wit:
<br />The alley running East from Olive Street, between 23rd and
<br />24th Streets in Block 3, Rugh's Addition to Eugene, Lane
<br />County, Oregon.
<br />WHEREAS,_ heretofore and on the 12th day of 1!~ay, 1941, the Common Council
<br />of the City of Eugene passed an ordinance setting a hearing for the 23rd day of
<br />June, 1941 in the Council Chambers, at which time and place protests and re-
<br />monstrances could be heard as to the vacation of the following premises, to-v~rit:
<br />The alley running East from Olive Street, between 23rd
<br />and 24th Streets in Block 3, Rugh's Addition to Eugene,
<br />Lane County, Oregon.
<br />and,
<br />ti`~P.EAS, a hearing was held pursuant to said Ordinance in the Council
<br />Chambers in the City Hall in the City of Eugene on Monday, the 23rd day of June,
<br />1941 at 7:30 o'clock P. M. and at said time the Council heard all objection, and
<br />Vt1HEREAS, all-persons owning property abutting upon said alley proposed
<br />to be vacated have consented to said vacation and Yiave applied for said vacation,
<br />and the City Planning Commission has consented to said vacation, it being the
<br />purpose of said vacation that the city incurs a risk by keeping the same open
<br />to public travel since the alley sought to be vacated is upon the precipitous
<br />incline running from Qlive Street Easterly and constitutes a dangerous and
<br />difficult thorougYifare v~~ithout any outlet,
<br />Now, therefore,
<br />THE CITY OF EUGE1~lE DOES ORDAIN AS FOLLOV~S:
<br />Section 1. The Common Council of the City of Eugene finds that due and
<br />legal notice of said hearing was published and posted as required by law; that
<br />no valid objection has been made at said 'nearing, or filed; that the consent of
<br />the ov~~ners of the abutting property, and the consent of the City Planning
<br />Commission, properly acknowledged, has been filed in said proceeding; and that
<br />the public interest will not be prejudiced by the vacation of said alley.
<br />Section 2. That said hearing was held on the 23rd day of June, 1941, at
<br />7:30 o'clock P. M. in the Council Chambers of the City Hall in Eugene, Lane
<br />County, Oregon, and that all matters necessary to be done have been completed.
<br />Section 3. That the following described area, to-wit:
<br />The alley running East from Olive Street, between 23rd and 24th
<br />Streets in Block 3, Rugh's Addition to Eugene, Lane County,
<br />Oregon,
<br />be and the same is hereby vacated and the area so vacated, being an alley, shall
<br />revert .to the abutting property pursuant to the statutes of the State of Oregon,
<br />reserving, however, to the City of Eugene the perpetual right to maintain any
<br />public utilities or structures now in the alley and to lay down at any time that
<br />the council deems necessary or convenient'-any public utility in the alley, and
<br />resei:~ving the right to enter upon the alley and maintain the same.
<br />Section 4. The Recorder be and he is hereby directed tofile a certified
<br />copy of this Ordinance with the Recorder of Lane County, Oregon, together with
<br />a map or plat of said property, and that a certified copy of the Ordinance shall
<br />be filed with. the County Assessor and another certified copy of the Ordinance
<br />shall be filed with the County Surveyor.
