THE CITY OF EUGETTE DOES ORDAIN AS FOLLOti"3S: Section 1. That section 13 of Ordinance No. 8413 entitled, "An Ordinance to create or divide the City into Districts within some of which it shall be lawful, and within others of which it shall be unlawful to erect, construct, alter or maintain certain buildings, or to carry on certain trades or callings, or within which the height and bulk of future buildings shall be limited, and providing for setback lines, and providing for a penalty for the violation thereof." passed by the Common Council April 8, 1935 and approved by the Mayor April 9, 1935, be and the same is hereby amended to read so as to add the following.; "Setback lines are hereby established upon Seventh Avenue from the western city limits to its junction with Pearl Street of sixteen feet on each side of Seventh Avenue and no building or structure shall be permitted nearer to said street than as herein provided except that the common council may upon application of a property owner by special _.. .ordinance change or alter the setback line as to a particular property. "Setback lines are hereby established upon Sixth tivenue from the western city limits to its junction with High Street of sixteen feet on each side of Sixth Street and no building or structure shall be permitted nearer to said street than as herein provided except that the common council may upon application of a property owner by special ordinance change or alter the setback line as to a particular property." The City Engineer be andhe is hereby authorized and directed to place the foregoing setback lines upon the Use Map of the City of Eugene and immediately draft such line upon the Use District Map and the said lines bg~ and they are hereby established as the setback lines between said terminals of Sixth Street j and Seventh Street in the City of Eugene. Section 2. VdHEREAS, buildings are being ereet~d which are not in conformity with structures already around the streest, thus greatly injuring the general I~ appearance of the city and the property rights of persons who have already built, ther•ef ore an emergency is declared to exist and it is necessary for the immediate preservation of the peace, health and safety of the city that this ordinance take effect immediately upon its passage by the Common Council and approval by the NTayor and it is so ordered.
