HomeMy WebLinkAboutORDINANCE NO. 8689139 08DINANCE NO. 8689 An Ordinance initiating the vacation of the following described premises, to-wit: 1 All of B4adison Street lying South of the South line of 12th Street and lying North of the North line of 13th Street, and also, all that portion of the alley in Block 6, James Huddleston's Amended Addition to Eugene, Lying between Lots 1 and 2 on the North and 9 and 10 on the South, all in Lane County, Oregon. and calling a hearing and directing that notice be given. THE CITY OF EUGENE DOES ORDAIN AS FOLLOWS: i Section 1. The Common Council o#'.,the City of Eugene hereby initiates vacation proceedings on its awn authority without petition or consent of the property owners, excepting as provided by s~stute, of the following described property, to-wits All of Madison Street lying South of the South line of 12th Street ~ and lying North of the North line of 13th Street, and also, all that portion of the alley in Block 6, James Huddleston~s Amended Addition to Eugene, lying between Lots l and 2 on the North and 9 and 10 on the South, all in Lane County, Oregon. Section 2. A hearing shall be held upon the proposal to vacate the street and ~ alley as herein provided, and said hearing sh alI be had on the day of October, 19141, at tha Council Chambers in the City Hall in Eugene, Oregon, at 7;3~ otclook P.~d. of said day, at which time.e.ll persons will be heard upon objections or suggestions with reference to the vacation oP said portion of street and alley, and at said time the Council will provide for the vacation of said premises or deny such vacation, and in case the vaction is made will make provisions for any damages sustained, by local assessaeent. ' Section 3. The City Recorder be and he is hereby required to imanediately publish for four consecutive weeks in a newspaper published in Eugene, Lane County, Oregon, the news' paper selected by him is hereby designated as the official newspaper of the city for this purpose, notice of the proposed vacation. Such notice shall give the description of the area to be vacated as herein set out, and state the date men this ordinance was passed; the name of any petitioners petitioning for said vacation; the date when the said petition, together with any objection or remonstrances which may be made in writing and filed with the City Recorder prior to the date of said hearing, will be heard and considered. Section ~. The City Recorder shall forthwith and within five days after the first publication of said notice, post or cause to be posted_at or near each end of said proposed vacation, a Dopy of the foregoing notice which shall be headed "NOTICE OF STREET I AND ALLEY VACATION", and which notice shall be posted in at least two conspicuous places in ~I such proposed vacation of such area. The posting and the first day of publication of such notioe sh all be not less than twenty--eight days before the time set for hearing. Seotion 5. 'r~iFiEREAS, Sohool District No. !~ of Lane County, Oregon, owns all of Block 5 and Lots 1, 2, 9 and 10 of Block 6 of James Huddleston~s Amended Addition to the City of Eugene, and it is necessary and desirable for the development of the school area th at ~Hadison Street and that portion of the alley be vacated so that School District No. 14 may employ the entire area for the development of its school plant, and to thus avoid the danger of pupils passing and re-passing on the street and alley sought to be vacated, an emergency is hereby declared to exist and it is declared to be necessary for the ia~nediate preservation of the peace, health and safety of the City of Eugene that this ordinance take effect immediately upon its passage by the Common Council and its approval by the Mayor, and it is so ordered.
