An Ordinance amending Section Thirteen of the Ordinance Number 8413 entitled, "An Ordinance to create or divide the City into Districts within some of which it shall be lawful, and within others of which it shall be unlawful to erect, construct, alter or maintain certain buildings, or to carry on certain trades or callings, or within which the height and bulk of future buildings shall be limited, and providing For setback lines, and providing fora penalty for the violation thereof." passed by the CiO~omon Council April 8, 1935 and approved by the Mayor April 9, 1935, by extending the provision as to setback lines. THE CITY OF EUGENE DOES ORDAIN AS FOLL(~S: Section 1. That Section 13 of Ordinance No. 8413 entitled, "An Ordinance to oreate or divide the City into Districts within some of which it shall be lawful, and within others of which it shall be unlawful to erect, construct, alter or maintain oertain buildings, or to carry. on certain trades or callings, or within which the height and bulk of future buildings shall be limited, and providing for setback lines, and providing for a penalty for the voilation thereof." _ passed by the Common Council April 8, 1935 and approved by the Mayor April 9, 1935s be and the same is hereby amended to read so as to add tha following; "Setback lines are hereby established upon East Broadway from High Street to its,3unction with the Southern Pacific railway track of 16 feet on each side of Broadway, and no building or structure shall be erected nearer to said street than as herein provided, except that the Common Council may upon applicati on of a property owner by special ordinance change or alter or condition the setback line as to a particular property." The City Engineer be and he is hereby authorized and directed to place the foregoing setback lines upon the Use Map of the City of Eugene and immediately draft such line upon the Use District Bdap and the said lines be and they are hereby established as the setback lines between said terminals of High Street to its ~unotion with the Southern Pacific railway track in tre City of Eugene.
