An Ordinance for the construction of a sanitary sewer on the East side of
4`Jashington Street from Twenty-second Avenue to Twenty-third Avenue, tb-wit:
Commencing on the North side of TwentyY=second Avenue at the alley between
ti`Jashington street and Jefferson street, running thence South across Twenty-
second Avenue, thence East to the East side of ~yashington Street, thence South
on the East side of 4~+ashingtori street to Twenty-third Avenue, in the City of
Eugene, Oregon, and declaring an emergency;
THE CITY OF EUGENE DOES ORDAIN AS FOLLOti"1S:
Section 1. The Conunon Council of the City of Eugene does hereby declare
its intention to build and construct a sanitary seVaer on the East side of
Washington street from Twenty-~ec.orid Avenue to Twenty-third Avenue, to-vvit:
Commencing on the north side of Twenty-second Avenue at the alley betvaeen Vdash-
ington street and Jeff_'er•son street, running thence South across Tvaenty-second
Avenue, thence East to the East side of Washington street, thence South on the
East side of ~~ashington street to Ttiventy-third Avenue, in the City of Eugene,
Oregon.
Section 2. The said sewer shall be constructed of first class cement or
vitrified pipe, according to the plans and specifications of the amity Engineer.
Section 3. The City Engineer is hereby directed to survey out the location
of said sewer, and prepare plans and specificiations and a profile thereof, and
file the same wi tYi the City Recorder.
Section 4. the construction of said sec:~er• shall{include all necessary
manholes, ~°ryes, and all things necessary and convenient for tiie complete building
thereof .
Section 5. The whole cast of the construction of said sewer shall be borne
by and shall be assessed to the lots, parts of lots and acreage property liable
therefs~r, and benefitted by the construction thereof in proportion to the benefits
accruing to each lot, part of lot, or acreage property as shall be ascertained
and determined by the Council.
Section 6. Upon the completion of the sewer, the Common Council sriall
ascertain the cost thereof and assess that portion thereof against the lots, parts
of lots or acreage property liable therefor or benefitted thereby in accordance
with the provisions of the Charter of the City of Euge~~e, and when said costs
are so assessed the same shall be entered in the City Lien Docket, and be
furtYier enforced as provided by the City Charter.
Section 7. Whereas, the improvement contemplated and provided for by this
ordinance, is a necessary improverr~ent and the district of the city in which said
sewer is to be constructed is in such a condition that the construction of said
sewer is essential to the health and safety of the residents of said district, it
ass
is therefore declared that an emergency exists and it is necessary for the
immediate pz°eservation of the public peace, health and safety, that this ordinance
take effect immediately upon its passage by the Council and approval by the Mayor.
