ORDIIITANCE N0. 8713
An Ordinance adopting the plans and specifications of the City
Engineer for.~the construction of a sewer, as follows: Commencing on the North
side of Twenty-second Avenue at the alley between Vaashington street and Jefferso
street, running; thence South across Twenty-second Avenue, thence East to the
East side of rdashington Street, thence South on the East side of `J~ashington
street to Twenty-third Avenue, in the City of Eugene, Oregon; and declaring
an emergency.
V~tHEREAS, on the 26th day of January,l942, the Common Council of
the City of Eugene passed Ordinance No.87___2_~"~for the construction of a sewer
as described and set forth in the caption hereof, and
VdHEREAS, Section 3 of said Ordinance directed the City Engineer
to make plans and specifications foz• the construction of said sewer and file
the same with the City Recorder, and
V~REAS, in aeco¢~rdance with such instructions the City Engineer
has prepared said plans and specifications and .filed the same with the City
Recorder of said City of Eugene on the 26th day of January, 1942, and the
Common Council of the City of Eugene having .examined and approved the same,
and being duly advised in the premises,

Section 1. That the plans and specifications of #,he City Engineer
for tYle construction of a sewer to be laid as follows: on the East side of
Vdasr~ington street from Twenty-second Avenue to Twenty-t~~ird Avenue, to-wit:
Commencing an the North side of Twenty-second Avenue at the alley between
~Yasiiington street and Jefferson street, running thence South across Twenty-
second Avenue., thence East to the East side of Washington Street, thence South
on the East side of tiUashington street to Twenty-third Avenue, in the City of
Eugene, Oregon; filed with the City F.ecorder on the 26th da,y of 7aauary, 1942,
be and the same are in all things ratified, approved and adopted, and that said
sewer be constructed in accordaace therewith.
Section 2. That the City Recorder be and he is hereby instructed
to give notice to contractors and to property owners as provided by the Charter
of the City of Eugene for the letting of contracts for the construction of
sewers.
Section 3. That the Common Council of the City of Eugene does hereby
declare that the contract for the construction of said sewer shall be let in
one contract and the City Recorder is hereby directed to state in the notice
to contractors and property owners that the contract for said improvement shall
be let as one contract.

Section 4. That the work on said improvement shall commence within ten
days after the letting of the contract and shall be completed within thirty days
thereafter.
Section 5. The bidder receiving the contract for said improvement shall
execute a good and sufficient bond with one or more sureties to be approved by
the. Street Cornrnittee in the sure of eighty per cent (800) of the contract price,
for the faithful performance of the contract.
Section 6. Each person, firm, company or corporation bidding upon said
improvement shall accompany his bid with a certified check in the sum of 5 per
cent of the amount bid as evidence of good faith and to"guarantee the entering
into a contract in accordance with the bid subrriitted by hirn and the execution
of the bond herein provided for.
Section 7. V~herea~s, the improvement contemplated and provided for by
this ordinance is a necessary improvement and the sanitary condition of the
property is bad, the construction of said sewer is decl~3red essential to the
health and safety of the residents of said district, and it is therefore
declared that an emergency exists, and it is"necessary for- the preservation of
the public peace, health and safety that this ordinance take effect immediately
upon its passage by the Common Council and approval by the Idiayor.
