T'r~ CI 1'Y OF EUGENE DOES, ORDAIN AS FOLLO~F~S: Section 1. It shall be unlawful f or• any person to operate or use a bicycle, propelled ti~~holly or in part by muscular power upon any of the streets, alleys or public high~;fays of the City of Eugene without first obtaining from the Police Department a license therefor. Section 2. `The Police Department is hereby authorized and directed to issue, upon written application, bicycle licenses which shall be f'or the current year of 1942, to and including the 31st day of December, 1942, and thereaftez° said licenses shall issue for tYie current year commencing vaith the first day of January of each calendar year and ending with the 31st day of December of each year. Said licenses vahen issued shall entitle the licensee to opez•ate such bicycle for which said licerise has been issued upon the streets, alleys and public highways, exclusive of the sidewalks, in the city of Eugene excepting as hereinafter provided. ;.> Section 3. The City of Eugene shall provide each year metallic license plates which shall be issued only to owners oi' bicycles, together vaith a registration card, all to be issued~by the Chief of Police or assistaritts designated by him. The metallic license plates and registration cards are to have numbers stamped thereon in numerical order beginning with number one, indicating the year- for v~lhich the same are issued and the letter EBL stamped thereon; such metallic license plates shall be suitable for attachment upon the frames of bicycles, at a place designated by the Police Department, and it shall be tiie duty of the Police Department to attacri one such metallic license plate to the frame of each bicycle and to issue a corresponding re~istr•ation card to the licensee upon the payment of the license fee ®i' twenty-five (25} cents. . Such metallic license plate shall rerr:ain attached during the existence of such license. ~1'he Police Department shall also keep a record of the date of issue and number of such license and to whom issued. Section 4. No person shall ride or• operate any bicycle upan any street, alley, or public place within the corporate limits of the City of Eugene during ~ the period from a half hour before sunset to a half hour before suns°ise, and all .times when fog or other atmospheric conditions render the operation os: said bicycle dangerous to tr•az`'fic or the use of the streets, or at any othez.• time when there is not sufficient light to render clearly discez•nible any pez•son on the streets a distance of two hundred feet ahead without having a lighted lamp I~ 1'7 2 _ _ - _ -- - - - ---- -- -- _ _ -- ---- _-_ -_--- - _-__ _ -- - _---_ --_ -- - _- --- -,r .---- -_ -- --- affixed on the front of said bicycle visible under normal atmospheric conditions from a distance of at least three hundred feet in front of said bicycle and also a reflex mirror or lighted lamp on the rear of said bicycle exhibiting a red light visible under like conditions f r•om a distance of at least tw°o hundred feet to the rear of such bicycle.. Section 5. All pez°sorls engaged in the business of buying second-hand bicycles are hereby required to make a report to the Police Department of the purchase, giving the name,'address and person from whom each bicycle is pur- chased, the frame ,number thereof and the number of the metallic license plate found thereon, if arty; all persons engaged in the business of selling nevi or second-hand bicycles are hereby required to~make.a report to the Police Depart- ment giving a-list of all sales made, vahich list shall include the-name: and. address of each person to whom sold, the kind of bicycle sold .together ~P~ith a description and the frame number thereof and the number of the metallic license ,plate attached thereto, if any. Said re~corts shall be made within twenty-four hours from the date of the sale. Section 6. It shall be the duty of every person rho sells or transfers ownership of any bicycle to report such sale or transfer by returning to t'rre Police Department the registration card issued to such person as licensee thereof, together with the name and adress of the person to vuhom said bicycle vas sold or: transferred, and such, report shall be made within five days of the date of said sale or transfer. It shall be the duty of the.pur•chaser or transferee of such bicycle to apply for a transfer of registration thereof within five days of said ~ sale or• transfer, Section 7. All persons who rent, hire, or loan bicycles shah first obtain a .license tag or tags to be used on such bicycles by paying therefor the regular fee, which tag or tags shall be attached to the bicycle. Persons requiring such tags may secure the same from the Chief of Police of said city. Section 8. No pez•son shall -operate or ride on any bicycle upon the streets, alleys or public highways of the City of Eugene with tvao or more persons upon the same bicycle, pz°ovided, Yiowever, that this restriction shall not apply to tandem bicycles or other bicycles equipped for tvao or more riders and no person small be permitted to operate a bicycle with the passenger in front of the operator. Section 9. T~To person, while. riding or operating a bicycle on any street, alley or publicrrighway in the City of Eugene, shall hold on to any other vehicle. Section 10. It shall be ~~~avaful to ride or operate a bicycle on any sidewalk in the city of Eugene outside of Fire Zone No. 1. It sha 11 be unlaw- ful to vide or operate a bicycle on any sidewalk within Fire Zone P1o. 1. ~ `7 3 Section 11. Every person riding or operating a bicycle on an;T street;~_ alley, or public place in the City of Eugene shall keep said bicycle on tY~ extreme right of the traffic lane, and it shall be unlawful for two or more operators of bicycles to travel abreast on .any street, alley or public place in tYie City of Eugene or to operate said bicycle on traffic lanes otherwise than in single f ile. Section 12. Every person riding or operating a bicycle on ar.~y street, alley, or public place in the City of Eugene shall be subject to all provisions of the laws of the State of Oregon and the ordinances of the City of Eugene applicable to the drivers of vehicles, except the provisions thereof that by their very nature can have no application. Section 13. It shall be unlawful for any person or persons to run or engage,or cause to run or to be engaged in any bicycle race on ar_y street, alley or .public: place within the corporate limits of the City of Eugene, except under permit from and supervision of the Chief of Police of said City. Section 14. Any person who shall violate any of the provisions of this ordinance shall., upon conviction thereof in the Recorder's Court of the City of Eugene, be punished by a fine not to exceed X100.00 and in default of the payment of such fine, may be imprisoned in the city- jail one day for each ~~°.2.00 of the fine unpaid. In addition to such penalt;;r the City Recorder may, either in lieu of or in addition to such fine, prohibit the operation upon the streets, alleys, and public places of the City of Eugene for a period not to exceed thirty days, of the bicycle so used in such violation, in which event the bicycle so used in such violation shall be impounded with the Chief of Police and retained by him for the period that the operation thereof is prohibited, or the owner's card or certi- ficate shall be hula for they period during which the operation of the bicycle is prohibited. Section 15. All ordinances and parts o~ ordinances in conflict herewith are hereby repealed. Section 16. Nothing herein contained shall be deemed to be, nor shall be in conflict with any of the provisions of the state law. Sect ion. l7.
