Il~~°PROVEF<<iL'NT ORDII~TANCE N0. 8742 An Ordinance for the construction of a sanitary sewez to extend along the extension of Longview Street from Fairmount Boule- vard to the property hereafter described, in the City of Eugene, Oregon, and declaring an emergency: THE CITY OF EUGENE DOES ORDAIN AS FOLLOt'dS: Section 1. The Common Council of the City of Eugene does here- by declare its intention to build and construct a sanitary sewer in the extension of Longview Street from Fairmount Boulevard to the following described property, to-wit: L. K. Shumaker. Beginning in North line of Hendricks Park 78.7 feet South 68°10' East of Northwest corner of Lot 11, Block 28, Fairmount, thence North 21050' East 108 feet; South 77015' East 50.3 feet; South 21050' ~;est 116 feet to said park line and thence North 68°10' ~,iest to beginning. T~ta:hlon Sweet. Beginning at com~lon corner Lots 3, 4, and 12, Block 28, Fairmount, also the corner of Hendrick's Park, thence along park line South 68°10' East 78.7 feet, thence North 21°50' East 116 feet to South li~.e of road known as Baton Driveway, thence v~esterly along the South line of said road for a distance of 24U feet to a point over the water main leading into the Fairmount Reservoir, said water main being located 125.0 feet due if,~est from the initial corner thence Southerly along, the line of said v~~ater main for a distance of 190 feet to its intersection with the line of Hendrick' s Park, the~~ce along said park boundary Iv`orth 45° East to beginning. and to serve the above described property. Section 2. The said sewer shall be constructed of fiz°st class cement or vitrified pipe, according; to the plans and specifica- Lions of the City Engineer. Section 3. The City Engineer is hereby directed to survey out the location of said sewer, and prepare plans and specifications and a profile thereof, and file the same with the City Reorder. Section 4. The construction of said sewer shall include all necessary manholes, wyes, acid all things necessary and convenient for the budding thereof . ~-' ~i -~ 2 - .. Section 5. The whole cost of the construction of said sewer shall be borne by and shall be assessed to the lots, parts of lots and acreage property liable therefor, and benefited by the construction thereof in proportion to tsie benefits accruing to each lot, part of lot, or acreage property as shall be ascez~tained and deterruined by the Council. Section 6. Upon the corr~~,letion of the sewer, the Common Coun- cil shall ascertain the cost thereof arld assess that portion thereof against the lots, parts of lets or acz°eage property liable therefor or benefited thereby in accordance with the provisions of the Charter of the City of Eugene, and when said costs are so assessed the same shall be entered in the City Lien Docket, and be further en- forced as provided by the City Charter. Section 7. ~JHEREAS, the improvement contemplated and pro- vided for by this ordinance, is a necessary improvement and the district of the city in vahich said sewer is to be constructed is in such a condition that the constr•uetion of said sewer is essen- tial to the health and safety of the residents of said district, it is therefore declared that an emergency exists and it is neces- sary for the imr~edi~te preservation of the public peace, health and safety, that this ordinance take effect immediately upon its passage by the Common Council and approval by the Mayor. That the Common Council of the City of Eugene, Lane county, Oregon, does hereby declare its intention to improve and making such other and further improvements in connection therewith as may be necessary and proper to a properly all in accordance with the plans and specifica- tions to be prepared by the city engineer as hereinafter specified. Section 2. That the costs of said improvement shall be assessed and be borne-by the property adjacent to said improvement, except street intersections whichwill be paid for by the city, and there shall be included as a part of the costs thereof, the engineer's charges for his services thereon not to exceed five per cent of the contract price therefor. Section 3. That the city engineer is hereby directed to make and prepare plans and specifications for the said improvement as provided in Section One of this Ordinance and file the same with the City Recorder. Section 4. WHEREAS, the improvement contemplated and provided for by this ordinance, is a necessary improvement, and the streets to be improved are in such a condition that their immediate improvement is essential to their safety, it is, therefore, declared that an emergency exists and that it is necessary for the immediate preservation of the public peace, health and safety, that this ordinance take effect at once, and it is ordered that this act shall take effect immediately upon its passage by the Council and approval by the Mayor.
