HomeMy WebLinkAboutORDINANCE NO. 8743~ ~ s ~ ~ .~_ ~"h ~ ~ ORDINAI~TCE RTO. 8743 An Ordinance adopting the plans and specifications of tale City Engineer for the construction of a sewer, as follows: In the extension of Longview Street from Fairmount Boulevard, to the property hereinafter described, in the City of Eugene, Oregon and declaring an emergency. ::HEREAS, on the 11th dayof Nay, 1942, the Common Council of the City of Eugene passed Ordinance No. 8742 for the construction of a sev°~er as described and set forth in the caption hereof, and l:'HEREAS, Section 3 of said Ordinance directed the City Engineer to make plans and specifications for the caistruction of said sever and file the same with the City Recorder, and ~~HEREAS, in accordance with such instructions the City Engineer has prepared said plans and specifications and filed the same with the City Recorder of said City of Eugene on the 11th day oz I~ay, 1942, and the Common Council of the City of Eugene having examined and approved the same, and being duly advised in the premises, THE CITY OF EUGEI~TE DOES ORDAIN AS r OLLOG3rS Section 1. That the plans a~.d specifications of the City Engineer for the construction of a sewer to be laid in t:1e exten- lion of Longview Street frog+3 Fairmount Boulevard to the i ollo`ving described property, to-wit: L. K. Shumaker. Beginning in North line of Hendrick's Park 78.7 feet South 68°l0' East of Nort~.west corner of Lot ll, Block 28, Fairmount thence I~torth 21 50' East 108 feet; South 77°15' East 50.3 feet; South 21°50' ~~dest 116 feet to said park line and thence North 68010' ~~'est to beginning. IVia~~.on Sweet . Beginning at com~:~on corner Lots 3, 4, and 12 Block 28, Fairmount, also the corner of riendrick's Park, thence along park line South 68°10' East X8.7 feet, thence Ilorth 21°50' East 116 feet to South lirie of road knovan as Laton Driveway, thence westerly along the South line of said road for a distance of 24U feet to a point over the water main leading into the Fairmount Reservoir, said water main being located 125.0 feet due ~°Jest from the initial corner thence Southerly along the line of said water main for a dista~~ce ~~f 190 feet to its intersection with the line of Hendrick's Para, thence along said park boundary North 45° East to beginning. and to serve the above property; filed vrith the City Recorder on tree 11th day of T,~iay, 1942, be and the same are in all things ratified, approved and adopted, and that said sewer be constructed in accordance therwith. Section 2. That the City Recorder be and he is hereby instructed to give n~~tiee to contractors and to property owners as provided by the Charter of the City oi' Eugene for the letting of contracts for the construction of sewers. Section v. That the Common Council of the City of Eugene does hereby declare that the contract f or• the construction of said sewer shall be let in one contract and the City Recorder is hereby directed to state in the notice to contractors and property owners that the contract for said improvement shall be let as one contract. Section 4. That the work on said improvement shall commence within ten days after the letting of the contract and shall be completed ~;~ithin thirty days thereafter. Section 5. The bidder receiving the contract for said im- provement shall execute a hood and sufficient bond with one or more surities to be approved by the Street Committee in the sum of eighty per cent (80 0} of the contract price, for the faithful performance of the contract. Section 6. Each person, firm, company, or corporation bidding upon said i~~proveliient shall accompany his bid vrith a certified check in the sum of 5 per cent of the amount bid as evidence of good faith and to guarantee tine entering into a contract in accordance with the bid submitted by him and the execution of the bond herein • adr ~ ,-~ ~ ~ ~ provided for. Section 7. 1JH~REAS, the improvement contemplated and provided for by tr~is ordinance is a necessary improvement and the sanitary condition of the property is bad, the co.astruction of saki sewer is declared essential to the health and uafety of the residents of said district, and it is therefore declared that ara emergency exists, ~:nd it is necessary for the preservation of the public peace, health and safety that this ordinance take elfect immediately upon its passage by the Common Council and a~~proval by the I~l~ayor. An Ordinance approving and adopting the plans and specifications of the City Engineer for the improve- ment of in the City of Eugene, Oregon, by directing the City Recorder to advertise fo-r bids for the construction of said improvement in accordance with such plans and specifica- tions, and notifying property owners when and where the bids therefor will be opened and considered. WHEREAS, the Common Council of the said City of Eugene, on the day of 192 ,passed Ordinance No. .for the improvement .of in the City of Eugene, by and said Ordinance was approved by the Mayor of the City on the day of , 192 ;and, WHEREAS, Section 3 of said Ordinance directs the City Engineer to make and prepare complete plans and specifications for the improvement of said as specified in said Ordinance, and, WHEREAS, plans and specifications have been so prepared by the City Engineer and have been examined by the members of the Common Council of the City and found to be satisfactory THE CITY OF EUGENE DOES ORDAIN AS FOLLOWS Section 1. That the plans and specifications of the City Engineer for the improvement of in the City of Eugene, by paving the same and doing such other work as may be necessary to completely im- prove the same are in all things approved and adopted, and the said shall be improved in accordance therewith. Section 2. That the City Recorder is instructed to give notice to contractors and property owners, as provided in Section 53, 54 and 55-B, of the Charter of the City of Eugene, inviting bids for the improve- ment of said as prescribed in and in conformity to said plans and specifications. Section 3. That the Common Council declares that the said improvement and the whole thereof shall be let as one contract, and the City Recorder is directed to state in the notice to contractors and property owners that said improvement will be let in one contract, and to also state therein the time and place when and where bids for the construction of said improvement will be opened and considered by the Common Council, and, that at such time and place property owners may file remonstrances against letting said con- tract. Section 4. That the party whose bid is accepted for said improvement shall sign a contract for said work within ten days from the time of the receipt by him of the notification of the acceptance of his bid, and the work thereon shall be commenced within ten days after the letting of said contract, and shall be completed within sixty days thereafter, unless an extension of the time therefor be granted by the Com- mon Council. The party whose bid is accepted shall also execute and deliver to the city a good and sufficient bond, with one or more sureties to be approved by the Committee of the City, in an amount equal to eighty per cent of his contract price, as security for the faithful and satisfactory ful- fillment of his contract. Section 5. That each party bidding for said improvement shall accompany his bid with a certified check or cash in an amount equal to five per cent of the amount of his bid, as evidence of good faith, and said check, or the proceeds thereof, or said money shall be retained by the City until a written contract is finally made, and fully executed and the bond furnished and delivered, all to be done within ten days after the award of said contract. Section 6. WHEREAS, the improvement contemplated and provided for by this ordinance, is a necessary improvement, and the streets to be improved are in such condition that their immediate improvement is essential to their safety, it is, therefore, declared that an emergency exists and that it is necessary for the immediate preservation of the public peace, health and safety, that this ordinance take effect at once, and it is ordered that this act shall take effect immediately upon its passage by the Council and approval by the Mayor.
