THE CITY OF EUGENE DOES OF,DAIN AS FOLLO~'~S: Section 1. The Common Council of the City of Eugene hereby initiates vacation proceedings on its own authority without petition or consent of the property owner, excepting as provided by statute, of the following described property; to-wit: All that certain portion of the 14 foot alley running East and Vilest through Block 34 of the Amended Plat of Y~airmount from the west line of Lot 4 to the east line of Lot 12; Also: All that portion of the. 14 foot alley of said block 34, running North and South between Lots 10 and 11 from the South line of the alley running east and LVest in said Block to a point 230 Peet North from the Southerly line of said Block 34. Section 2. A hearing shall be held upon the proposal to vacate the alley as herein provided, and said hearing shall be held on the 14th day of Dece.~ber, 1942, at the Council Chambers in the City Hall in Eugene, Lane County, Oregon, at 7:30 otclock P.T. of said day, at which time all persons will be heard upon objections or suggestions with reference to the vacation of said alley and at said time the Council will provide for the said vacation of said premises or deny such vacation, and in case the vacation is made will make provisions for any damages sustained by local assessment. Section 3. The City Recorder be and he is hereby required to immediately publish for four consecutive weeks in a newspaper published in Eugene, Lane County, Oregon, notice of the proposed vacation. Such notice shall give the description of the area to be vacated as herein set out, and state the date when this ordinance was passed; the name of any petitioners petitioning for said vacation; the date when the said petition, together with any objection or remonstrances which may be made in writing and filed with the City Recorder prior to the date of said hearing will be heard and considered. Section 4. The City Recorder shall forthwith and within five days after first publication of said notice, post or cause to be posted at or near each end of said proposed vacation, a copy of the foregoing notice, which shall be headed "Notice of Street Vacation," and which notice shall be posted in at least two conspicuous places in such proposed vacation of such area. The posting and the first day of publication of such notice shall not be less than twenty-eight days before the time set for hearing. Section 5. ~~hereas trie State Highway Commission together with the City of Eugene and the Public Utilities Commission have combined for the purpose of reconstructing the entire Judkin's Point area at the Eastern City Limits of the City of Eugene eliminating all of the railroad crossings, and, whereas it is necessary for tree safety of the traveling public of the City of Eugene that these changes shall be made and the crossings eliminated and 4~hereas, the work is nearly completed and the streets are about to be closed, an emergency is hereby declared to exist and it is necessary for the immediate preservation of the peace, health and safety of the City of Eugene that this ordinance take effect immediately upon its passage by the Common Council and its approval by the Mayor, and it is so ordered.
