ORDINANCE N0. 8755
An Ordinance initiating the vacation of the following described
premises, to-v~.it
That certain portion of Franklin Boulevard in the City of Eugene lying
between the North line of Eighth Avenue and a line extended from the
~ intersection of the North line of Broadway and the fiy'esterly side line
~ of Franklin Boulevard to the intersection of the southerly line of
Broadway extended easterly with the easterly side line of Franklin
Boulevard.
That certain section of Eighth Avenue in the City of Eugene lying between
the westerly line of the Southern Pacific Company's right of way extended
across said avenue and the westerly line of Franklin Boulevard.
That certain section of Broadway in the City of Eugene, lying between
the. westerly line of the Southern Pacific Company's right of way extended
across Broadway and the ~~esterly line of Franklin Boulevard.
and calling a hearing and directing that notice be given.
THE CITY OF EUGENE DOES ORDAIN AS FOLLO~~'S:
Section 1. The Common. Council of the City of Eugene hereby initiates
vacation proceedings on its~own authority without petition or consent of the
property owners, excepting as provided by statute, of the following described
property, to-wit:
That certain portion of Franklin Boulevard in the City of Eugene, lying
between the north line of Eighth Avenue and a line extended from the
intersection of the north line of Broadway and the westerly side line
of Franklin Boulevard to the intersection of the southerly line of
Broadway extended easterly with the easterly side line of Franklin
Boulevard.
That certain section of Eighth Avenue in the City of Eugene lying between
the westerly line of the Southern Pacific Company's right of way extended
across said avenue. and the westerly line of Franklin Boulevard.
That certain section of Broadway in the City of Eugene, lying between
the westerly line of the Southern Pacific Company's right of way extended
across Broadway and the westerly line of Franklin Boulevard.
Section 2. A Bearing shall be held upon the proposal to vacate the streets
herein provided, and said hearing shall be held on the 14th day of December,
1942, at the Council Chambers in the City Hall in Eugene, Oregon, at 7:30
o'clock P.Tvi. of said day, at which time all persons will be hear upon ob-
jections or suggestions with reference to the vacation of said streets and at
said time the Council will provide for the said vacation of said premises or
deny such vacation, and in case the vacation is made will make provisions for
an~a damages sustained by local assessment.
Section 3. The City Recorder be and he is hereby required to immediately
publish for four consecutive weeks in a newspaper published in Eugene, Lane
County, Oregon, notice of the proposed vacation. Such notice shall give the
description of the areas to be vacated as herein set out, and state the date
when this ordinance was passed; the name of any petitioners petitioning for
said ordinance for vacation; the date when the said petition, together with
any objection or remonstrances which may be made in writing and Piled with
the City Recorder prior .to the date of said hearing will be heard and considered.

Section 4. The City Recorder shall forthwith and within five days
after the first publication of said notice, post or cause to be posted at
or near each end of said proposed vacation, a copy of theforegoing notice,
which shall be headed "Notice of Street Vacation", and which notice shall
be posted in at least two conspicuous places in such proposed vacation of
such area.
The posting and the first day of publication of such notice shall be
not less than twenty-eight days before the time set for the hearing.
Section 5. Whereas the State Highway Commission together with the City
of Eugene and the Public Utilities Commission have combined for the purpose
of reconstructing the entire Judkin's Point area at the Eastern City Limits
of the City of Eugene eliminating all of the railroad crossings and,
~~hereas it is necessary for the safety of the traveling public of the
City of Eugene that these changes shall be made and the crossings eliminated,
and,
V~hereas the work is nearly completed and the streets are about to be
closed, an emergency is hereby declared to ixist and it is necessary for
the immediate preservation of the peace, health and safety of the City of
Eugene that this ordinance take effect immediately upon its passage by the
Common Council and its approval by the T~{Favor, and it is so ordered.
