HomeMy WebLinkAboutORDINANCE NO. 8756I 2tl 4 ORDINANCE N0. 8756 I An Ordinance initiating the vacation of the following described premises ;to-wit Beginning at the intersection of the easterly line of Fairmount Boulevard f end the northerly line of Ramble Avenue, as laid out and platted in the City of Eugene, running thence easterly along the north line of said Ramble ' Avenue to the east line of Ramble Addition; thence South 12.65 feet; thence ' westerly 12.5 feet distance from and parallel to the north line of said 1 Ramble Avenue to the east'~line of Fairmount Blvd., thence northeasterly along ~ the easterly line of Fairmount Blvd. to the place of beginning. Beginning at the intersection of the easterly line of Fairmount Blvd., and the Southerly line of Ramble Avenue as laid out and platted in the City of ~ Eugene, running thence easterly along the southerly line of said Hambel-~ ~ Avenue 173.6 feet; thence northv~esterly 30 feet to a point 12.5 feet measured ` at right angles t o the southerly line of Ramble Avenue; thence westerly 12.5 feet from and parallel to the south line of Ramble Avenue to the easterly ~ line of Fairmount Blvd., thence southwesterly along the easterly line of Fairmount Blvd. to the place of beginning. ` Beginning at the intersection of the south line of Ramble Avenue and the east line of Ramble Addition, as laid out and platted in the City of Eugene, running thence north 12.65 feet; thence northwesterly 12.5 feet distance ~ from and parallel to the said south line of Ramble Avenue 290 feet, to the ~ point of curve of a curve having a 10 foot radius; thence an the circumference ~ of said curve to its intersection vaith the northerly line of the alley as platted in Ramble Addition; thence on a curve to the left having a four foot ~ radius to its intersectiol. with the southerly line of said Ramble Avenue; ~i thence easterly along the southerly line of said Ramble Avenue to the place ~ of beginning. and calling a hearing and directing that notice be given. THE CITY OF EUGENE DOES ORDAIN AS FOLLOWS: Section 1. The Co~unon Council of the City of Eugene hereby initiates vacation proceedings on its own authority without petition or consent of the property i i owners, excepting as provided by statute, of the following described property;to-with!: I as at Beginning at the intersection of the easterly line of Fairmount Boulevard and 1~ the northerly line of Ramble Avenue, as laid out and platted in the City of Eugene, running thence easterly along the north line of said Ramble Avenue II to the east line of iiamble,Addition; thence South 12.65 feet; thence westerly ~ 12.5 feet distance from and parallel to the north line of said Ramble Avenue, I~ to the easterly line of Fairmount Blvd., thence northeasterly along the ~ easterly line of Fairmount Blvd. to the place of beginning. Beginning at tree intersection of the easterly line of Fairmount Blvd., and the I{ southerly line of Ramble Avenue as laid oat and platted in the City of Eugene, ! running thence easterly along the southerly line of said Ramble Avenue 173.6 i~ feet; thence northwesterly 30 feet to a point 12.5 feet measured at right l ~~ngles to the southerly line of Ramble Avenue; thence westerly 12.5 feet from ~i and parallel to the south line of Ramble Avenue to the easterly line of Fairmounit Blvd, to the place of beginning. Beginning at the intersection of the south line of Ramble Avenue and the east (, line of 1-iamble Addition,as laid out and platted in the City of Eugene, running ~~ thence north 12.65 feet; thence northwesterly 12.5 feet distance from and ~I parallel to the said south line of Ramble Avenue 290 feet, to the point of curved of a curve having 10 foot radius; thence on the circumference of said curve to its intersection with the northerly line of the alley as platted in Ramble ~~~ Addition; thence on a curve to the left having a four foot radius to its intersection with the southerly line of said Y-Yamble Avenue; thence easterly ~ along the southerly line of said Ramble Avenue to the place of beginning. '~ Section 2. A hearing shall be held upon the proposal to vacate the street herein provided, and said hearing shall be held on the 28th day of December, 1842~j the Council Chambers in the City Hall in Eugene, Lane County, Oregon, at ?:30 ~+~ ~~' o'clock F.M. of said day, at which time all persons will be heard upon objections ~ or su~;~estions with reference to the vacation of said street and at said time the I Council will provide for the said vacation of said premises or deny such vacation, IIII ~~ bland in case the vacation is made, will make provision for any damages sustained ~~ .; 2,(~5 ~~by local assessment. ,' Section 3. The City Recorder be and he is hereby required to immediately publish for four successive and consecutive weeks in a newspaper published in I~Eugene, Lane County, Oregon, notice of the proposed vacation. Such notice shall give the description of the area to be vacated as herein set out, and state the date when this ordinance was passed; the name of any petitioners petitioning for said vacation; the date when the said petition, together with any objection or remonstrances which may be made in writing and filed with the City Recorder prior to the date of said hearing will be hear and considered. l Section 4. The City Fcecorder shall forthwith and within five days after the ~fi$st publication of said notice, post or cause to be posted at or near each end ~of said proposed vacation, a copy of the foregoing notice, which shall be headed "Notice of Street Vacation," and which notice shall be posted in at least two conspicuous places in such proposed vacation of such area. The posting and the first day of publication of such notice shall not be less than twenty-eight days before the time set for hearing. Section 5. V`lhereas Ramble Avenue is a dead-end street serving six owners and it is beautified by trees and sn.rubbery within the street which, if the street ~is improved must be removed, and ~~hereas for tYie uses for which it shall be subjected, there is no occasion }for improving the full width of 50 feet at great expense, and UJhereas all of the property owners abutting on said street have joined in ~a petition to the council to make the vacation and the council deems it to the best interest of the property owners of the area and to the general welfare of the ,City of Eugene that the street be narrowed from 50 to 25 feet, and jl~hereas improvements must either be made or abandoned at once, an emergency is therefore declared to exist and it is necessary for the immediate preservation of the peace, health and safety of the City of Eugene that this ordinance take effect immediately upon its passage by the Common Council and its approval by the Mayor, and it is so ordered.
