ORDINANCE NO. 8757
An Ordinance vacating the following described area, to-wit:
That certain protion of the 14 foot alley running east and west
through Block 34 of the Amended flat of Fairmount from the west
line of Lot 4 to the East line of Lot 12.
~ Also: That portion of the 14 foot alley of said Block 34, running
south and north between lots 10 and 11 from the south line of the
alley running east and west in said block to a point 230 feet
North from the Southerly line of said Block 34.
G'JHEREAS, heretofore and on the 26th day ,of October 1942, the Common Council
of the City of Eugene passed an Ordinance setting a hearing for December 14, 1942
in the Council Chambers at which time and place protests and remonstrances could
be hear as to the vacation of the following premises; to-wit:
That certain protion of the 14 foot alley running east and west
through Block 34 of the Amended Flat of Fairmount from the west
line of Lot 4 to the East line of Lot 12.
~ Also: That protion of the 14 foot alley of said Block 34, running
south and north between lots 10 and 11 from the south line of the
alley running east and west in said block to a point 230 feet
North fPom the Southerly line of said Block 34.
tk?HEREAS, a hearing was held pursuant to said Ordinance in the Council Chamber
in the City Hall in the City of Eugene on Tvionday, Decerrlber 14, 1942, at 7:30 0' clot
F.T4i. and at said time the Council heard all objections, and
4~.TIEREAS, all persons owning property abutting upon said area have consented
to said vacation, it being the purpose of said vacation to enable the State High-
way Commission to reconstruct the entire Judkin's Point area at tYie Eastern City
Limits of the City of Eugene and eliminate all of the railroad crossings for the
safety of the traveling public of the City of Eugene,
Now Therefore,
THE CITY OF EUGETv~E DOES ORDAIN AS FOLLOVdS:
Section 1. The Common Council of the City of Lugene finds that due and
legal notice of the said hearing was published and posted as required by law;
that no valid objection to said vacation has been made at said hearing, or filed;
that the consent of the owners of the abutting property, properly acknowledged,
has been filed in said pz~oceeding; and that the public interest will not be
prejudiced by the vacation of said area.
Section 2. What said hearing was held on December 14, 1942, at 7:30 o'clock
F.TU1. in the Council Chambers of the City Hall in Eugene, Lane County, Oregon, and
no objections or remonstrances were made or filed.
Section 3. That the follwoing described areas, to-wit:
That certain portion of the 14 foot alley running east and west
through Block 34 of the Amended flat of Iairmount from the west
line of Lot 4 to the east line of Lot 12.

north and south between lots 10 and 11 from the south line of the
alley running east and west in said block to a point 230 feet
north from the southerly line of said Bock 34.
be and the same is hereby vacated, and the area so vacated, being streets or alleys

shall revert to the abutting property pursuant to the statues of the State of Oregon.
Section 4. The recorder be and he is hereby directed to file a certified
copy of this ordinance with the Recorder of Line County, together with a map
or plat of said property, and that a certif ied copy of the ordinance shall be
filed vti~ith the County Assessor, and another certified copy of the ordinance
shall be filed with trie County Surveyor.
