HomeMy WebLinkAboutORDINANCE NO. 8758I 2 !~ 8 ORD II~~ANCE NO . 8 7 58 An Grdinance vacating the following described areas, to-wit: ' That certain portion of Franklin Boulevard in the City of Eugene Lying between the wTorth line of Eighth Avenue and a line extended from the intersection of the Ivxortli line of Broadway and the v westerly side line of Franklin Boulevard to the intersection of the Southerly line of Broadway extended easterly with the easterly ', side line of Franklin Boulevard. That certain section of Eighth Avenue in the City of Eugene lying between the westerly line of the Southern Pacific Company's right of way extended across the said avenue and the westerly line of Franklin Boulevard. That certain section of Broadway in the City of Eugene, lying ~ between the westerly line of the Southern Pacific Company's right of way extended across Broadway and the Westerly line of Franklin Boulevard. SAVING AND ExCEPTING from the vacation of Eighth Avenue and Franklin Boulevard that certain section of the intersection of Eighth Avenue and Franklin Boulevard lying between the revised easterly right of way line of the Southern Pacific Company and the existing easterly right of way line of Franklin Boulevard and bounded on the north by the north line of Eighth Avenue and on the south by the center line of Eighth Avenue extended easterly to an intersection of the easterly right of way line of Franklin Boulevard, to be used as a roadway to the adjoining property. ~dHEREAS, heretofore and on the 26th day of October, 1942 the Common Council of the City of Eugene passed an Ordinance setting a hearing for December 14, 1942, in the Council Chambers at which time and place protests and remonstrances could be heard as to the vacation of the following described premises, to-wit: That certain portion of Franklin Boulevard in the City of Eugene ~~ lying between the North line of Eighth Avenue and a line extended from the intersection of the North line of Broadway and th e ~ ~ westerly side line of Franklin Boulevard to the intersection of the Southerly line of Broadway extended easterly with the easterly side line of Franklin Boulevard. That certain section of ~i~ighth Avenue in the City of Eugene ~ lying between the westerly line of the Southern Pacific Company's right of way extended across said avenue and the westerly line of Franklin Boulevard. That certain section of Broadway in the City of Eugene lying between the westerly line of the Southern Pacific Company's right of vvay extended across Broadway and the westerly line of Franklin Boulevard. and, 1~"HEi~EAS, a hearing was held pursuant to said Ordinance in the Council Chambers in the City Halp in the City of Eugene on Illonday, December 14, 1942 at 7:30 o'clock I'. N. of said day and at said time the Council heard all objections, at73 lc.'-~~:AS, all persons ownir_g property abutting upon said areas have consented ~ to said vacation, it being the purpose of said vacation to enable the State Highway Commission to reconstruct the entire Judkin's Point area at the Eastern City Limits of the City of Eugene, and eliminate all of the railroad crossings for the safety of the traveling public of the City of Eugene, and V',tII~REAS, after investigation and hearing, and being fully advised, the Council 2()9 finds that it is necessary that exception shall be made as to a passage-way permitting ingress and egress by certain of the consenting abutting owners, Now, Therefore, THE CITY OF EUGENE DOES ORDAIN AS FOLLOti`JS: Section 1. The Common Council of the City of Eugene finds that due and legal notice of the said hearing was published and posted as required by law; that no valid objeetian to said vacation has been trade at said hearing, or filed; that the consents of the owners of the abutting property properly acknowledged have been filed in said proceeding; and that the public interest will not be prejudiced by the vacation of said areas. Section 2. That said hearing was held on December 14, 1942, at 7:30 o'clock in the Council Chambers of the City Hall in Eugene, Lane County, Oregon, and no objections or remonstrances were made or filed. Section 3. That the following described areas, to-wit: That certain portion of Franklin Boulevard in the City of Eugene lying between the north line of Eighth Avenue and a line extended from the intersection of the North line of Broadway and the ~,v'esterly side line of Franklin Boulevard to the intersection of `" the southerly line of Broadway extended easterly with the easterly side line of Franklin Boulevard. That certain section of Eighth Avenue in the City of Eugene lying ~- between the westerly line of the Southern Pacific Company's right of way extended across said avenue and the westerly line of Franklin Boulevard. SAVING AND EXCEPTING from the vacation of Eighth Avenue and Franklin Boulevard that certain section of the intersection of Eighth Avenue and Franklin Boulevard lying between the revised easterly ~ rigrtt of way line of the Southern Pacific Company ahd the existing easterly right of way line of Franklin Boulevard and bounded on the north by the north line of Eighth Avenue and on the south by the center line of Eighth Avenue extended easterly to an inter- section of the easterly right of way line of Franklin Boulevard, to be used as a roadway to the adjoining property. be and the same is hereby vacated, and the area so vacated being streets, shall revert to the abutting property pursuant to the statutes of the State of Oregon; specifically reserving however, to the City of Eugene and to any of its agencies, all utilities of every character in the within vacated area, with the right of operating, maintaining, repairing and re-building the same. Section 4. The City Recorder be and he is hereby directed to file a certified copy of this ordinance with the Pecorder of Lane County, together with a map or plat of said property, and that a certified copy of the ordinance shall be filed with the County Assessor, and another certified copy of the ordinance shall be filed with the County Surveyor.
