I; i VVhe.reas, heretofore and on the 23rd day of Tdovember 1942, the Common Council of the City of Eugene passed an Ordinance setting a hearing for December 28, 1942, in the Council Chambers at which time and place protests and remonstrances could be heard as to the vacation of the following premises; to-wit: Beginning at t'rie intersection of the easterly line of Fairmount Boulevard and the northerly line of liambe Avenue, as laid out and platted in the City of Eugene, running thence easterly along the north line of said Ramble Avenue to the east line of Ramble Addition; thence South 12.65 feet; thence westerly 12.5 feet distance from and parallel to the north line of said iIamble Avenue, to the easterly line of Fairmount Blvd. thence north- easterly along the easterly line of Fairmount blvd. to the place of beginning. VJli~ftEAS a hearing was held pursuant to said Ordinance in the Council Chambers in the City Hall ih the City of Eugene on iJionday, December 28, 1942 at 7:30 o'clock 21~ and at said time the Council heard all objections, and ttiHE1tiEAS all persons owning property abutting upon said area have consented to said vacation, it being the purpose of said vacation to enable the City of Eugene to narrow Ramble Avenue from 50 feet to 25 feet because Ramble Avenue is a dead-end street serving six owners-and it is beautified by trees and shrubbery within the street which, if the street is widened must be removed, and for uses for which it shall be subjected, there is no occasion for improving the full vvidth of 50 feet at great expense to the City of Eugene. Now, Therefore, THE CITY OF EUGET~~E DOES ORDAIN AS FOLLOV'dS: Section 1. The Common Council of the City of Eugene finds that due and legal notice of the said hearing was published and posted as required by law; that no valid objection to said vacation Ylas been made at said hearing, or filed; that the consent of the owners of the abutting property, properly acknov~rledged, has been filed in said proceeding; and that the public interest will not be prejudiced by the vacation of said area. Section 2. That said hearing w~:s held on December 28, 1942 at 7:30 o'clock P. zap. in the Council Chambers of the City Hall in Eugene, Lane Oounty, Oregon, and no objections or remonstrances were made or filed. Section 3. That the following described areas, to-wit: Beginning at the intersection of the easterly line of Fairmount Boulevard and the northerly line of :amble Avenue, as laid out and platted in tYie City cf Eugene running thence easterly along the north line of said Ramble Avenue to the east line of ~iamble Addition; thence South 12.64 feet; thence westerly 12.5 feet distance from and parallel to the north line of said Ramble Avenue, to the easterly line of Fairmount Boulevard, thence nortr~easterly along the easterly line of Fairmount Boulevard to the place of beginning. Beginning at the intersection of the easterly line of ?~airmount Blvd., and the Southerly line of ~Iamble Avenue as laid out and platted in-the City of Eugene, running tYience easterly along the Southerly line of said Harnble Avenue 173.6 feet; ti~ence north- westerly 30 feet to a point 12.5 feet measured at right angles to the southerly line of Ramble Avenue; thence vaesterly 12.5 feet from and parallel to the south line of ?amble Avenue to the easterly line of Fairmount Blvd., thence southwesterly along tree easterly line of Fairmount Blvd. to the place of beginning. Beginning at the intersection of the south line of Hamby Avenue and the east line of Ramble Addition, as laid out and platted in the City of Eugene, running thence north 12.65 feet; thence north- westerly 12.5 feet distance from and parallel to the said south line of IIamble 1avenue 290 feet, to the point of curve of a curve having a lU foot radius; thence on the circumference of said cuazve to its intersection v~iith the northerly line of the alley as platted in Ramble Addition ; thence on a curve to the left having a four foot radius. to its intersection vti=itYi the southerly line of said Ramble l-avenue; thence easterly along the southerly line of Ramble Avenue to t~~e place of beginning. be and the same is hereby vacated, and the area so vacated, being a street, shall revert to the abutting property pursuant to the statutes of the State of Oregon, specifically reserving, ho~rdever, to the City of 'Eugene and to any of its agencies, all utilities of every character in the within vacated area, with the right of operating, maintaining, re paining and re-building the same. 213 Section 4. Tile Recorder be and he is hereby directed to,file a certified copy of this ordinance with the Clerk of Lane County, together vaith a map or plat of said property, and that a certified copy of the ordinance shall be .filed with the County hssessor, and another certified copy of the Ordinance shall be filed with the County Surveyor.
