HomeMy WebLinkAboutORDINANCE NO. 8761I 214 ORDINANCE NO. 8.7,61 An Ordinance regulating the parking of vehicles (including bicycles) upon the streets of the City of Eugen e, including parking meter regulations, and prescribing penalties for the violation thereof, and repealing all ordinances or parts of ordinances in so far as they are in conflict herewith, and declaring an emergency. THE CITY OF EUGENE DOES ORDAIN AS FOLLOWS: Section=~.1. (a) The term "street" as used in this ordinance shall apply to all that part of the public highway, bridge or alley intended for the public x use of vehicles or street cars and generally known as the roadway. (b) The term "curb" shall mean the extreme edge of the traveled portion of the street or roadway. (c) The term "vehicle" shall mean every mechanical device by which persons or property are transported over the streets and alleys of the City of Eugene, including bicycles. (d) The term "emergency vehicle" shall mean ambulance, fire, police, public service emergency and United States mail vehicles while engaged in emergency business. (e) The term "driver" shall mean the rider, driver or leader of a horse or horses, or any person who pushes or propels a vehicle upon the streets. (f) The term "park" or "parked" shall mean and apply to arty standing vehicle, and the term "double park'r or "double parked" shall mean and apply to any standing vehicle where the shortest distance from any part of said vehicle t;~the curbing on the side of the street on which said vehicle is standing is more than three feet. Section 2. All vehicles parked or left standing on any street or alley in the City of Eugene, except upon the streets or alleys where angle parking is expressly permitted under the provisions of this ordinance, shall be parked parallel to the curb and not more than six inches distant therefrom and not within a distance of three feet from any other vehicle in front or behind thereof, and all parking being done with a view to economy of space, all vehicles shall draw up to a distance of three feet from the nearest vehicle, and in no other manner, excepting where angle parking is permitted, and excepting the space opposite to the vehicle entrance to any residence property is reserved to the owner or occupant of said property, and excepting further all marked areas for special uses. Section 3. It shall be unlawful for the driver of any person or persons to park or leave standing any vehicle in anyplace upon the streets of Eugene other than between curb or curb lines and as provided in this ordinance and/or marked upon the streets themselves. Section 4. It sha 11 be unlawful for the driver or any person or persons to 215 double park any vehicle on any street or alley of the City of Eugene, and a vehicle is presumed to be double parked whether anyone is in charge thereof or not, unless loading or unloading passengers therefrom. Section 5. ~It shall be unlawf ul for the driver or any person or persons to park or leave any vehicle standing apon the streets or alleyss of the City of Eugene continuously for more than two hours from twelve o'clock midnight to five o'clock in the morning of said day. Section 6. It shall be unlawful for the driver or any person or persons to park or leave any truck, delivery wagon, or transfer wagon standing on any alley of the City of Eugene except in the process of loading or unloading goods, wares, merchandise, or freight thereon or therefrom. Section 7. It shall be unlawful for the driver or any person or persons to park any vehicle in any alley in the City of Eugene except during the process of loading or unloading goods, wares or merchandise or freight thereon or therefrom or while actually engaged in the loading or unloading of passengers or occupants of said vehicle. Section 8. The following is dee.~r~ed a limited parking zone in the City of Eugene and it shall be unlawful for the driver or any person or persons to park or leave any vehicle standing on any street or alley within said zone fora period of time exceeding one hour at any time from nine o'clock A.T~?., until six o'clock P.N~. of any day excepting Sundays, kith the exceptions and qualifications herein- af ter noted. The boundaries of the zone shall be deemed to include both sides of the boundary streets: Beginning at the corner of Sixth St. and Cha rnelton St., and thence South on Charnelton St. to Twelf th St., then follow Twelfth St. from Charnelton St. to Olive St. ; thence follow Olive St. frorr~ Twelfth St. to Eleventh St. ; thence follow Eleventh St. from Olive St. to tli;illamette St. ; thence South on Villamette St. to Thirteenth St.; thence follow Thirteenth St. East- ~rVillamette St. to Oak Street; thence follow Oak St. North, Thirteenth St. to Twelfth St.; thence follow Twelfth St. East, Oak St. to Pearl St.; thence follow Pearl St., Twelfth St. to Broadway; thence follow Broadway, Pearl St. to High St. and return; thence follow Pearl St., Broadway to Eighth St.; thence follow Eighth St. to the railroad track and return; thence follow Pearl St. to Sixth St.; thence follow Sixth St., Pearl to the alley between Willamette St. and Oal St.; thence TtiTOrth on the alley between Willamette St. and Oak St. to the southern Pacif ie Right of Way, and thence Northwesterly along the South line of the Southern Pacific Right of way to Olive Street produced; thence South on Olive St. produced to the intersection of Sixth St. and Olive St.; thence West on Sixth Street to the place of beginning. The following shall have a twelve minute limitation: The West side of Villamette St. from Fifth St. to the half block south of Fifth Street; the south side of Fifth St. from Willamette St. , UVest half block;. And a thirty minute limitation on both sides of Charnelton Street between Broadway and Tenth Streets and the South side of Braadway from Charnelton St. Last to alley. All marked loading zones shall have a twenty-four minute limitation. No vehicle other t~ian a truck shall be permitte on a loading zone. In addition to the foregoing, theaters and hotels and certain public buildings are marked on the curb and parking is prohibited where so indicated excepting only 216 for the momentary loading and unloading of passengers or freight, and-ahl'curbs marked yellow a ~~prohibited areas for parking; truck parking marked green; and general parking white. In the following areas parking is prohibited: Nineteenth St. between tiVillamette St. and Olve St.; - Ferry St. between Eighth and Ninth St.; The 1.°uest side of Patterson St., riilyard St. and Alder St. from Broadway to Eleventh Avenue.; The Vilest side of Alder St. from Thirteenth St. to Nineteenth St.; Thirteenth St. from Kincaid to University St.; Trie I~~orth side of Thirteenth St. from University St. to Onyx St. ; The South side of Eleventh St. to ~:illamette St. to the alley between trdillamette St. and Olive St. ; It shall be unlawful to park between said hours upon Thirteenth Avenue between Alder Street and Kincaid Street longer than one hour. Section 9. The moving of any car within the block shall not be deemed to extend the time of parking. Section 10. That all traffic on IUorth, South, East and V'¢est Park Streets shall be one-moray traffic and that all vehicles traveling upon said streets shall travel in the following direction and no other, to-wit: Vehicles traveling on u`'est Park St. shall travel from North to South; Vehicles traveling on South Park St. shall travel from ~~dest to East; Vehicles traveling on East Park St. shall travel from South to North; Vehicles traveling on l~Torth Park St. shall travel from East to ~`iest; and it shall be unlawful for any driver or person or persons to drive or propel any vehicle on any of said streets except as in this section provided. Section 11. It shall be unlawful for the driver or any person or persons to turn or permit to be turned any vehicle between street intersections on any street in the City of Eugene. Section 12. It shall be unlawful for any driver or• any person or persons to make a complete turn or reversal of direction commonJ_y known as a "L' Turn" of any vehicle at the intersection of Vdillamette Street with Sixth Avenue, Seventh Avenue, Eighth Avenue, Broadway, Tenth Avenue, Eleventh Avenue, Thirteenth Avenue or at Broadway and Oak or iri any intersection of any street with the Pacific highway within the City of Eugene. Section 13. Only angle parking shall be permitted on North, South, East and Vilest Park Streets, excepting that portion reserved for horses and horse drawn vehicles. Section 14. That on Kincaid Street between Thirteenth Avenue and University High School only angle parking shall be permitted. 1~7otor veriieles may be parked at an angle on~said streets at all hours of the day or night. Section 15. It shall be unlawful for the driver or any person or persons to stop, park, or permit any vehicle to stand on any street in the City of Eugene, 21'7 within twenty feet of any fire hydrant, or within ten feet of the property line at the corner of any street intersection or upon any bridge, culvert or approach or in front of the vehicle entrance or marked reserve space to any property. - f t i~ j~ Section 16. Every motor vehicle operated in the City of Eugene shall be equipped with a muffler and it shall be unlawf ul for any person or persons to ~~ ~ run or operate any motor vehicle in the City of Eugene unless the muffler is MI closed when the same is being operated upon the streets of the City of Eugene. j I, Section 17. It shall be unlawful for any person to park any automobile '~, upon the streets of tiie City of Eugene not in conformity with the provisions i ~ of this ordinance. Section 20. It shall be unlawful for any person, firm or corporation to: Park or stor any vehicle upon any property of the City of Eugene excepting upon written permission from the Chief of Police. III Section 21. Nothing herein contained shall prevent the use of the city 1 property by the city and its employees and agents for any purpose that the i~ city wishes to make of it and shall not be deemed to prohibit the ordinancy use ~I of ways and roadsides in parks of the city except upon areas where the parking I) of automobiles will damage the improved grounds. Section 22. All cars parked within the City of Eugene sha 11 comply with I~ ~~ the state law with reference to the hours and method of lighting provided by ~~~ the state law except that where a vehicle shall be parked in accordance with the city ordinance of the city or upon the street where there is sufficient ~~ light to reveal any persons within a distance of two hundred feet upon such street 1 or highway, no lights need be displayed upon such vehicle. PARKING METERS: Section 23. DECLARATION OF PURPOSE: As a means of relieving motor vehicle I traffic congestion within certain business district of the City of Eugene caused by the double parking and overtime parking of motor vehicles and a general abuse of parking privileges, and for• the purpose of establishing an efficient system applicable for the enforcement of parking regulations, and to facilitate a ~~ greater freedom for the motor vehicle user in transacting business requiring a r a ive short eriod of time within the times hereinafter desi nated and as an el t p g 21 ~ _ ~~ _` -- - - - -- - - - - - - - __ - r exercise of the police power, the City Council hereby adopts and ratifies the installation and use of parking meters as already established and as hereafter established by the Police Committee by the placing of parking meters upon the streets. Section 24. PARKING PlIETER TIME AND FEES; A parking meter fee of Five Cents 00.05) shall be paid by all persons parking a motor vehicle using metered parking time for one hour and a parking meter fee of One Cent (0.01) shall be paid by all persons parking a motor vehicle using metered parking time for twelve minutes, all as provided by the legend on the meter. Provided, however, that parking meter space may be used without charge on Sundays and legal holidays, and may be used on other days of the week between six o'clock P.M. and nine o'clock A.Ni., and delivery motor vehicles may use loading parking meter space without charge on any day. Delivery motor vehicles are trucks used for delivery purposes only. Section 25. PARKING ~~TER SPACE TO BE DESIGNATED: The City Engineer's off ice is hereby authorized and directed to place lines or marks on the curb or on the street or avenue about or along side of each parking meter to designate the park- ing space for which said parking meter is• to ~be used, and each motor vehicle parked along side of or next to any parking meter shall park within the lines or markings so established. It shall be a violation of this ordinance to park.any motor vehicle across any such line or mark or to park said motor vehicle in such a wqy that the same shall not be within the area so designated by such line or mark. Section 26. &~ANNER OF PARKING IN b7ETER PARKING SPACE; When any motor vehicle shall be parked in any phce along side of or next to which there is located a parking meter, the owner, operator, manager or driver of such motor vehicle shall upon entering the said parking space immediately deposit either a Five Cent or a One Cent coin of the United States in the parking meter along side of or next to said parking space and perform any mechanical act required by the directions posted on said parking meter, and the said parking space shall then be used by such motor vehicle during the parking limit provided by section 24 of the ordinance for the part of the street or avenue in which said parking space is located. If scald motor vehicle shall remain parked in any such parking space beyond the parking limit fixes by sa~cl section 24 of this Ordinance for such parking space, the parking meter shall display a sign showing illegal parking and in that event such motor vehicle shall be considered as parked overtime beyond the said period of time, and the parking of an automobile overtime or beyond the period of time fixed by section 24 of this Grdinance in any such part of the street or avenue where any such parking meter is located shall be a violation of this ordinance and punishable as hereinafter provided. It shall be unlawf ul for any person to cause, allow_ or permit or suffer any such motor vehicle registered in his name to be parked JT _ .._ r . . ) _ overtime beyond the lawful period of time as in this ordinance provided. Section 27. EXTENSIOi~T OF PARKING TI_~_E PROHIBITED: It shall be unlawful and an offense under this ordinance for any person to deposit or cause to be deposited in a parking meter, a coin for the purpose of extending the parking time beyond the time fixed by this ordinance for parking in the parking space along side of or next to which said parking meter is placed. The display of a sign showing illegal parking on any parking meter while a motor vehicle is parked in a space adjoining said parking meter shall be prlina facie evidence that:said motor vehicle has been parked overtime and beyond the parking period of time. Section 28. REGULATION AS TO COINS AND PROTECTION OF PARKING T~iETERS: It snall be unlawful and an offense to deposit or cause to be deposited in any parking meter, any slug, device or substitute for a coin of the United States. It shall be unlawful and a violation of this Ordinance for any person to deface, injure, temper with, open or wilfully break, destroy or impair the usefulness of any parking miter installed under the terms of this ordinance.. Section 29. FEE EXACTED AS A POLICE REGULATION: The coins required to be deposited as provided by this ordinance are levied as police regulation, supervision and inspection fees, to cover the cost of inspection, supervision and regulation involved in the inspection, installation, operation, control and use of tie parking spaces and parking meters described herein and involved in checking up and regulating the parking of motor vehicles in the parking meter district created by this ordinance. Section 30. Ii~~POUNDTDIG OF AUTOMOBILES: In tYie event any motor vehicle shall be found standing or parked in violation and contrary to any of the provisions of this ordinance, such motor vehicle shall be given a traffic tag, or be removed by the Bureau of Police and taken to a garage and there kept until the applicat~ior for• its redemption shall be made by the owner or his duly authorized agent, who shall be entitled to the possession thereof upon the payment to the City of the sum of (~2.U0). In the event the motor vehicle impounded shall not be redeemed within ten days, then such motor vehicle shall be sold after first publishing once in a newspaper in the City and postion ih three public places a notice of sucYi proposed sale, allto be done ten days before the date of the sale, such notice to describe the automobile and .the time and place of the sale. The impounding fee and cost provided for in this ordinance shall be cumulative of any and all other penalties that may be provided. Section 31. REGULATIONS AS TO LOADING AND UNLOADING Ih? PAR SING PJIETER DISTRICT No person shall stand or park or double park a motor vehicle in a loading zone in the parking meter district for tl~e purpose of loading or unloading passengers at any time. Delivery motor vehicles using parking meter space after twelve otclock noon shall comply with each and all of the provisions of this ordinance relating to the payment of the parking meter fee and time of meter parking. 219 ,. Section 32. DUTIES OF THE POLICE: It shall be the duty of the Police ~(JV ------- -- -- --- -- -- --- - -- - - - -- ~~r-' Depa rtment,through its officers to enforce the provisions of the ordinance. Section 33. COLLECTION OF PARKING METER FEE: It shall be the duty of the City Treasurer to designate either himself or some employee of his office to make regular collection of the money deposited in said parking meters. In this con- nection it shall be the duty of such persons so designated to pick up the sealed cylinders containing the coins as deposited in the parking meters and deliver said cylinders with the seals unbroken to the City Treasurer.'s office. It shall be the duty of the City Tz°easurer's off ice to break the seals and count the funds and deposit the same to the credit of a special fund called "Parking i~7eter Fund", which said fund shall be deposited on order of the Council. Section 34. Taxicabs and for-hire cars shall not park motor vehicles in any parking meter space except for the purpose of loading and discharging passengers, unless such motor vehicle shall pay the fee required by this ordinance, and taxi- cabs and for-hire cars shall stand only in the alloted spaces fixed by the Council by ordinance. It shall be unlawful for bicycles to be parked otherwise than as hereinafter provided and it shall be unlawful for any other vehicle to park in a designated bicycle parking area. BICYCLES Section 35. Bicycles may be parked next to the curb in the same manner as automobiles in any place in the city outside of Fire Zone No. 1 and outside the parking meter area. There is attached hereto, blueprint exhibits designated as f'A,B,C,D,E and F", each exhibit representing a city block and each exhibit designating by numbers parking areas in the meter district, and on each exhibit in red is shown a reserve parking area for bicycles as follows: On Exhibit "A", No. 21; on Exhibit "B", Nos. 19 and 24; on Exhibit "C", No. 20; on Exhibit "Dtt, 1~TO. 20; on Exhibit "E", No. 21; and on Exhibit "F", Nos. 6 and 20. In each of said spaces there shall be provided parking facilities for bicycles and bicycles may be parked in such area for a period not exceeding four hours in the downtown district. In all other parking areas, bicycles shall come under the general terms of this ordinance. Section 36. The City Engineer be and he is hereby directed and authorized to designate each of the reserve parking areas for bicycles upon the street itself by suitable markings. Section 37. All ordinances and parts of ordinances in conflict herewith are herewith and 'Hereby repealed to the extent of sucri conflict. Section 38. In addition to any other provisions and penalties provided in this ordinance, any person violating any of the provisions of this ordinance shall, upon conviction thereof in the Recorder's Court of the City of Eugene, be fined not to exceed Two Hundred Dollars(~200.00) and costs, and in default of the payment of such fine and costs, shall be imprisoned in the city jail one day for each two dollars (~p2.00) of such fine unpaid. 22~, Section 39. Inasmuch as the Ordinances of the City of Eugene now in force are inadequate to meet the present traffic needs of the City of Eugene in its present rapid growth, and in order that such traffic regulations may be more in harmony with the State Traffic Laws that now exist, and the enforcement of the traffic ordinances and regulations being imperative, the Common Council finds and declares that it is necessary for the immediate preservation of-the public health and safety of the City that this Ordinance become effective immediately and an emergency is hereby declared to exist and this ordinance shall take effect upoiz its passage by the Common Council and approval by the l~rayor.
