ORDINANCE NUMBER 8764
An Ordinance prohibiting dogs from running at large during the months of
April, May, June, July, August, and September in the City of Eugene, declaring
an emergency and providing penalties.
WHEREAS, The United States is engaged in a world-wide war which t~areatens
its existence, an d
WHEREAS, The National Administration ha called upon all citizens to adopt
every possible means of aiding in the vaar effort and in conserving the resources
of the country to that end, and has particularly emphasized the necessity of
creating a food reserve by means of Victory Gardens, and has called upon all
patriotic citizens to secure land and develop thereon a productive food garden,
and
WHEREAS, the Council will coincidentally with the passage of this Ordinance
publicly call upon all patriotic citizens owning dogs to keep them upon their
own premises during the emergency, and
WHEREAS, It is necessary that all citizens conform to the same patriotic
standard,
THEREFORE,
THE CITY OF EUGENE DOES ORDAIN AS FOLLOV~FS:
Section 1. That the word "dog" as used in this Ordinance shall mean
male and female dogs, either sterilized or not and whether licensed or not:.
Section 2. It shall be unlawful during the months of April, PJfay, June,
July, August, and September of any year in the City of Eugene for any owner of
a dag to permit the same to run upon premises, streets or alleys other than the
property of its owner unless it shall be under leash.
Section 3. It shall be unlawful for any dog to run at large in the City of
Eugene during the months of April, May, June, July, August and September of any
year.
Section 4. All Police officers of the City of Eugene and any special officer
appointed by the Chief of Police and confirmed by the Council are hereby author-
ized and directed to take up and impound any dog or dogs running at large in the
City of Eugene during the months of April, May, June, July, August, and Septerber
of any year.
Section 5. The Chief of Police is hereby authorized and directed to secure
a suitable place in which all impounded dogs may be confined and cared for during
their detention.
Section 6. Any officer impounding a dog shall report to the Police Department
upon a slip to be furnished, a description of the dog impounded giving the size,
color, weight, sex, breed and apparent age and his license number if any. The
Chief of Police shall cause notice to be given the owner of the dog if known or

disclosed by the license, by mail, and shall cause a notice to be published once
in the Eugene Register-Guard describing dogs so impounded and notifying the owner
or owners to immediately call for said dog, pay the cost of impounding, procure
a license if the dog has none, and give the Chief of Police reasonable assurances
that the dog will not again run at large. ~~=hereupon the Chief of Folice shall
direct that the dog be released to his owner.
Section 7. Five days after the publication of the notice hereinabove refer
to, the Chief of Police is authorized to sell any impounded dog or dogs ~o ad-
vertized to any purchaser who will pay his license fee and the cost of impounding
and will give the Chief of Folicd assurances that the dog v:ill no longer be
permitted to run at large during the prohibited period.
Section 8. Ten days from the date of the publication of the notice any dogs
uncalled for shall be killed in a humane manner under direction of the Humane
Society.
Section 9, Any dog owner, believing himself aggrieved by the seizure and
impounding of his dog may apply to the City Recorder for the release of such dog
and the City Recorder shall thereupon set a time and place for hearing such
application and notify the Chief of Police and upon a summary hearing at such titre
and place, the City Recorder shall have full power to determine whether the dog
has been wrongfully impounded and v~hether he shall be returned to his owner and
upon what terms.
Section 10. Any person, firm, or corporation violating any of the provisions
of this ordinance shall upon conviction thereof in the Recorder's Court be fined
not to exceed X25.00 and the costs of the prosecution and upon default in payment
of the fine may be imprisioned in the City Jail one day for each y~2.00 of such
fine unpaid.
Section 11. 1~,'HEREAS~: the United States is at War and the Administration
had declared that the tttaintenance of Victory Gardens are essential to the national
preservation, and WHEREAS no whole hearted corr~pliance with the Administration's
policy can be had if dogs are permitted to run at large and destroy gardens, and
baHEF~~'AS, the time has arrived for the preparation of gardens andr_the rfore
an emergency is declared to exist and trte Council declares it to be necessary
for the peace, health and safety of the City of Eugene that this ordinance take
effect immediately upon its passage by the Common Council and its approval by the
1~~ayor, and it is so ordered.
