ORDINANCE NO. 8765
An Ordinance providing for• the regulation of hotels, rooming houses and
lodging houses within the City of Eugene requiring permits and providing penalties
and declaring an emergency.
THE CITY OF EUGEIV'E DOES ORDAIN AS FOLLOV~zS:
Section 1. That commencing January 1, 1943, it shall be unlawful for any
person to conduct, keep, manage, operate or cause to be conducted, kept, managed,
or operated, either as owner, lessor, lessee, agent or attorney, any hotel,
rooming house or lodging house within the corporate limits of the City of Eugene
without having first obtained a permit from the Council entitling him so to do
as provided in this Ordinance.
Section 2. For the purposes of this Ordinance, the word "person" shall
mean and include natural persons, co-partnerships, corporations and associations,
and shall include per•Nons of both sexes. The word t1houset' shall mean and include
hotels, rooming and lodging houses.
Section 3. For the puuposes of this Ordinance, a hotel rooming house or
lodging house shall be and is deemed to be any house or building containing six
or more rooms vvhicri are kept and maintained for sleeping or lodging purposes and
which are offered to the public for rental or• hire, either- for steady roomers or
transients.
Section 4. No permit shall be granted to any applicant or to any hotel,
rooming house or lodging house e;xcept that the applicant shall b,e a person of
good moral character and shall be qualified in all respects to operate a hotel, ro
ing house, or lodging house, and in case of having operated such a house have a
good record as a law abiding citizen and having operated an orderly place; and
no permit shall be granted f'or the operation of any hotel, rooming house or
lodging house which hotel, rooming house, or lodging house does not conform and
comply with the regulations of the Ordinances of the City of Eugene generally
and particularly with respect to fire hazard, the Building Code, and sanitary
regulations.
Section 5. ~~Jhenever an application shall be made for a permit for• the
operation of a hotel, rooming house, or lodging house, the Council shall require
reports from the Chief of the Fire Department, the Chief of Police and from the
Chair-man of the Health Committeeof the Council as to the hotel, rooming house
or lodging house complying with the regulations and ordinances of their particular
departments and the Chief of Police shall make a particular examination and report
both a;_: to the character of the hotel, rooming Douse, or lodging house and of
the applicant witYi respect to their police record and if the Council shall be
satisfied that the applicant and the hotel, rooming house, or lodging house both
comply substantially with the foregoing requirements a permit shall be issued

and in case trey shall find that either the applicant or the hotel, rooming house,
or lodging house does not substantially comply with the foregoing requirements,
the permit shall be denied; provided, however that in case the applicant shall
be agrieved at the denial of his ,application, that the Council shall permit the
applicant to be heard in person before the denial shall become absolute.
Section 6. Eacl2 permit shall run during the current calendar year and shall
terminate on the 31st day of December following the issuance of the permit; and it
is reserved to the Council the right at any tune for any of the reasons set out
in Section 4 to revoke any permit granted in the same manner as it vv~as previously
granted.
Section 7. 1~o permit issued under the terms of this Ordinance shall be
transferred or assigned without the consent of the Common Council.
Section 8. No person to whom a permit sha 11 be issued as provided in this
Ordinance shall suffer or permit the hotel, rooming house or lodging house to
which such permit relates, to be used as a house of ill fame, brothel, bawdy
house, or disorderly house, for the purpose of prostitution, fornication or
lewdness, or suffer any lascivious cohabitation, adultery, fornication or other
immoral practice to be carried on therein, or suffer or permit any disorderly
conduct in said hotel, rooming house, or lodging house, as disorderly conduct
is now or• may hereafter be defined by tl~e Ordinances of the City of Lugene.
Section 9. l~?o person to whom a permit shall be issued to conduct and operate
a hotel, rooming house or lodging house shall in said house sell, barter, exchange
oz' otherwise dispose of spirituous liquor, malt or vinous liquors, or suffer any
such liquor to be sold, bar•ter•ed or otherwise disposed of therin, except as
provided in the State Law of Oregon, or permit or suffer any gambling of any
kind therein.
Section 10. Every person totwhom a permit shall have been issued to conduct
a hotel, rooming house, or lodging house shall at all times keep a standard hotel
register in which shall be inscribed the names of all guests or persons rentir_g
or occupying rooms in such house, which register shall be signed by the persons
renting the room or• rooms, or by someone under his direct3.on. Such registration
must be made, and after the name or names are inscribed or registered the manager
of the house, orhis agent shall write the number of the room or rooms which said
guest or pez°s on is to occupy, together with the time when such room is rented.
All of which shall be done before such person is permitted to occupy such room
or rooms. Such register shall be at all times open to inspection`.'by any guest
of the house evherein such register is kept and to any executive or peace officer
the City of Eugene, or of the State of Oregon.
Section- 11. It shall be unlawful for any person to write or cause to be
written in any hotel register any other or different name than the true name of
such person, or the name b,y which sucl2 pez°s on is generally known.

Section 12. No rooms or romm shall be assigned to two persons of the
opposite sex, except in cases of children accompanied by parents or guardian,
unless such persons shall be registered as husband and wife.

Section 14. Any person to whom a permit shall have been issued as provided
in this Ordinance, shall cause each sleeping room or apartment in suc,:~ house to
which such permit relates, to be numbered in a plain and conspicuous manner, the
number to be placed on the outside of the door to such room, and no two such
doors shall bear the same number.
Section 15. Where a permit shall have beers issued to any co-partnership,
corporation, or association to conduct a hotel or rooming house or lodging house,
any person having charge, management or control of such hotel, rooming housed or
lodging house, as well as the ovaner or proprietor, shall be liable to prosecution
for any violation of the provisions of this Ordinance.
Section 16. For the purpose of determining the liability of any person or
persons to prosecutions for violating any of the provisions of this Ordinance,
it shall be sufficient to show that sucYz person vras at the time of the act of
violation complained of, the person in actual charge, management, or control of
the house in which such act is alleged to have been committedl
Section 17. The City. Recorder of tge City of Eugene shall keep an indexed
record of pez°mits issued pursuant to the provisions of this Ordinance, together
with a record of convictions for violations of the provisions of this Ordinance.
Section 18. Any person violating any of the provisions of this Ordinance,
upon conviction thereof, shall be punished by a fine of not more than two hundred
(200.00) dollars and costs, and in default of the payment of such fine, to be
imprisoned in the City jail one day foi~ each X2.00 of sucri fine.
Section 19. The City Recorder shall report to the Common Council the
prosecutio:.1 or conviction of any person to whom a permit has been issued, and
the Common Council may thereupon revoke and terminate the permit so issued to such
person.
Section 20. Tn addition to the remedies provided for herein, it shall be
the duty of the Chief of Police whenever a hotel, rooming house, or lodging house
shall be operating without a permit and has no application pending, t~~ give the
person in charge a written notice to close said place and evict all tenants

therefrom within five days from such notice, and at the expiration of such period
the Chief of Police shall summarily close the offending hotel, rooming house
or lodging house and not permit the same to be operated further.
Section 21. Nothing in this Ordinance contained shall be construed to apply
to any eleemonsynary, religious, benevolent or charitable association or to any
student fraternity or sorority houses or dormitories conducted at or near the
University of Oregon.
Section 22. All Ordinances and parts of Ordinances in conflict herewith
are hereby repealed.
Section 23. 4Jhereas, hotels, rooming houses and lodging houses are operated
in the City of Eugene that are not complying with the fire hazard, building and
sanitary regulations of the City of Eugene, and that they constitute a rr~enance and
a danger to lives and property, an emergency is declared to exist and it is
hereby declared that it is necessary for the immediate preservation of the peace,
health and safety of the City of Eugene that this Ordinance take eft_'ect immediatel;
upon its passage by the Common Council and its approval by the Mayor and it is
so Ordered.
