Ordinance No. 8766
An Ordinance amending Ordinance No. 8764 entitled "An Ordinance prohibiting
dogs from running at large during the months of April, May, June, July, August,
and September of any year in the City of Eugene, declaring an emergency and
providing penalties," passed by the Common Council on the 22nd day of NTarch, 1943
and approved by the Mayor on the 23rd day of NTarch, 1943.
TIC CITY OF EUGENE DOES ORDAIN AS FOLLO~~JS:
Section 1. That Ordinance No. 8764 entitled "An Ordinance prohibiting
dogs from running at large during the months of April, Tray, June, July, August,
and September of any year in the City ,of Eugene, declaring an emergency and
providing penalties," passed by the Comrrion Council on the 22nd day of March, 1943
and approved by the TvTayor on the 23rd day of March 1943 be amended so that
Section 6 thereof shall read as follows:
"Section 6. An officer impounding a dog shall report to the., Police Department
upon a slip to be furnished, a description of the dog impounded giving the
size, color, weight, sex, breed and apparent age and his license number,
if any. The Chief of Police shall cause notice to be given the owner of
the dog if known or disclosed by the license, by mails and shall cause a
notice to be published once in tYie Eugene Register-Guard describing dogs so
impounded and notifying the ov4ner or ownez~s to immediately call for said dog,
pa,y the costs of impounding, procure a license if the dog has none, and
give the Chief of Police reasonable assurances that the dog will not again
run at large. Upon compliance by the owner, the Chief of Police shall direct
that the dog be released to his owner, and the owner exonerated."
And that Ordinance TV'o. 8764 be further amended so that Section 10 thereof shall
read as follows:
"Section 10. Any person, firm or corpmatian violating any of the provisions
of this ordinance shall upon conviction thereof in the Recorder's Court be
fined not to exceed :10.00 and the costs of the prosecution and upon default
in payment of the fine, may be imprisoned in the City Jail one day for each
X2.00 of such fine unpaid."
And that it be further amended by adding thereto section 102 reading as follows:
"Section 102. That the Counci_1 hereby declares that dogs running at large
during the garden season, polluting streets and vegetation and trespassing
upon private property is hez°eby declared to be insanitary, a threat to
public health, and a public nuisance."
Section 2. VtTH:[~.;REAS, the United Stated is at VVar and the Administration has
declared that the maintenance of Victory Gardens is essential to the national
preservation, and
Ut~I~REAS, NO whole-hearted compliance with the administration's policy can
be had if dogs are permitted to run at la me and destroy gardens, and
V~HEREAS, the time has arrived for the preparation of gardens and theref ore
an emergency is declared tm exist ahd the Council declares it to be necessary for
the peace, health, a¢Id safety of the City of Eugene that this Ordinance take effect
immediately upon its passage by the Com on Council and its approval by the Mayor,
and Tt is So Ordered.
