HomeMy WebLinkAboutORDINANCE NO. 8768 1 2~3 ORDINANCE 8768 An Ordinance authorizing the making of a dump tenderts contract. THE CITY OF EUGENE DOES ORDAIN AS FOLLOWS: Section 1. The Mayor and City Recorder- of the City of Eugene be and they are hereby authorized and directed to execute and deliver, on behalf of the City of Eugene, that certain garbage contract with R. R. Hughes, a copy of which is hereto attached and made a part of this ordinance. Passed by the Common Council this 28th day of June, 1943. /s/ John Fields Recorder Pro Tem Approved by the Mayor this 30th day of June, 1943. /s/ Elisha Lame Mayor THIS CONTRACT AND AGREEMENT, Made and entered into this 1st day of July, A.D. 1943 by and between the City of Eugene, a municipal corporation, party of the first part, and R. R. Hughes, party of the second part; V~ITNESSETH That, Whereas, the City of Eugene maintains a garbage dump on property owned by the City South of the City Limit's and the second party has heretofore been in charge of the same under a former contract, and the City's fascal year commences on July 1, 1943, Therefore, it is agreed between the parties hereto that the second party shall care for the City's garbage dump in a sanitary and workmanlike manner, complying with all laws and ordinances applicable thereto for a term of one year, commencing July 1, 1943 and terminating June 30,-1944 and sha 11 receive therefor Prom the City of Eugene y~118.75 on the first day of August, 1943 and X118.75 on the first day of each succeeding month throughout the term of this contract. As an additional compensation for the care of the garbage dump the City of Eugene grants to the second party the exclusive right o:i salvage o.f all garbage and waste material which shall be gathered in the City of Eugene, and this shall constitute a property right which the second party may exercise. It is further af~reed that the City has amended its garbage ordinance pro- viding that garbage haulers desiring to retain edible portions of the garbage for feeding purposes may do so upon payment of X25.00 per quarter, and there being three garbage haulers, the City hereby agrees to pay over such additional license charges to the seccna pulpy not to exccea alLOgeLner a total cor~LpensaLion oz' ~y143.75 per month.
