An Ordinance adopting the survey, plat and report of the City Engineer
as to the proposed opening of Fillmore Street from the alley south of Sixth
Avenue West to Seventh Avenue Vdest in Eugene, Oregon.
THE CITY OF EUGENE DOES ORDAIN AS FOLLOWS:
Section 1. That the survey, plat and report of the City Engineer upon
the proposed opening and establishment of Fillmore Street from the alley south
of Sixth Avenue west to Seventh Avenue west in Eugene, Oregon, made and filed
by him with the City Recorder on November 6, 1943, pursuant to the resolution
of the Common Council of the City, passed on October 25, 1943, is deemed
satisfactory and is hereby adopted as so made in the words and figures following,
to-wit:

GENTLEMEN
Pursuant to the resolution of October 25, 1943 I herewith submit a rep
of the survey for the opening of Fillmore Street from the alley south of 6th
avenue west to 7th avenue west in Eugene, Oregon. I have made a survey of the
proposed opening and have marked the boundaries thereof.
This report contains:
First: A f ull and complete description of such street and boundaries
thereof, and of the portion of each tract of land to~be appropriated therefor.
Second. A plat showing the proposed opening together with adjacent
property.
Third. The present owners of adjacent property which may be bene-
fited by such opening.

DESCRIPTION OF LtiND TO BE TARN FOR THE OPENING OF FILLMORE STREET
FR011~1 THE ALLEY SOUTH OF SIXTH AVENUE WEST TO SEVENTH AVENUE WEST.
Patrick C. Collins-
Beginning at a point in the south line of the alley and the east line
of Fillmore street in block 1, Grand Prairie Addition to Eugene, Lane County,
Oregon; and running thence west along said alley line 33.0 feet, thence south
along the center line of said Fillmore Street, if extended, 80.0 feet, thence
west 33.0 feet, thence south along the west line of said Fillmore Street, if
extended 82.24 feet to the north line of Seventh Avenue west, thence east along
the north line of seventh avenue west 66.0 feet; and thence north 162.27 feet
to the place of beginning.

at its intersection with the South line of the alley in blocks 1 and 2 Grand Praiz
Addition to Eugene, Lane County, Oregon; and running thence west along said alley
line 33.0 feet, thence south 40.0 feet, thence east 33.0 feet to said center line,
and thence north 40.0 feet to the place of beginning.

Beginning at a point in the center line of Fillmore street, if extended;
40 feet south of the south line of the alley in blocks 1 and 2 of Grand Prairie
Addition to Eugene, Lane County, Oregon; and running thence west parallel with
sa-id alley line 33.0 feet, thence south 40.0 feet, thence east 33.0 feet to the
said center line of Fillmore Street, and thence north 40.0 feet to the place of
beginning.
Section 2. That to open and establish said street, it will be necessary
to acquire the land as shown by said report and the City of Eugene does hereby
determine to acquire said land mentioned and described in said report for the
purpose of opening, extending and establishing said Fillmore Street from the
alley south of Sixth Avenue west in Eugene, Oregon.
Section 3. That F. N. Bennett, James A. Rodman and ~°~m. R. Robertson
three disinterested free-holders of the City of Eugene and each possessing the
qualifications of jurors of the Circuit Court of Lane County, Oregon are appoin-
ted as viewers to view such proposed street and made an assessment of the damages
and benefits as provided in Section 4 of Chapter 92 of the Charter of the City
of Eugene.
Section 4. That said viewers are directed to meet on the 4th day of
January, 1944 at 10 o'clock in the Council Chambers of the City Hall in the City
of Eugene, and the City Recorder is directed to cause a notice to property owners
by publication for• at least ten days successively pr~;or to the said day assigned
for said viewers to meet, in a newspaper published in the City of Eugene, giving
the names of and the time and place appointed for them to meet and specifying
with convenient certainty the boundaries, termini or other description of the
said proposed street, and the boundaries or other description of the parcels of
private property to be appropriated for said purpose.
Section 5. That the City Recorder is directed to send by mail post-pai
a copy of each notice to each of tree property pwners whose property is proposed
to be appropriated or to the agent of such owner where the postaddress address
of such owner or agen-t is known to him, and if such postoff ice address be unkno
to him, then such notice shall beddirected to such owner or agent at Eugene,
Oregon, as provided in Section 3 of Chapter 9 of the Charter of the City of
Eugene.
Section 6. That it is necessary for the convenience of tie citizens
of the City of Eugene that said street be opened and extended and an emergency
therefor declared to exist, and it is therefore declared to be for the immed.ia

preservation of the peace, health and safety of the City of Eugene that this
~I ordinance become effective immediately upon its passage by the common Council
