An Ordinance to regulate the planting and care of all trees, shrubs,
flowers, plants and vegetation on City property, and within the boundaries of
streets and alleys, and in any place controlled by the City involving traffic
hazards.
THE CITY OF EIIGENE DOES ORDA.IV AS FOLLO~~'S:
Section 1. Obstruction of visision at intersections. It shall be un-
lawful for any person, firm or corporation owning, in possession of, occupying
or having control of any premises within the city of Eugene, to plant, maintain
or allow any tree, shrub, bush, or plant of a height in excess of~three feet
above the crown of the adjacent roadway or to place or allow any wood to be
piled or other substances placed in that protion of the roadway between the
property line and the curb line within 25 feet from the intersection of curb
lines at any street, avenue or highway intersection. Where curbs have not been
established, no such use of the said street area shall be made within 15 feet
of the intersection of property. lines extended at any street, avenue, or high-
way intersection. The terms, "bush",tSshrub;' or "plant", as sued in this sec-
tion shall include clambers or other vegetation growing upon or supported by
poles, wires, or trellises, but the provisions of this section shall not be
applicable to poles, hydrants, or other facilities placed, maintained, and
established by any governmental agency or public or private utility.
Section 2. Location of shade trees in streets. All trees planted or
set out in the streets shall be placed on a line in the center of the space
between the curb and sidewalk lines.
Section 3. It shall be, unlawful to plant any fir, cedar, balm, poplar
nut, locust, fruit or cottonwood trees in arty parking strip in any street in
the City of Eugene.
Section 4. Trimming oP Trees; It shall be unlawful for any person
to permit the branches of any tree upon or in front of any premieses of which
he is the owner or occupant, to be less that nine feet above the sidewalk or
less than twelve feet above the roadway; provided that the clearance over the
sidewalk be level with that over the street and that the trees be trimmed symm-
etrically all around.
Section 5. City May Remove; All trees, shrubs, plants and iegetation
in any parking strip may be trimmed, pruned or removed at any time by the City.
or the City may require any property owner to trim, prune or remove all trees,
shrubs, plants or vegetation in a parking strip abuttin~ upon said owner's
property and Failure to comply therewith, after ten day s notice by the City
Recorder, shall be deemed a violation of this ordinance.

Section 6; Removal of Trees; Whenever in the opinion of the City
Engineer, the roots of any tree in the streets have entered any sewer, lateral
sewer, or house connection in said streets and are stopping, restricting or
retarding the flow of sewage therein the City Engineer shall notify the owner
to remove said tree. If the owner fails to remove said treet within thirty
days, the City, Engineer may remove said tree and assess the costs against the
property..
Section 7: Park Committee; The provisions of this ordinance shall be
under the supervision of the Park Committee of the City Council, and no tree
shall b~e removed from streets, alleys or City property, except upon permission
from the Park Committee.
Section 8. Repeal; All ordinance-and parts of ordinances in conflict he
herewith are hereby repealed.
Section 9. Penalty; Any firm, person or corporation violating any of
the provisions of this ordinance, or refusing to comply with any direction upon
the notice aforesaid, shall upon conviction by the City Recorder, be fined, not.
to exceed X50.00 and costs of prosecution and may be imprisoned in the City Jail
one day for each X2.00 of the fine unpaid.
