HomeMy WebLinkAboutORDINANCE NO. 88032~9 ORDINANCE N0. 8803 An ordinance providing; for the regulation of hotels, rooming houses and lodging houses t~yithin the City of Eugene, requiring licenses, and providing penalities and declaring an emergency. THE CITY OF EUGENE DOES ORDAIN AS FOLLOWS; SECTION 1, Commencing January, first, 1943, it shall be unlavaful for •any person to conduct, keep, manage, operate; or cause to be conducted, kept, managed or operated; either as owner, lessor, lessee, agent or Attorney, any hotel, roomin house, or lidging house, within the ineprporate limits of the City of Eugene without having first obtained a license from the Council en- titling hom to do so as~provided in this ordinance. License fees shall be as follows; 4 to 10 rooms - - - - - - 2.50 11 to 20 rooms - - - - _ - - 5.00 21 rooms or more, - - - - - 10.00 and no license shall be issued for a less amount. SECTION 2. There is attached hereto rules and regulations marked Exhibit "A", which is expressly made a part hereof as though set out herein. SECTION 3. For the purposes of this ordinance, the work "person" shall mean and include matural persons, co-partnerships, corporation and associat- ions, and shall include persons of both sexes. The wor "house" shall mean and include hotels, roomir~ houses and lidging houses. SECTION 4. For the purpose of this ordinance, a hotel, rooming house or lodging house shall be and is deemed to be any house or building containing four or more rooms which are kept and maintained for sleeping or lodging purposes and which are offered to the public for rental or hire, either for steady roomers or transients. SECTION 5. No license whatever shall be granted to any applicant or to any hotel, rooming house or lodging house, except that the applicant shall be a person of good moral character, and shall be qualifoed in all respects to operate a hotel, rooming house or lodging house, and in case of having operated such a house, shall have a good record as a law abiding citizen and having operated an orderly place.; and no license shall be granted for the operation of any hotel rooming house or lodging house, which hotel, rooming house or lodging house does not conform and comply with the rules and regulations of this ordinance and the Ordinances of the City of Eugene generally and part- icularly with respect to fire hazard, theBuilding Code and sanitary regulations of the Health Department. SECTION 6. Whenever an application shall be made for a license for the operation of a hotel, rooming house, or lodging house, the Council shall re- quire reports from the Chief of the Fire Department, the Chief of Police and from the Health officer ~s to the hotel, rooming house or lodging house, complying with the rules and regulation and Ordinances, and the Chief of Police shall make a particular examination and report both as to the character of the hotel rooming house or lodging house, and of the applicant with respect to his or her police record, and if the Council shall be satisfied that the appli- cant and the hotel, rooming house or lodging house comply substantially with the foregpoing requirements, a license shall be issued, and in case they shall find that either the applicant or the hotel, rooming house or lodging house does not substantially comply with the foregong requirements, the license shall de denied; provided, howeverm that in case the applicant shall be ag~reivec at the deniel of his application, that the Council shall permit the applicant to be heard in person before the deniel shall become absolute. SECTION 7. Each license shall run during the current callendar year and shall terminate of the 31st day of Ddeember following the issuance of the license; and it is reserved to the Council the right at any time for any reason set out in ;:section 5 to revoke any license granted in the same manner as it was previously granted, and for the same reasons. SECTION ~. No license issued under the terms of this ordinance shall be transferred or assisgned without the consent of the Common Council. SECTION 9. No person to whom a license shall be issued as provided in this ordinance shall suffer or permit the hotel, rooming house or lodging house to which such license relates, to be used as a house of ill fame, brothel, bawdy house or disorderly house, for the purpose of prostitution, fornication, or lewdness, or su~'~;er any lacivious cohabitation, adultery, fornication or other immoral practice to be carried on therein, or suffer or permit any dis- orderly conduct in said hotel, roomin house or lodging house, as disorderly conduct is now and may hereafter be def fined by the OdinBnaes of the City oP Eugene. 3t)0 SECTIoN 10. SECTION 11. Every person to whom a license shall have been issed to conduct a hotel, rooming house, or lodging house shall atall time keep a standard hotel register in which shall be inscribed•the anmes of all guests or persons renting or occupying rooms in such house, which register shall be signed by the persons renting the room or rooms. Such registration must be made, and after the name or names are inscribed or registered the manager_of the house, or his agent shall write the number of the room or rooms which siad guest or person is to occupy, together with the time when such room is rented. All of which shall be done before such person is permitted to occupy such room or rooms. Such register shall be at all time•open to inspection by any guest of the house wherein such register is kept, and to any executive or peace officer of the City of Eugene, or of the State of Oregon. SECTION 12. It shall be unlawful for any person to write or cause to be written in any hotel register any other or s~ifferent name than the true name of such person, or the name~by which such person is generally known. Section 13, .No room or rooms shall be assigned to two persons of the opposite sex, except in cases of children accompanied by parents or guardian unless such persons shall be registered as husbband anci wife. SECTION 14. It shall be unlawful fox any person to whom a license has been issued as provided in this Ordinance to rent or permit to be occupied any room in the hotel, rooming house or lodging house to which such permit relates, to persons of the opposite sex, one of whom is a msner, unless such persons have bona fide baggage er ahe vouched for as husband and wife by a reputable person of the City of Eugene, or by permission of a member of the Police force or Police Committee of the Council. SECTION 1;5. Any person to whom a license shall have been issued as provided in this ordinance, shall cuase each sleeping room or apartment in such house to which such license relates, to be numbered in a plain and con- spicuous manner, the number t.:~ be placed on the outside of the door to such room, and no two such doors shall bear the same number. SECTION 16 Where a license shall have been issued to any copartner- ship, corporation, or association to conduct a hotel or rooming house or lodging house; any person having charge, management or control of such hotel, rooming house, or lodging house, as well as the owner or proprietor, shall be liable to prosecution for- any violation of the provisions of this ordinance, or the rules and regulations accompanying this Ordinance. SECTION 17. For the purpose of~determining the liability of any per- son or persons to prosecutions for violating any of the provisions of this ordinance, rules and regulations, it shall be sufficient to show that such perons was at the time of the act of violation compalined, of, the person in actual charge, management or control of the house in which such act is alleged to have been committed. SECTION l8. The City Recorder of the City of Eugene shall keep and indexed record of licenses issued pursuant to the provisions of this Ord= finance, together with a record of convictions for violations of the provisions of this ordinance. SECTION 19. Any person violation any of the provisions of this ord- inance upon conviction thereof, shall be punished by a fine of not more than Two Hundred 0200.00) dollars and costs, and in defai~~:t of the' payment of such-fine, to be imprisoned in the City Jail one day for each X2.00 of such fine. SEC'PION 20. 'The City Recorder shall report to the Common Council the prosec~.tion or conviction of any person to whom a license has been issued, and the Common Council may thereupon revoke and terminate the license so issued to.such person. Section 21. Tn addition to the remedies providdd for herein, it shall be the duty of the Chief of Police whenever a hotel, rooming house or lodging house shall be operating without a license and had no application pending, to give the person in charge a written notice to close said place and .evict all tenants therefrom within five days from such notice, and at the expiration of such within five days frost such petiod the Chief of Police shall summarily close the offending hotel, rooming house or lodging house and not perrriit the same to be opperated further. 3O1 ._ ~.:SECTION~22. Nothing in the ordinance contained shall~..be construed to apply to any eleemosynary, religious, benevolent or charitable association or to any student fraternity or soroity house or dormitories conducted at or neat the University Of Oregon. SECTION 23. It shall be the duty of each person to whom a license is issued t~ comply with the rules and regulations of this Ordinance and the directions of the Chief of Police, Chief of the Fire Department, the Building Inspector and the City Health Officer. Such rules and regulations shall be issued to all licenses by the City Recorder. Failure to comply with said rules and regulations shall be punishable in the same manner as fialure to comply with other portions of this ordinance. SECTION 24. All Ordinance. and parts of ordinance in conflict herewith are hereby repealed. SECTION 25. Whereas, hotels, rooming houses and lodging houses are operated in the City of Eugene that are not complying with the fire, hazard, building and sanitary regulations of the City of Eugene, and that they con- stitue a menace and a danger to lives and property, an emergency is declared to exist and it is ereby~declared that it is necessary for the immediate preservation of the peace, health and safety of the City of Eugene that this ordinance take effect immediately upon its passage by the Common Council and its approval by the Mayor, and it is so ordered.
