An Ordinance submitting the question of the electors of the City of Euge ~ and to the electors of the territory hereinafter described, the question "For Annexation or "Against Annexation" of sueh_ area and ordering a special election to be held in such areas and in the City of Eugene on the 20th day of December 1944 designating polling places, appointing fudges and clerks of election and all necessary dots for the carrying on of said election,. and declaring an i emergency. ~ THE CITY OF EUGENE DOES ORDAIN AS FOLLOWS: Section ~.: That the Common Council of the City of Eugene hereby submits to the electors of the City of Eugene and to the electors of the following described area, to-wit: Beginning at the southwest corner of the City limits of Eugene, Lane i County, Oregon, being the intersection of the center lime of Chambers -street and the south line of Fifteenth Avenue West, running thence east 30 feet to the East lime of Chambers street, thence south 490 feet, thence east 62 feet, thence south 3040 feet to the southwest corner of the Municipal Airport, thence east 1705 feet to the south- ; east corner of said airport, thence south 220feet tQ the south line of the North half of Section One, Township 18 south Range 4 West, Willamette Meridian, thence west along said south line to the west line of Chambers Street, thence north along the west line of Chambers Street, to.the south line of~Lot Thi"rty, Prospect Park, thence U1est along the south line of Lot 30 and-Lot 29, and the South line of said lots if prodmced west, to the west line of section One, Town- i ship 18 South of Range 4 west of the Willamette Meridian; thence north along the west line of said Section l:~and of Section 36, Township 17 South range 4 West, Willamette Meridian, to the northwest corner of said Section 36, thence East along the North line of Section 36 } to the southerly line of the Oregon Electric Railway Co. right of way, thence Easterly along the said right of way and the south line of 5th avenue west to the present West line of the City limits, and thence South along the City limit line to the place of beginning. for question "for Aruiexation" or "Against Annexation" of such territory to the City of Eugene. Section 2. That the Common Council of the City of Eugene also submits to the electors of the city of Eugene the questions "For Annexation" or "Against Annexation" of the following described area, which is what is known as the old City Airport and which will be voted upon in the City but not voted on irk the Airport area, as the City itself is the owner of the Airport area, t wit: Beginning 30 feet East of Southwest corner of the present City limits of Eugene, Lane County, Oregon; being the center lime of Chambers St. and the south line of 15th avenue West, running thence East 903 feet to the East line of the Municipal Airport of Eugene, thence south 520 feet to the south line of Donation Land Claim No. 37, thence west 83.3 feet, thence south 530 feet to the center line of 18th avenue West if extended, thence 571 feet to the 1P~est line of Polk street, thence south 20 feet thence East along the south line of 18th avene west 378 feet to the East line of the Municipal Airport, thence south 2457 feet to the South east corner of said airport, thence avast 1705 feet to the Southwest corner of said airport, thence north 3040 feet to a point 30 Peet north of the south line of Donation Land claim No. 37, thence west 62 feet, and thence north to the place of beginning. i~ 3r)3 Section 3. The Common Council of the City of Eugene hereby orders a special election to be held in the City of Eugene, Oregon and to held in the area described, on the 20th day of December, 1944, at which election there shall be submitted to the electors of said city and to the proposed annexation area for their approval or rejection the proposal "For Annexation" or "Against Annexation" of said area to the City of Eugene. Section 4. That said proposal shall be placed upon tie official ballot by the City recorder to be voted upon by the electors of the proposed area and by the electors of said City at said election. Section 5. The City Recorder shall provide such poll book~,ballot boxes, tally;~sheets and such other supplies for each proposed area, as are necessary for the carrying on of the election, all of which shall be delivered to the election board. Section 6. The following are hereby designated as the polling places for said election in the City of Eugene, one to be in each ward of said City and the following are hereby designated as the polling places in the proposed annexation area, and the Common Council does hereby appoint the judges and clerks to serve iri each of said polling places as herein designated, to-wit: In the following list of Judges and Clerks, the first-named shall be a judge and Chairman of the election board; the seco~#d named shall be a Judge, and the next three shall be designated as first, second and third clerks: toge- they with any replacements or alternates found necessary, to-wit: Eugene Ward I CHAIRMAN JUDGE CLERKS Roosevelt School 1787 Agate Street EUGENE WARD 2 _ Washington School 275 East 7th EUGENE WARD 3 Vocational. The polls shall be opened in each of said polling places at f eight o'clock in the morning and shall be kept open until eight o'clock in the i 1 evening on said election day. Section 8. The first named Judge on said election board as provided for in this ordinance shall be Chairman of the Board of which he is a member, and the ballots cash at said election shall be counted, tabulated and returned to i the City Recorder as provided by law. t Section 9. The City Recorder is hereby authorized and directed to give nbtice of said election by publication in a newspaper of general circulation i in such cooperation and in such territory so proposed to be annexed, for the ~ period of four weeks prior to such election, a~:so by posting notices thereon in four public places within such corporation and four public places in the r territory proposed to be annexed for a like period. Such notice shall dist- ' inctly state the proposition to be so submitted and shall designate espec- ially the boundaries of the territory so proposed to be annexed and the elector. shall be invited thereby to vote upon such proposition by placing upon their ballots the words "For Annexation" or "Against Annexation". } Section 10. The Judges and Clerks, before entering upon the discharge of their duties at such election shall each take and subscribed before an ~ officer authorized to administer the same, an oath, that he will honestly and faithfully discharge his duties as such Judge or Clerk. In case of the absence or inability of any Judge or Clerk so appointed to act at such election, then the qualified electors present at the polls, bef6reeproceeding to vote, m~,y choose an elector to act in his place from among the number, who shall duly 4 qualify as aforesaid before entering upon the discharge of his duties as Judge or Clerk of such election. WHEREAS, it is desired to submit to the electors of the City of Eugene and the electors of the proposed annexed area a proposal for annexation, and WHEREAS, the sanitary conditions, water supply and electric supply are inadequate and constitue a menace to the health and safety of the people of the propsed annexaed area, an emergency is therefore declared to exist and it is necessary for the immediate preservation of the peace, health, and safety of the City of Eugene, that this ordinance take effect immediately upon. its passage and approval by the Mayor, and IT IS SO ORDERED.
