HomeMy WebLinkAboutORDINANCE NO. 8827323 ORDTNAIVTCE ATO. 8827 An Ordinance vacating the f ollowing described area, to-wit: Maple Avenue from the south line of 15th avenue to the south line of Plat of Victoria Heights ?MiEREAS, Heretofore mnd on the 9th day of April, 1945, the Common Council of the City of Eugene passed an' ordinance setting a hearing for Today 14, 1945, in the Council Chambers at which time and place protests and remonstrances could be heard as to the vacation of the following premises, to-wit: _ Maple Avenue from -the South line of 15th avenue to the south line of Plat of Victoria Heights. WHEREAS, a hear in~.was held pursuant to sa.id~ordinance in the Council Chambers in the city hall in the city of Eugene on Monday, May 14, 1945, at 7:30 o'clock P.M. ~ar~d at siad time the Council heard all objections, and 1VHEREAS, all persons owning property abutting upon said area have consented to said vacation. Now Therefore, TtTE CITY OF EUGENE DOES ORDAIP? AS FCLLO~VS: Section 1. The Common Council of the City of Eugene finds due and legal notice of the said hearing was published and posted as required by law; that no valid objection to said vacation has been made at said hearing, or filed; that the consent of the owners of the abutting property, properly acknowledged, has been filed in said proceeding; and that, the public interest will not be prejudiced by the vacation of said area. Section 2. That said hearing was held on May 14, 1945, at 7:30 o'clock P.M. in the Council Chambers of the City Hall in Eugene, Lane County, Oregon, and no objections or remonstrances were made or filed. Section 3. That the following described areas, to-wit; Maple Avenue from the south line of 15th avenue to the south line of Plat of Victoria Heights be and the same is hereby vacated, and the area so vacated, being streets or alleys, shall revert to the abutting property pursuant to the statutes of the State of Oregon, expressly reserving however to the City of Eugene the right to enter upon said area and maintain, repair and operate its public utilities. Section 4. The Recorder be and he is hereby directed to file a certified copy of this ordinance with the County Clerk of Lane County, together with a map or plat of said property, and that a certified copy of the ordinance shall be filed with the County Assessor, and an certified copy of the ordinance shall be filed with the County Surveyor.
