HomeMy WebLinkAboutORDINANCE NO. 8835I 3~0 ~ ORDINANCE N0. 8835 i i i j An ordinance vacating the following described area, to-wit; ~ Alley between Augusta and Riverview street ,between 16th avenue and the Pacific Highway,. WHEREAS, heretofore and on the 11Fth day of May, 191.5, the Common Council of the City of Eugene passed an ordinance setting a hearing for the 9th day of July, 19l~5 in the Council Chambers, at which time and place protests and remonstrances could be heard as to the vacation of the following premises, to-wit: I .Alley between Augusta and Riverview streets between 16th avenue and the Pacific Highway. f WHEREAS, a hearing was held pursuant to said ordinanc© in the Council Chambers j ~ in the City Hall in the City of Eugene on Monday the 9th day of July, 1915 at 7:30 k o'clock P.M. and at said time the Council heard all pbjections, and WHEREAS, all persons owning property abutting upon said alley proposed to be vacated have consented to said vacation and have applied for said vacation, and the City Planning Commission has consented to the vacation, f Now, Therefore, , THE C ITY OF EU GLIv'E DOES ORDAIN AS FOLLOWS s Section 1. The Common Council of the City of Eugene finds that due and legal notice of the said hearing was published and posted as required by law; that no valid ~ objection of said vacation has been made at said hearing, or filed; that the consent j of the owners of the abutting property, properly acknowledged, has been filed in said proceeding; and that the publis interest will not be prejudiced by the vacation of said area. Section 2. That said hearing was held on July 9, 19Ia.5 at 7:30 of clock P.M. in the Council Chambers of the City Halp in Eugene, Lane County, Oregon and no objections or remonstrances were made or filed. Section 3. That the following described area, to-wit; ~~ Alley between Augusta and Riverview streets between 16th avenue and the Pacific Highway be and the same is hereby vacated, and the area so vacated, being alleys shall revert to the abutting property pursuant to the statues of the State of Oregon, reserving to the City the right to enter, construct and maintain all sewers, water pipes and public utilities. - Section 1.~.
