WHEREAS, heretofore and on th© 13th day of August, 1945, the Common Cauncil of the City of Eugene passed an Ordinance setting a hearing for the 8th day of October, 1945, in the Council Chambers, at which time and place protests and remonstrances could be heard as to the vacation of the following premises, to-wit: Vacation of alley immediately south of Block 5 Cheshire's 1st Addition to Eugene described as follows: Beginning at the Southeast corner of Lot 8, Block 5, Cheshire's 1st ;addition to Eugene, running thence South 17 feet, thence West 160 feet, thence Rtorth 17 feet, thence East 160 feet to the place cf beginning in lligene, Lane County, Oregon. and, WHEREAS, a hearing was held pursuant to said Ordinance in the Council Chambers in the City Hall in the City of Eugeno, on 1Utonday, the 8th day of October, 191.+5, at 7;30 o'clock P.M. and at said time the Council heard all objections, and WHEREAS, all persons owning property abutting upon said alley proposed to be vacated have consented to said. vacation and have applied for said vacation. THE CITY OF EIIGENE DOES ORDAIN AS FOLLOPYS: Section 1. The Common Council of the City of Eugene finds that due and legal notice of said heari;~g was publichcd end posted as required by law; that no valid ob- jeetior. has been made at said hearing, or filed; that the consent of the owners of the abutting property, and consent of City Planning Commission, properly acknowledged, has been filed in said rroce®diag; and that the public interest will not be prejudiced by the vacation of said portion of alley. Section 2. That said hearing was held on the 8th day of October, 1945, at 7:30 o'clock P.M. in the Council Chambers of the City Hall in Eugene, Lane County, Oregon, and that all matters necessary to be dune have been completed. Section 3. That the following described area, to-wit: Vacation of alley immediately south of Block 5 Cheshire's 1st Addition to Eugene described as follows: Be ginning at the Southeast corner of Lot 8, Block 5 Cheshire's 1st Addition to_Eugene, running thence South 17 feet, thence West 160 feet, therce.North 17 feet, thence East 160 feet to the place of beginning in Eugene, Lane C ount y, O re g can. be and the same is hereby vacated and the area so vacated, being an alley shall revert 366 to the abutting property pursuan~ to the statutes of the State of ~regan, reserving, however, to the 'City of Eugene the perpetual right to maintain any public utilities or structures now in the street and to lay down at any time that the Council deems neceasary or convenient, any public utility in the alley, and reserving the right to enter upon the alley and maintain the same. Section L}. The Recorder be and he is hereby directed to file a certified copy of this Ordinance with the Recorder of Lane County, Oregon, togethor with a map or plat of said property, and that a certified copy of the Ordinance shall be filed with the County Assessor and another certified copy of the Ordinance shall be filed with the County Surveyor.
