HomeMy WebLinkAboutORDINANCE NO. 8860 3s9 -- - =- ORDINANCE PTO 8860 f An Ordinance to regulate the keepir>g and maintenance of animals, fowls and insects in the Gity of Eugene; providing for a license, and repealing all Ordinances in conflict herewith. THE CITY OF EUGENE DOES ORDAIN AS FOLLuwVS: Section 1. It shall be unlawful for any person, firm, company, assoc- cation or corporation to keep or maintain any horse, cow, sheep, goat, livestock or any other like domestic animal; any fowls or birds, including doves; any bees or other insects, without having obtained a license as herein provided. Section 2. Any person desiring to keep any animal, fowl, bird or insect hereinbefore mentioned, within the City, shall make a written application to the City Health Department of the city for a license therefor, showing the number and kind of animals, fowls, bird or insects to be kept or maintained, and such a des' cription or address as shall identify the place where such animal, fowl, bird or insect is to be kept, and any other information required by the City Health Depart- ment or necessary to enable him to determine the place and manner in which such creatures are kept, with respect to the comfort and convenience of others. Section 3. 3efore acting on any such license, the City fiealth Officer shall investigate the character of the applicant and all of the facts surrounding the maintenance of such creature a~~ such place, with a view to its being kept in such a manner as riot to endan ger or affect the health, comfort and convenience of other citizens of the city, and after a full consideration of all the facts and circumstances, if it shall appear that the manner of keeping and maintaining such creature shall not be detrimental to the welfare of the city or its citizens, the City Health Officer shall endorse upon such application his approval thereof; but if it shall appear from his inspection that a license should not be granted, he shall endorse upon the application his rejection thereof. Section 1.~. In case any application for liconse shall be rejected by the City Health Lepartment, the applicant may appeal to the `Common Council by appearing before them at their next regular meeting and presenting his rejected application fur review and the Council shall thereupon hear the applicant and either grant the license or adopt the recommendation of the City Health Department, and the action of the Council upon such application shall be final. Section 5. Upon receipt by the City Recorder of any application as here- inbefore provided, with the approval of the City Health Officer endorsed theron, or with the endorsement of the Common Council, the Recorder shall immediately issue a license in accordance therewith and shall make a record of such license. Such license shall terminate on the first of January following its issuance; shall name the person to whom it is granted; the date of its expiration; the number and kind of animals, fowls, birds or insects to be kept, and the place where they are 3 "~ 0 to be kept, together with any other information which the recorder may desire to be endorsed thereon. ~, Section 6. That rz1l pens, hutches, corrals, chicken coops and other enclosures in vrhich any of the foregoing creatures are kept must be maintained a j distance of at le ast 150 feet from any inhabited dwelling, and must be kept clean and wholesome and free from offensive odors. j Section 7. Such license shall be revocable, if at any time, for good cause and upon complaint, the Oity Health Officer shall make application to have I ~ it revoked. Such license shall be revoked only after hearing before the Common Council. Section 8. County Fair Grounds when used for Fair purposes are hereby excepted from the provisions of this ordinance. f j Section 9. .Any person, firm, company or corporation violating any of 1 the provisions of this ordinance shall be subject, upon conviction thereof, in the P.4unicipal Court, to a finZ of not mere than X200.00 and costs of the proceedin g, f and in default of pa,rment of such fine, shall be confined in the City Jail for one day for each dollar of the Section 10.
