ORDII@IANCE N0. 8871} _ ~~ AN ORDINANCE PROVIDING FOR THE ESTABLISHMENT OF A BUREAU OF FIRE PREVENTION, PROVIDING OFFICERS THERE FORE AND DEFINING THEIR POWERS AAtD DUTIES, AND PRESCRIBING REGULATIONS FOR FIRE PREVENTION AND LIFE SAFETY IN CONNECTION WITH HAZARDOUS MATERIALS AND~PROCESSES. THE CITY CF EUGENE DOES ORDAIN AS FOLLOWS: Part 1. BUREAII OF FIRE PREVENTION AND GENERAL PROVISIONS. 101. A Bureau of Fire Prevention in the Fire Department of the City of Eugene is hereby established which shall be operated under the supervision of the Chief of the Fire Department. The City Manager shall designate an officer (or member) of the Fire Depart- ment as Chief of the Bureau of Fire Prevention, who shall hold this office at the pleasure of the City Manager. The Chief of the Fire Department may detail such other members of the fire department s.s inspectors as shall from time to tima be necessary. The Chief of the Fire Lepartment shall recommend to the City Manager the employment of technical inspectors,- who, when such authorization is made, shall be selected through an examination to determine their fitness for the position. The examination shall be open to members and non-members of the fire department, and appointments made after examination shall be for an indefinite term with removal for cause. 102. It shall be the duty of the officers of the Bureau of Fire Prevention to enforce all laws and ordinances covering the following: 1. The prevention of fires; 2. The storage and use of explosives and flammables; 3. Ths installation and maintenance of automatic and other private fire alarm systems, and fire extinguishing equipment; 1a.. The maintenance and regulation of fire escapes; 5. The means and adequacy of ex~-t in case of fire, from factories, schools, hotels, lodging houses, asylums, hospitals, churches, halls, theatres, amphitheatres, and all other places in which numbers of persons work, live or congregate, from time to time, for any purpose; 6. The investigation of the causo, origin, and circumstances of fires. They shall 'nave such other powers and perform such other duties as are set forth in other sections of this ordinance, and as may be conferred and imposed from time to time by law. 103. The Chief of the Fire .Lepartment, Chief of the Bureau of Fire Prevention or any Inspector may, at all reasonable hours, enter any building or premises within his 3urisdiction for the purpose of making-any inspection, or investi,~:atioa which, under the provisions of this ordinance, be or they may deem necessary to be made. 101+.. The Chief of the Fire Department, Chief of the Bureau of Fire Prevention or any Inspector specially designated thereto shall inspect, as often as may be necessary, but not less than four times a year, all specially hazardous manufacturing processes, storages or installations of gases, chemicals, oils, explosives and flammable materials, all interior fire alarm and automatic sprinkler systems, and such other hazards or appliances as the Chief of the Fire Department shall designate, and shall make such orders as may be necessary for the enforcement of the laws and ordinances governing the same and for safeguarding of life and property from fire. 105. ~, It shall be the duty of the ChieF of the Fire vepartment to inspect, or cause to be inspected by the Bureau of Fire Prevention, or by the Fire Department officers and members, as often as may be necessary, but not less than twice a year in outlaying district and four times a year in the closely Quilt portions of the city all buildings and premises except the interiors of private dwellings, for the pur- pose of ascertaining and causing to be corrected any conditions liable to cause fire , or any violations of the provisions or intent of any ordi.Tiance of the city affecting the fire hazard. Whenever any Inspector, as defined above, shall find any 'ouilding or upon any premises, combustible or explosive matter or dangerous accumulations of rubbish or unnecessary accumulation of waste paper, boxes, shavings, or any highly flammable materials, ar.d which is so situated as to endangor life or peoperty; or shall find obstructions to or on fire escapes, stairs, passageways, doors or windows, liable to interfere with the operations of the fire Department or egress of occupants in case of fire,~he shall order the same to be removed or remedied. 4(36 106. It shall be the duty of the Chief of the Fire Department to inspect, or cause to be inspected by the Bureau of Fire Prevention, or by the Fire department officers or m members, each place of assembly at least monthly and at such times, including time of occupancy and use, as to insure compliance with all laws, regulations and orders deal- ing with overcrowding, use of decorations, maintenance of fire appliances in such places of assembly. Where conditions are found to be unsatisfactory, written orders for immediate correction shall be given. 107. The Chief of the Fire vepartment, Chief of the Bureau of Fire Prevention or an Inspector upon the complaint of any person or whenever he or they deem it neces- sary, shall inspect all buildings and premises within their jurisdiction. Whenever any of said officers shall find ~ y building or other structure which, for~wani; of repairs, lack of sufficient fire escapes, automatic or other fire alarm apparatus or fii•a extinguishing equippmment or by reason of age or dilapidated condition, or from any other cause, is expecially liable to fire, and which is so situated as to endanger other property or the occupants thereof, and whenever such officer shall find i.n any building combustible or explosive matter or flammable conditions dangerous to the safety of such building or the occupants thereof he or they shall order such dangerous cond- itions or materials to be removed or remedied. 108. The service of such orders as mentioned in Sections 10l~, 105, 106 and 107 ma'y~e made upon the occupant of the premises to whom it is directed, either by delivering a copy of same to such occupant personally or by delivering the same to and leaving it with any person in charge of the premises, or 3n case no such person is. found upon the premis®s, by affixing a copy thereof in a conspicuous place on the door to the entrance of the said premises. Whenever it may be necessary to serve such an order upon the owner of the premises such order may be served either by delivering to and leaving wit~3,the said persona copy of the said order, or, if such owner is absent from the jurisdiction of. the officer making the order, by maili:.~ :,ucl: ocp~r to the owner t s last known post office address. Any such order shall forthwith be complied with by the owner or occupant of such premises or building. If such order is made by the Chief of the Bureau of Fire Prevention or one of~the Inspectors, such owner or occupant may within twenty-four hours appeal to the Chief of the Fire Department, who shall, within five-days, review such order and file his decision thereon, and unless by his authority the order is revoked or modified it shall remain in full force and be complied with within the time fixed in said order or decision of the Chief of the Fire Department. Provided, however, that any such owner or occupant may, within five days after the making or affirming of any sucr. order by the Chief of the Fire Lepartment, file his petition with the Municipal Court, praying a review of such order and it shall be the duty of such court to hear the same within not less than five days nor more than ten days from the time the petition is filed, and to make such order in the premises as right and justice may require and such decision shall be final. Such parties so appeal- ing to the Municipal Court shall file with said court within two~days a bond in an amount to be fixed by the court, to be approved by the Court, conditioned to pay all the costs of such appeal in case such appellant fails to sustain his appeal or the same be dismissed for any cause. • 109 The Bureau of Fire Prevention shall investigate the cause, origin and circumstances of every fire occuring: in the city by which property has been destroyed.. or damaged and, so far as possiole shall determine whether the fire is the result of carelessness or design. Such investigations shall be begun immediately upon the occurrence of such a fire by the Inspector in whose district the fire occurs, and if it appears to the officer making such an investigation, that such fire is of suspicious origin, the thief of the Firs Department shall be immediatel~,r notified`of the facts; he shall take charge immediately of the Physical evidence, shall notify the proper authorities designated by law to pursue the investigation of such matters, and shall further co-operate with the authorities in the collection of ovidence and in the prosecution of the case. Every fire shall be reported in writing to the Bureau of Fire Prevention within two days after the occurence of the same, by the officer in whose jurisdiction such a fire has occurred. Such report shall be in such form as shall be prescribed by the Chief of the Fire Department, and shall contain a statement of alI facts relating to the cause, origin and circumstances of such fire, and extent of the damage thereof, and the insurance upon such property; and such other information as may be, required. 110. The City (Prosecutin~~ Attorney, upon request of the Bureau of Fire Prevention, shall assist tl^~e Inspectors in the investigation of any fire which, in their opinion, is of suspicious origin. 111. It shall be the duty of the Chief of the Fire Department to require teachers of public, private and parochial schools and educational institutions to have one fire drill each month and to keep•all doors and exits unlocked during school hours. 112. The Ghief of the Fire Department shall keep, in the office of the Bureau, of Fire Prevention; a record of all fires and. of all the.faets concerning the same, including statistics as to the extent of such fires and the damage caused thereby, and whether such losses were covered by insurance, and if so, in what a?nount. 4(x'7 Such record shall be made daily from the reports made by the Inspectors under - the provision of this ordinance. "Approved° shen"applied to materials, type of construction and appliances refer. s to a~prcval rt> tyie Chief of the Bureau of Fire Prevention as a result of inveGtigationsarid. tests •conducted by him or. ~by reason of accepted principles or testy by 'the tla,tional Board df Fire Und•ervrri~e~~ or the Undervriters' Laborat- oriea; Inc., or the'PTa.tiorial Bureau of Standards. 11 ~ A permit is the written a~~thority of the Bureau of Fire Prevention, issued purstia.nt•tc this ordinance, to have, keep, store, use, manufacture, sell handle and transport e~;plosives ; flar~mab7_e materials and rubbish, a.s hereinafter defined; and to construct; operate or maintain establishments •hereinafter specified. ~ ~ - ' 118: ?a'henever'the'Bureau of •Fi:re Prevention shall reject or refulee to grant a pernit, 'or t~rhen 'it is claimed 'tha.t provisions of this ordinance or any ordinance or. any ordinances relating thereto do not apply,~or ~~rhen it is claimed that the true intent and meaning of this ordinance or any regulations have been miscon- strued or wrongly interpreted, and. the permit applied for having been refused by the Bureau of Fire Prevention, thin any person may appeal from the decision of the Bureau of Fire Prevention, in writing, as outlined in Section 108. 11 In determining the flash point of flammable liquids, the Tag Closed - Tester (standardized by the National Bureau of Standards) shah be authoritatibe in case of dispute. All. tests shah. be made in a.ccordarce vrith the met2-iods of tests as adopted by the American Socibty for Testing raterials. 120. The City Engineer, the Chief of the Fire Department znd the Chief of the Bureau of Fire Prevention shall act as a Committee on dett:rmination, and specify any new materials, procecces or occupancies, and trades vrhich shall require permits in addition to those now enumerated- in this ordinance. The Chief of the Bureau of Fire Prevention shall post such list in a conspicuous place in his office, - and shall. also maintain in his office details and descMiptive drawings showing approved and acceptable methods of storing, handling or protecting such materials as shall be deemed as requiring a permit. 121. The intent of this ordinance is to safeguard and restrict tb.e storage; handling and use of dangerous and hazardous materials to a reasonable degree ~.rith respect to injury to persons and destruction of property. Installation, const- ruction and safeguards shall be provided in a standard modern and approved manner. Compliance raith Sta.ndard.s of the National Board of. Fire Underwriters shall be ' prim. facie evider_ce of such approved manner. The Chief of the Bureau of Fire Prevention shall maintain a public file og the Standards of the National Board of Fire Underwriters, tir~+;ch steal?_ be deemed as advisory requirements to this ordunance insofar as they c?n be applied to e?.ch particular. installation for which a permit is required. 122. ?~efere permits may bP issued, the Chief of the Bureau of Fire Prevention or his assiGtants, steal? inspect and approve the receptacles, veh'_cles, buil.flings or. storage places to be used. - 12 All applications for. permits .required by this ordinance shall b e made to the Bureau of Fire Prevention in such form end detail as it shall prescribe. 12~. Every permit granted by the Bureau of rite Prevention tinder the provisions of this ordinance shall be for such period as the Chief of the Bureau nay determine, r_ot to exceed one year. Such pe-rL~it must at all times be kept on the premises designated therein, and shall at all times be s~~bject to inspection by any officer of the fire or police departments. 12 One permit only shall be required by retail establishments dealing in, or manufacturing plants using, two or more flammable combustible or. explosive materials to be kept in the establishment at any one time. ~~~s 125. EXPLOSIVES. 201. The term "explosive" or "explosives" whenever used in this ordinance shall be held to me~.n ar_d include any chemical compound or mechanical mixture, that is commonly used, or inter_ded for the purpose of producing an explosion, that contains any oxidizing ar_d combos+ible units, or other. ingredient:, in such pro~oertions, quantities cr pac'_~ing that ar_ ignition by fire, by friction, or concussiori'~, by percusRiuu, or oy detonator of any p~.rt of the compound or mixture may cause such a sudden generation of highly heated gases that the resultant gaseous ~crQssures are capable of producing destructive effects on contiguous ot+~ects or of destroying life or limb. 202. Nothing in this part shall be held to mean ar_d include any small arms ammunit- ion or signal rockets, or devices or compositions used to obtain visible or audible pyrotechnic effects, which are covered in Part 3, nor to include explosives in tre forme prescribed in the official United States PhP.rmacopeia. 203s It is prohibited for any person to manufacture any explosives, except that any explosives may be manufactured in the laboratories in o©lleges and similar institutions for the purpose of investigation and instruction. 20~+. It is prohibited for any -person to transport or carry any explosive in or upon any public cenveyanre which is carrying passengers f er rire. 205. .• It is prohibited for any ~oerson to nave, keep, use, store or transport any explosives, except under permit therefor. 206. It is prohibited for any person to have, keep, store, sell, offer for s~.le, give avray, use, transport, or manufacture any of the follo1~ring explosives in ary quantity: Liquid nitroglycerine; high e~-plosives containir_g over 60 per cent of nitro- glycerine ( except gelatine dynamite); high explosives having an unsatisfactory absorbent or one that permits leakage of nitroglycerine under any conditions liable to exist during transportation or storage; nitrocel7.ulose in a dry and u_nccmpressed cor_dition, in quantity greater than ten (10) potu~fl-s in one exterior pac?•,age; fulminate of ~marcury in bulk in a, dry condition, and fulminate of all other metals in any condition, except as a component of manufactured articles not hereinafter forbidden; or explosives containing an ammonium salt and chlorate. 207• Every vehicle while carrying explosives sha.J.1 have painted on its front, sides and back, in easily legible letters at least four inches high, in contrasting colors, the word "EXPLGSIVES," or in lieu thereof shall dipplay, in such manner. that it will be visible from all directions, a red flag with the word "DAA?G'~'R" printed, Stamped or sevra thereon in white letters. .Such flag sY.all be at least twenty-four inches square, and the letters thereof shall be at least Six inches high. ~I~9 (a) It is prohibited for any person in charge of a vehicle containing such exploxive to smo':~? in or upon such vehicle, to drive the vehicle while intoxic-,.ted, to drive the vehicle or to conduct hiinsel`f in a, care less or redkless manner, to load or unload such vehicle in a careless manner or while smoking or intoxicated. (b) It is prohibited for any person to place or carry in the bed or • body, or cause to be placed or carried in the bed or body of any vehicle containing ~' snch explosives, any metal tool or other piece of metal, or any matches. `(c) It is prohibited for. any person to place or carry o* cause to be placed or carried, in any vehicle containing explosives, any erpleders, detonators, bi.?sting caps or other similar explosive material. I {d) Th? permit for transporting ecpl.osives Ghal1. designate the time ~~~hen, ~~ a.nd may designate the route whereon the same may be tr.a.nsported. 2d8 All explosives rmwst be stored in a magazine complying with the requirements of this ordinance, unless such explosives are being trarsported or used4as prescribed and authorized by this ordinance; a.nd an accurate record sho~•.~ing~ the disposition ~' of each container or. pact~age of explosives stored, transported or used shall be kept such record to be subject to inspection by the Bureau of Fire Prevention at all } tires. ` 20p Provided that one portable magazine containing not more than fifty pounds of explosive may be allo+•~ed if placed on ~~rheels and looted not lore than ten feet fret, on the came floor ~,rith and directly opposite to the entra.nre on the floor nearest the !I street level, and one portable :aagazine containing not more than five thousand ., bl-sting caps, may be alloured. if pla.ceu~ on wheels and located on the floor nearest the street level. (b) Blastir_g ca..~cs or u.etorators of any kind shall not be kept in the same magazine ~rrith other exploxives. (c) All magines mast be kept locked except arhen being inspected or when explosives are being placed therm or being removed therefrom. ~ (d) A11 magazines or daces ~trher.e explosives are stored must be kept clean ~ and free from grit, rubbish and empty pack~.gea. lal ( e) A4agazi$~s shall be made of fireproof material or wood covered with sheet iron and- ahall~conspicuously marked, "Magazine - Explosives". 210 BTASTIA?C: No per"son shall blast or carry on any blasting operations +:rithout first having obtained a permit from the Bureau of Fire Prevention. The applicant for such permit must file a, bond deemed adequate in each case by the Bureau of Fire Prevention, which bond shall becore available in the payment of any damage arising; from the neglect of the contf~actor or his agents or employees. • I Part '3. i PY?30TECHDiICS 4~ND SI~SA,LL ARt~1S ANUNITIONS ' X01 Pyrotechnics ~arhenever used. in this ordinance shall be held to mean any sparkler, squib, rocket, firecracker, roman candle, signal lights, railroad tra.rk torpedo, f7.ash7 ight composition, fire~,rorks or other devices or compes ition used. ~ to obtain visible or audible pyrotechnic displa.v, and shall include fire balloons, that is balloons of a type Urhich Y~,ve burning material of any kind attached thereto. X02 No person shall have, keep, store, use manufacture, se1.1, handle or ' transport any pyrotechnics; provided, hotrever, (a) That nothing in this ordinance shall be held to apply to the possession or use of signaling devices for current daily consumption by railroads, vessels and others requiring them. (b) That the Bureau of Fire Prevention may, upon due application, issue ' a permit to a properly ~{ualified person for giving pyrotechnic display of fireworks in the public parks or other open places. Such permits shall impose such restrictions as in the opinion of the Chief of the Bureau of Fire Prevention may be necessary to properly safeguard life and property in each case. (c) That nothing in tr.is ordinance shall be held to apply to the possession, sale or use of nerma.l stacks of flashlight cem_oositions by photographers or dealers in photogra hie s+app7 ies. Siaall ammunitions ~,rhPr_ever used in thi s ordinance sha.1_7. be held to mean any shotgun ,,rifle, pietol or revolver c-,rtridges. 1 ~ No person shall manufacture within the limits cf the city any small arms ammar_ition. This sh~,ll not be construed as prohibiting the hand-loading of ~ small arms ammunition`s for private use and not for resale. 305.. No person shall store for sale, sell or offer far sale any small arms ammunitions without a permit. 4~0 Part ~. JL•dance j ~~,ith the requirements for st~_ndard film vaults and in a manner satisfactory to the , B~,zreau of Fire Prevention. 4~ Every picture machine using nitr,o-cellulose film shall be ir_stalled or operated ~~rithin a booth, to be not, less than ~+S square ,feet in size and 7 feet high: If more than one machine is to be operated an additional 2Z- square feet shall be provided for each additional machine. The booth shall be built of brink, tile, or -- plaster blocks, plastered on both sides, or of concrete, or of a rigid metal frame, properly braced, and sheathed a,nd roofed with locked seamed sheet iron of not less than No. 20 U,S, metal gauge, or with '~ inch hard asbEStos board, securely riveted or bolted~to the frame, or 2 inches of-solid metal lath and Portland cement Plaster. All joints aha.ll be sufficiently tight to prevent the discharge of smoke. (, a) The booth shall be floored with the same material as the sides and roof, riveted to the iron frame and covered with the same noncombustible material. The entrance door into the bootie shall be at least 2 feet by 5 feet, of construction equivalent to the sheathing permitted above for rigid frame booths, and shal?_ be so arranged. as to close autom2aically, and shall be kept closed at all times shop not used for egress or ingress. (b) Two or=f ices or openings for each picture machine may be provided one for the operators view shall be not larger than ~6 se~uare inches, and the other through v-hich the picture is projected shall be not larger than o~ scauare inches. All picture machines using inflamr-i~ble fii_ms shall re equipped vrith incombustible magazines for rrceiving ~,nd delivering the films during the operation of the machine. A shutter must be provided and placed in front of the condensor of the machine, so arranged that same can be instantly closed by the operator. ~ 1~ Films not in the magazine shall. be kept in metal bOY.AS, except in the process of re~.rinding, transferring or r~y~airing. There shall also be two switches controlling the lights in the exhibition room, one of which shall be operated from the booth and the other so placed that i.t, is within reach of the ticket taker or rther person stationed a.t the entrance door. (d) Ventillation shall be provided by one or more mechanical exhaust systems which shall draw air from each arc lamp housing and from one or more points near the ceiling. Systems shall exhaust to outdoors either directly or through a non-combustible . flue used for no other pur.~oose. Exhaust capacity shall be rot less than 12 inches in diameter nor more than 50 cubic feet per minute for each arc lamp plus a minimum of 200 cubic feet per minute for the room itself, Ex'raust ducts shall bP of non-combustible material, and shall either be kept I incr. from combustible material or covered with I~2 inch of non-combustible heat insulating material. The term "Pyroxylin Plastic" as used in this ordinance shall be held to mean a.nd include any plastic substance, material or compound, other thar._ nitrocellulose film as provided for in the film storage regulations, having soluble cotton or aimi'_ar nitro- c811ulose as a base, including celluloid, fiberloia, pyralin, viscoloid, zylenite and simii.ar products, materials, and compounds by ?~rhatever name knot~,m, wren in the form of `olocks, slabs, sheets, tubes for fabricated shapes. ,~02 All retailers, jobbers a,nd ~,rholesalers storing or ha.nd.ling mere than 100 pounds of pyroxylin plastic shall obtain a permit; a permit shall also be required for manu- facture of articles of pyyroxylin ;olastic, which shall include t?-,e use of pyroxylin plastic in the manufacture or asGemblingof other articles. , All display of pyroxylin plastic articles ir. stores shall be in stow cases or show windo?,rs except as permitted. below. (b) An application for a permit accompanied by plans sr,all be made to the Chief of tree Bureau of Fire Prevention for all systems connected to liquefied pe.tro?earn or other compressed gas storage ccntainere exceeding an aggregate o;' 150 (~ gallons water capacity. 4A4 (c) In the case of s~TStems of 150 gal~.ons or lesser capacity the installer shall file a written notification with the Ohief of Fire Prevention indicating the ` date of each installation and. the location of the premises where such installation has been made. g0~ ODORIZING GASES. All compressed or lir~uefied gases shall be effectively odorized by an approved agent of such character as to positively indicate the presence of gas down to concentrations in air of not over one-fifth the lower limit' of flammability. - g0~ CONSTRUCTION OF CGNTAINERS. Structural metal supports shall be properly fireproofed, except that unprotected structural steel supports resting on concrete pads or footings may be used under either of the folio+.aing conditions: (1) The container has a water capacity of not over 600 gallons and_ the distance from its bottom to the ground does not exceed 2~ inches; (2) The container is in an isolated location and- the distance from its bottom to the ground does not exceed 5 feet. (b) Containers buried underground shall be so placed that the. top of container is below the est=blished frost line and in no case less than 2 feet below bhe surface. Where necessary to prevent floating, containers shall be .. securely anchored or weighted. hey shall be coated with a suitable protective material to prevent corrosion. '' (c) Containers once installed underground shall not be reinstalled above ground unless they successfully withstand a hydrostatic retESt of-one and. one-half times the design *.•ronking pressure, and show no evidence of detrimental corrosion. 415 VAL4'ES AATD ACCESSORIES. (a} Valves, regulating, gauging and otA.er necessary equipment shall be protected against tampering and. mechanical damage in an approved manner. (b) All connections Ito containers, except gauge connections and safety relief connections, shall be provided with approved shut-off valves close to the container. (c) Valves in the assembly of systems using tow or more cylinders or drums shall be so arranged that the change of cylinders or drums may be without shutting down the system. (d) When cylinders or •d.rums a.re not in use , outlet valves shall be kept tightly c'dflsed even though cylinders may be considered empty. (e) Approved gauging devices shall be employed on all storage containers other than cylinders and drums. SOS DIKES. -The Chief of the Bureau of Fire Prevention, where the slope of the ground or other local conditions arould permit above ground containers,-in case of rupture or overflow, to endanger adjacent property, shall require each container to be surrounded by a, dike of such capacity as may be considered necessary but not more than the capacity of the container. S0~• PIPING. (a) Piping shall be wrought iorn, steel, brass, or copper pipe; or approved seamless copper, brass or other approved .nonferrous tubing. All piping for conveying gas or liquid-shall be suitable for a safe working pressure of not less than 125 pounds. A11 piping for conveying gas or liquid shall be. tested and proven free ftom leaks at not less than normal operating pressure. (b) In a.ny system in which compressed gas in liquid form without pressure reduction enters the building only hea{ry ~•ralled seamless brass or copper tu?~ing shall be used, Urith an interval diameter not greater than 3/32-inch, and_ a t4~a11 thic'_~ness not less than 3~-inch; provided that this requirement o'/~~` shall not apply to commercial ga.s plants, bulk stations where cylinders, drums or tank trucks are filled, nor to industrial vaporizer buildings. (c) Joints in wrought iron and steel piping shall be of ~,relded construction, or shall. be made Frith fittin~•s capable of withstanding a pressure of at .least 125 pounds per squire inch:'or~1ess; extra heavy fittings shall be used for pressures exceeding 125 pounds per square inch. Cast-iron fittings shall not be used. Joints or brass or copper pipe, or approved seamless copper, brass or' other approved non-ferrous tubing shall be by means of approved fittings. (d) Piping shalt be run as directly as practicable; provision shall be made for expansion, contraction, jarring and vibration and for settling of container.. At points ~•rhere piping passes through outside walls below ground level, suitable provision shall be made to insure substantial gas 'tightness. S10 FIT,TIING CON1>IECTIODTS. - (a) The filling pipe inlet terminal shall not be located inside a building. It shall. be protected in a substantial manner against mechanical injury and tempering by unauthorizied persons. Filling pipe inlet terminals on containers other than those conforming to Interstate Commerce Commission Reguls.tions shall be located. not less than 10 feet from a.ny building a.nd s~rhere yor~cticable nbt less than 'S feet from any drive~;ray and shall be kept locked when not in use. (b) All containers, other than those complying writ h the Interstate. Commerce Commission Regalationa shall have all connections, except relief connections, equipped with approved automatic excess flo*.~r valves, provided, however, that fill connections shall be equipped with approved back-pressure check valves, to prevent discharge of contents in case connections are broken. These excess flo~~r and back-pressure check valves shall be located inside of the container or at a boint outside ~.rhere the line enters the containers;. in the 1__atter case, installation shall be made in such a manner than any undue strain beyond the excess floTrr or back-pressure valve will not cause breakage between the container and such valve. Relief valve discharge shall start at a pressure not more than 125 per cent of the designed ~rrorking pressure,. Safety relief valves shall have a free discharge area not less than as s~oecified in the Standards of the National Board of Fire Underwriters for the Design, Installation and Construction of Containers end Pertinent Equipment for the Storage and. Handling of Liquefied Petroleum Gases. (b) The discharge from safety reliefs shall be outside of buildings and not less.than 5 feet a~~ray from any opening in any building which is below the ~.evel of such discharge. 812 V,4PORIZiATG AND HOUSING \ (a) In donestic installations no liquid or gas shall be led into the building at a pressure exceeding 20 pounds gauge. The initial pressure reducing device shall be installed outside of building, except in the case of. a vaporizer house. (b) The vaporizer shall be located outside of buildings except those buildings devoted exclusively to gas manufactuxang and distribution operations, but may be located in a house or shed of fireproof construction, ~,vell ventilated from points near the floor and roof; provided that on systems utilizing vaporization supplied t~aithout artificial means, vaporizers may be installed in buildings, if such vaporizers are of not more than one quart capacity and are located close to point at arhich .pipe to vaporizer enters building. (c) 'Where a. device is employed for premixing the gas with air, such device shall be provided ~,rith means for automatically shutting off the gas mixing device before a combustible mixture is generated, except ~.~~here combustible mixtures are desired and generated, in ltihich case flame arresters shall be installed. ELEC2'RICAL INSTALLATIONS AND OPEN FLAMES. (a) In the immediate vicinity of storage containers, in vaporizer or pump houses, in cylinder filling plants, in gas plants, and similar 1oc~tions ~r~here liquefied gases are in liquid .form in large quantities, all electrical installations shall be in strict accordance ~.rith 'the requirements of. the National Electrical Code for Class 1 hazardous locations. (b) No artificial light involving flames or sioa.rks, shall be used in the vicinity of container ch~.rging operations Approved explosion-proof flashlights may be employed. 81~ FILLING DENSITIES. 'The total amount of liquefied gas, by weitht, shall be limited to the following percentages of the freight of the water capacity of the container, depending upon the specific gravity at 60 degrees Farenheit of ,the liquid; F'or ).BOO specific gravity, 32 per cent for aboveground and 35 per cent for under- ground; for 0.500 specific gravity, ~?1 per cent for above ground and ~+5 per cent for underground; for 0.6A0 specific gravity, 53 per cent for aboveground and 56 per cent for underground; and for intermediate or higher specific gravities, corres- ponding percentages, but in no case shall the amount of liquid be such as to fill the conta.irer at a temperature of 1j0 degrees Farhenheit for aboveground, and 105 degrees Fahrenheit for underground. All connections shall be free from leaks. 816 TANK TRUCKS AND TRAILERS. Tank trucks and trailers shall be constructed a.s des- cribed in Section 80~. Piping safety devices, ,filling and the loading and unloading of tank trucks and trailers shall be as specified for containers Pumps of suitable design and properly protected may be mounted upon trucks and trailers and may be driven by the truck motor power take-off or other s~i.table means. The pumps. except constant speed centrifugal pumps, shall be equipped ~rrith suitable pressure actuated by-pass valves permitting flow from pump diseharge•to pump suction when the pump discharge pressure rises above a:predetermined point. . Every tank truck and. trailer shall be provided ~sith properly attached steel bumpers, or chassis extension at the rear which shall be so arranged as to adequately protect the tank, piping, valves and f.ittinga in o~.se~of collision. For the purpose of this ordinance, flammable liquids are divided into three classes, according to the flash point, as follows: Class 1. Liquids with a flash point belo~~T 25 degrees Fahrenheit (~4 degrees Centigrade) closed cup tester. Class 11. Lifruids with flash point above that for Class 1 and below 70 degrees Fa.}irenheit (21 degrees Centigrade) closed cup tester. Class 111. Kerosene Amyl Alcohl Turpentine Fuel Oil Any manufactured liquid or fluid commodity, such as 'paint, varnish, dryer, cleaning solution and polishing liquid which contains flammable liquids shall be considered a flammable liquid and shall be classified by Section °02 according to the flash point of the mixture. Except as specified in Section 905, a permit (which shall be for one or more of the folloi,aing subdivisions) shall be obtained; ' (a) For the storage or handling of a total quantity of Class 1 liquids in excess of one gallon in any dwelling, apartment house or tenement, and in excess of six gallons in any other building, and in excess of ten gallons outside of any building. (b) For the storage or handling of a total quantity of Class 11 liquids in excess of five gallons in any d.we?_ling, apartment house or tenement, and in excess of ten ga7.lons in any other building, and in excess of twenty-five gallons outside of any building. (c) For the storage or handling of a total quantity of Class 111 liquids in er..cess of twenty-five gallons ir_side any builc~irg, and in excess of onehundred-fifty gallons outside of any building. No container containing Class 11 liquids, of over five gallons capacity ma.y be used to fill other containers and appliances unless outside the building or in ?. s room in accordance with Section X15, and all drawing, except from safety cans, shall, where the nature of the liquid permits, be as provided for in Section QSI and 982. At service stations the dispensing of alcohol and other flam.~able anti-freeze solutions from drums shall be done outside the building, using pump of gravity discharge. Air pressure discharge shall not be used. 918. EXPOSED 1AINDO~,FTS MUST NAVE 4dIRED GLASS. Any building, other than a frame building, within the limits given in Section 951, containing more than 50Q gallons of flammable liquids-in other than sealed contain- ers.,. shall have all windows in side and rear walls and above the first floor on street fronts, exposed by other buildings within fifty feet, provided with vrired glass in metallic sash and frame. of NE~rI MANNFACTURING PLANTS, Any manufacturing plant established after date of enactment of ordinance i.n a building in which persons are employed above the second story, shall have all rooms, in vrhich Class I and~Il liquids a,re mixed or stored in receptacles permitting the es- cape of vapor, constructed in accordance vrith Section Q15. 920• EXISTING ~•~IANUFACTURING PLANTS. In existing manufacturing plants vrhere persons are employed above the second floor, all elevator, stair and other yells or vertical openings communicating to rooms in vrhich Class I, and II liquids are mixed or stored in receptacles permitting escape of vapor, shall be enclosed and provided with self-closing fire. doors or trap doors with heat releasing devices arranged to close doors automatically in case of fire. 921. MANUFACTURING PLANTS PROHIBITED IN BUILDINGS OCCUPIED AS DS~IELLINGS. No manufacturing plant shall be located in any building used as a duelling for more than one family unless all Class I lieuids are kept in safety cans, not exceeding one quart in capacity, or in outside storage tanks as given in Section 951, vrith no discharge inside the building. 121. FETTLES, VATS, ETC. Kettles, vats, saturators and other vessels used in manufacturing ~orocesses, and containing more than five gallons of flammable liquids, shall not be located within five feet of combustible material nor vrithin five feet of any exit, unless tyro or more exits are provided, and all combustible floor thereunder within a radius of ten feet shall be protected ~•rith noncombustible coverings. All kettles and other open vessels shall be~provided with substantial covers arranged to close automatically in case of fire or which c?,n be easily a.nd readily placed in position, or shall be provided with an adequate automatic extinguishing device. X23. VENTILATION. Rooms in which Class I and II liquids are used in open vats, pans or other vessels, or in which Class I, II and III liquids are heated or otherwise treated in such manner as to produce flammable vapor, shall be well ventilated. S~lhere natural ventilation is not sufficient the Chief of the Bureau of Fire Prevention may require forced ventilation with a vent opening of at least 20 square inches in the wall at the floor level near each open receptacle containing such liquids, or each heating device from T,~hich vapors may escape and opposite to any door or other air inlet. Such openings shall be covered vrith 2 x 2 mesh No. 16 galvanized vrire vreb and shall be kept clear of all obstructions. From each vent opening a flue, of at least 20 square inches area and of non-combustible materials, built into the vaall or floor or securely fastened thereto and so arranged as not to be subject to mechanical injury, shall conduct to ?.nd through a sparkless eshaust fan, to be run continuously, and vrhich shall be of sufficient size to change the air in the room completely every five minutes. All discharge outlets of vent pipes shall be provided +:~ith 12 x 12 mesh or equivalent non-corrodible vrire screen and. shall be so located. that they ~A+ill not expose surrounding property and shall be acceptable to the Chief of the Bureau of Fire Prevention. Any other equivalent system of ventilation may be used when approved by the Chief of the Bureau of Fire Prevention. 124. E%TINGUISHERS REQUIRE. ~rlhere flamma.bl.e liquids are kept, used or handled a quantity of loose r_an- combustible absorbents, such as dry sand or ashes, together with pails or scoops; and iial 421 chemical extinguishers or other extinguishing devices or materials shall be provided in such quantities as may be direete~d by the Chief of the 3ureau of Fire Prevention. Every marketing station, wholesale storage, port terminal, and other property where flammable liquids are -stored in quantities in above ground tanks shall, as a minimum requirement, be provided with portable foam fire extinguishing equipment. 925. STORAGE OF B,AR23ELS AND DRUMS LIMITED. Within the limits given in Section 951, barrels and drums containing Class I, II or III liquids stored outside any building shall not be piled upon each other nor stored in a passageway or beneath any window and no open lights shall be permitted in any such storage yard. 926. DRUMS AND BARRELS &NST BE KEPT CLOSED. Drums or barrels for flammable liquids shall have caps, plugs and bungs replaced immediately after package is emptied. - 927. SMOKING PROHIBITED. In all rooms or parts of buildings which contain flammable liquids in open containers or in which the vapors from flammable liquids are present, or in which flam- mable liquids are used in any manufacturing process, the carrying of matches is prohibit- ed and smoking shall be a misdemeanor. Suitable "NO SMOKING" signs shall be displayed. 928. LIGHTING SHALL BE BY ELECTRICITY. Flammable liquids shall not be drawn nor handled in the presence of open Elam e or-fire, but may be drawn a_nd handled when lighting is by incandescent electric lamps installed in compliance with the "National Electrical Code." STORAGE TANKS ~.. . -. 951. STORAGE MUST BE OUTSIDE i~tJILDINGS. Except as othorwise permitted in this ordinance, the storage of flammable liquids shall be outside buildings, in underground tanks or above ground tanks; except that the storage in tanks above ground and outside buildings is prohibited within the following limits; Fire Zones 1 and 2. Provided that for existing tanks within such limits, which are properly safeguarded and do not involve a hazard to other property, a permit shall be granted. ' 952• UNDERGROUND STORAGE LIMITED. Tanks buried underground shall have the top of the tank not less than 2 feet below the surface of the ground, and below the level of any piping to which the tanks may be connected, except that, in lieu of the 2-foot cover, tanks may be buried under 12 inches of earth and a cover of reinforced concrete at least 5 inches in thickness provided, which shall extend at least one foot beyond the outline of the tank in all directions; concrete cover to be placed on a firm, well tamped earth founda;~iois. 4rherc~ necessary to prevent floating, tanks shall be securely anchored. or weighted. (a) The location of a tank with respect to distance from tank shell to line of adjoining property or nearest building shall depend upon the construction, contents, equipment,'and greatest dimension (diameter, length, er height) of the tank and shall be in accord~~with the following provisions: Groups A Tanks. Any all-steel, gas-tight tank constructed in compliance with these or equivalent standards and equipped either with (1) and approved permanent- ly attached extinguishing system or (2) an approved floating roof, which is to be used only for the storage of refined petroleum products or other flammable liquids not subject to boil over, shall be so located that the distance between shell of tank and property line or nearest building shall be not less than the greatest dimension (diameter, length or height) of the tank, except that such distance need not exceed. I20 feet. Group B Tanks. Any all-steel, gas-tight tank constructed in comz~liance with these or equivalent standards but not equipped either with (1) and approved permanently attached extinguishing system or (2) an approved floating roof,. which is to be used: only for the storage of refined petroleum products or other flammable liquids not sub- ject.to boil-over, shall be so located that the distance between shell of tank and property line or nearest building shall be not less than 12 times the greatest dimension (diameter, length,=or height) of the tank, except that such distance need not exceed 175 feet. Group C Tanks. Any all-steel, gas-tight tank constructed in compliance with these or equivalent standards and equipped either with (1) an approved permanently at- tached extinguishing system or (2) an approved floating roof, which is to be used for the storage of crude petroleum or other flammable liquid subject to boil-over, shall be so located that the distance be~reen shell of tank and property line or nearest build- ing shall be not less than twice the greatest dimension (diameter, length, or height) of the tank except that such distance shall be not less than 20 feet ar.d need not exceed 175 feet. Groups D Tanks. Any all-steel, gas-tight tank constructed in compliance with these or equivalent standards and not equipped either with (1) and approved permanently attached extinguishing system or (2) an approved floating roof, which is to be used for the storage of crude petroleum or other flammable liquid subject to boil-over, shall be so located that ttie distance between shell .of tank and property line or nearest build- ing shall be not less than three times the greatest dimension (diameter, length, or height) of the tank except that such distance shall be not less than 20 feet and need not exceed 350 feet. (b)The Minimum distance between shells of any two all-steel, gas-tight tanks shall be not less than one-half of the greatest dimension (diameter, Length, or height) of smaller tank except that such distance shall not be less than 3 feet, and for tank of 18,000 gallons or less the distance need not exceed 3 feet. (e) Tanks for storage of flammable 7.i quids under a pressure in excess of 15 pounds per square inch (gage) sha.l7. be constructed and protected with safety relief devices, in accordance ~,rith the Unfired Pressure Vessel code of the American Society of Mechanical Engineers. < g59. FOUNDATIONS: DIKES. (a) In each case of the bearing capacity of the ground sha17_ determine the type of foundation to be employed. ~~here there is any doubt the Cheif of the Bureau of Fire Prevention may require borings in or. der to ascertain the subsurface information as a means of determining ~-rhether the proposed foundation is suited to ground conditions on the site. Tanks more than one foot above the ground. shall have foundations a,nd supports of masonry or protected steel, except that wooden cushions may be used; no combustible material shall be permitted under or within ten feet of any above ground outside storage tank. (b) A17. tanks containing crude oil or other liquids which have a tendency to boil over, and all tanks exceeding 50,000 gallons ( 1-,200 barrels) capacity shall be adequately and properly diked *frith a dike having capacity not less than equal in volume to that of the tank or tanks surrounded.; minimum height or earth dikes to be 3 feet and of masonry dikes 30 inches. (c) Tanks of less than 50,000 gallons (1,200'barrels) capacity shall, tuhen deemed necessary b y the Chief of the Bureau~of Fire Prevention, on account of proximity to streams, character of topography or nearness to building of high value, be diked or the entire yard provided with a curb br retaining wall or. other suitable means taken to prevent the discharge of liquids on to other property in ease of a rupture in tank or piping. (d) Dikes or wa7.ls required by the prededing paragraphs (b) and (c) shall be of earth or masonry so constructed as to afford adequate protection. UThen dikes surround tanks containing crude owl, they shall have in addition to the above capacity, suitable coping or deflector projecting invrard. properly constructed to minimize the effect of a °boil over~~ ~r!a,ve. Dikes surrounding crude oil tanks shall be not less than 50 feet from the shell of the tank or tanks surrounded. (e) The height of the dike and the distance from the inner surface of the tank or tan'_<cs surrounded sha.l.l be such as to assure the scouring action of the winds required to prevent the accumu7.ation of combustible vapors within the dike, but in no case shall the height of the dike exceed 6 feet. Masonry dikes !~rith~angular walls shall be provided with expansion joints constructed of single sheet non=corrosion metal. L~here reinforced concrete is used, the steel reinforcing member°shall be interconnected. ~ '° (f) The capacity of dikes required by this Section shall be properly maintained. Earthen dikes shs,ll have a flat section at the top and shall have a slope consistent with the angle of repose of the ma,teria.ls of which they are constructed. Deliveries of flammable liquids of Class I and II, where practical, shall be made directly to the storage tank through the filling pipe by means of a hose or pipe between the filling pipe and barrel, tank wagon or tank car from which such liquid is being drawn. agl. PUMP REQUIRED. FUEL OIL EQUIPMENTS. An-approved domestic type oil burner may be supplied by gr.-vity from two connected inside or outside storage tanks; provided neither tank exceeds 275 gallons capacity and they are cennected to the fuel line by an approved 3 way valve. Gravity feed to approve burners installed in stoves and ranges is permitted sub- i r" ject to the following provisions: 1. That no gravity tank exceed a capacity of six gallons. ° 2. A11. trucks used for the transportation of flammable liquids in bu7_k quantity exceeding 100 g-lions shall be inspected by the Chief of the Bureau of Fire Prevention, a.nd unless certified by him as to their compliance with this ordinance they shall not be operated on the streets of the City of Eugene; provided that this certification shall not be required for trucks bearing the license or approval of the Interstate Commerce Commission; or the license or. approval of the State Highway Department; or to trucks transporting flammable lictuids in drums, cans and other containers of less than 60 gallons individual capacity. No truck transporting flammable liquids in bulk shall be left unattended on any street, high~,vay, avenue or alley, Provided that this will not prevent a driver from the necessary absence from the truck in connection Urith the delivery of his load, except during actual discharge of the liquid t,~then some responsible person must be present at the vehicle; nor shall it include stops for meals during the day. Trucks containing flammable liquids may bP parked in bulk storage lots only. They shall not be ~oarked or. garaged in building other than those specifically approved for such storage by the Chief of the Bureau of Fire Prevention. Each compartment of a~gravity discharge truck tank shall be equipped ~rJith a reliable and. efficient shut-off valve located. inside the she 11 of the tank in the compartment outlet, and except during de livery operations such valves shall automatically be kept closed, or shall be so interlocked ~,rith delivery operation that it will be mechanically closed urhen d.eliv=rv ooera.tions axe completed. , The operating mechanism for such valves shall be provided with a secondary-control, remote from the tank filling parts and discharge faucets for use in event of accidents or fire during delivery opera.tinns, and such control mechanism shall be provided *.~rith a fusible section ~r~hich will cause valves to close automatically in case of fire. In every case there shall be provided bet~tieen the shut-off valve seat and. discharge faucet, a, shear section 4rhich will break under strain and leave the shut-off valve seat intact. . Tanks, chassis, exles and springs shall be metal7.ically connected. Tank trucks shall. be equipped ~r~ith drag chains long enough to reach the ground. During the filling operation metallic contact shall be `ma.inta,ined bet~~reen the fill tiiroe and the ts.nk truck. . The foregoing provisions shall also apply to the construction and operation of trailers and. semi-trailers. All trailers shall be firmly and securely attached to the to~~ring vehicle by means of suitable draw-bars, supplemented by safety chains. Every trailer shall. be equipped with a reliable system of brakes ~t~ith reliable provisions for operation from the driver's seat of the vehicle dra~,ring it. Each trailer shall be provided with side lights and a tail light. Every tank truck and trailer shall be equipped. with at least one approved hand fire extinguisher of a type suitable for extinguishingc_oil fires. o~ C~`TTTAINERS PAINTED DISTIi~TCmIVE COLORS. Port=.ble containers for Class 1 and. 11 liquids shall be painted red (entire container or conspicuous band or stripe) and be conspicuously lettered ir_ black, °DangerAt~e~'=- Kelp Lights a.nd Fire At~ray~~ . It shall be a misdemeanor to ke•Pp. or place the above mentioned liquids in containers other than those mahked as designed, or to use the containers for any other liquids or substances than those specified or fail to keep their exterior clean so that coloring a,nd lettering are easily distinguishable. o~g8 REFINERIES. No permit shall be granted for the es.tablishement of a new plant .or an addition to a plant for refining, distilling or condensing petroleum and natural gas ~nrithin the , .limits of the city until after a survey has been made by the Chief of the Bureau of Tire Prevention and an investigation made of all hazardous conditions connected there- with. If there are no schools, churches, hospitals or public halls within 300 feet, and no other building than those of the plant within 150. feet of the proposed distilling or condensing plant, a.nd other conditions are consistent with the spirit and intent of this ordinance, the Cheif of the Bureau of Fire Prevention shall grant a permit for the location desired; provided,also, that a guarantee to maintain an open space 150 feet on all sides shall begiven by the applicant. Part 10. THE APPLICATIOTT OF FLAliP~1ABLE FINISFIES General Requirements 1001. DEFINITION. The term "finishin?~ shop' shall mean a building or part thereof used for the application of flammable finishes by means of spraying or dipping. 429. -- -- 1002. Pu~~~I!PS. A permit shall be renuired for any finishing shop using more than 1 g~.).lon of material on any working d.ay, or storing in connection ~r~ith the use thereof, more than 5 gallons of flammable finish. 100 LOCATION. 1'iriishing shops in buildings of ~~rooden construction or in building used in ~rrhole or in part for human habitation or in connection with stores shall be suitabley cut off bSr fire partitions or fire vralls from other portions of the building, and. shall be equipped ~r~ith an automatic sprinkler system. 100+. STORAGE OF FLAI~4PJfABLE FINISHES IA1 FINISHI3dG SHOPS. The storage of flammable finishes inside of finishing shops shall be restricted as follot~rs: (a}; Not to exceed 20 gallons, with no container exceeding 1 gallon in capacity, may be stored on a substantial shelf a.t least ?+ feet above the f7.oor and ~,~nth suitable guard strips to prevent containers from falling. (b) 3~.TOt over 50 gallons with no containe r exceeding 5 gallons capacity may be stored in a cabinet, entirely enclosed and. made of suitabl~ stiffened sheet iron of at least lg U.S. gauge in thickness, and double walled with 1;~-inch air s~oace or or equiv- alent construction. Doors shall. be of construction equivalent to the walls of the cabinets, be provided with 3-point lock, fit closely, and be kept closed when not in use. Door sills shall be raised a...t least 2 inches ~.bove the bottom of the cabinet. (c) Quantities in excess of these, given under (a) and {b) shall be in suitable storage and mixing rooms as specified in erection 915. ).00 MIXING. Mixing operations shall be carried on only in storage rooms a.s outlined in Section 915 or in special mixing rooms of.equiva.lent construction; provided that con- tainers of a. total capacity not exceeding 2 gallons may be opened and their contents mixed i.n the finishing room, during such times as the ventilating system is in oper.a.tion. (b) Receptacles containing flammable finishes shall be kept tightly covered. ,r- 1006 CONTAII~TERS. (a) All containers of flammable finishes shall be of metal suita.bly;;:constructed to prevent le~ka,ge; I.C.C. containers shall be acceptable for stor age. (b) Containers seed as part of the spraying outfit shall be of metal, except that g3.ass containers not exceeding 1 pint capacity, also cont ainers with glass inner linings of not more than 1 gallon capacity (protected.~~~itr, a metal holder or guard permanently fixed around the container) may be used. 100 VEA'TILATION: (s) Unless suitable ventilated spray booths are used for a7.1 finishing operations finishing rooms shall be cor_timaously ventilated during operation. Ventilation shall be such a.s to effect at least one comyolete change of air every three minutes. (b) Exhaust outlets in finishing rooms shall be located not over 5 feet above the floor and. shall discharge directly outside of building. Stacks and ducts shall b~ of substantial constrrcton with ,joints riveted and soldered or otherwise made tight. jhe y shall extend as directly as possible to the outside air and preferably not through other rooms, and be so arranged that the discharge of vapor a.nd residue or fire therefrom will not endanger property. They shall not be connected to other ventilating of collecting systems. 1008 LIGHTING AND ELECTRICAL EQUIPMENT: ` Artificial lighting shall be by electricity only. All electrical ~-tiring and e~+uipment~ in finishing shops shall be in accord with the National Electrical Code rules for. Hazardous Locations. Where spraying is done in properly arranged spray booths, portions of the room more than 20 feet from a booth need not be considered hazardous loca.ticns under the National Electrical Code unless such portions are so classified as the result of other operations. In the area `.rithin 20 feet of properly arranged spray booths the National Code rules for Haza.rd.ous Location may be modified. to a,11o+.~~ motors of the tota7.ly enclosed type or of the open induction tupe having no brushes, make or break contacts, collectors or otr~er arcing or sparkir_g parts, a,n~ to allow lamps of the enclosed vapor-tight type. 430 1008 HOUSTKEEPING, (a) Finishing shops shah. be kept free from all unnecessary combustible materials ^nd refus_e. No open flame shall be permitted in storage or mining rooms, storage cabinets, finishins rooms ors ra booths. For he~.ting purposes indirect systems only, such as steam ,_ ~ p y ! hot air or hot ~•rater, shall be used. 1017_ GROUND II+TG } _ Ali metal spray booths, dip tanks, bake ovens, mixers, filters, pumos, rooters and shafting shall. be e]_ectrically grounded in an effective manner. .1.012 EIRE EXTINGUISHING EC~UIPI~ErTT 3 . f The Chief of the Bureau of Fire Prevention shall require the instal]_ation of ~ portable fire. extinguishers_or other fire extinguishing a.pplia.nces as may be deemed necessary in finishing rooms, or near storage cabinets and spray booths. 1013 SMOKING. Smoking shall be prohibited in any room used for the storage of flammable finishes and in any finishing room. Suitable "2S0 SP~iOKING" signs shall. be prominently ' displayed. SPRAYIP3G ~ 101- (a) A11 sprayingshall be performed in a spry room or spray booth as specified } belot~r or its equivalent. (b) If spraying is performed in a room not provided Thrith spray b ootYs as herein provided, •such_spray room shall be separated from tree remainder of the building by partitions of fire-resistive construction eduivalent to incombustible ~rrall board or ~frooden studding or wooden studding covered on both sides with sheet iron. Doors in openings .in spray room partition shall be equal in fire resistance to partition and shall be of the self-closin?• type or so installed ~,s to close automatically in case of fire. ( c) Spray booths shall be of metal or other. non-combustible. material and. of ample size to acaommod_ate the object to be sprayed. (d) Spray booth`s. shall be provided with exhaust systems of sufficient capacity to adequately remove vapors or residues. (f) ~ Pails or receptacles shall not exceed 10 gallons capacity for gravity feed to spray guns and shall be kept covered with tight fitting non-combustible covers. Only wire cables or those containing stranded ~frire cores sha.Il; be used to suspend gravity-feed pails. Pails or receptacles containing flammable finishes shall be returned to the storage cabinet or storage room at the close of each day. (g) No portab7_e lamps shall be used inside spray rooms or booths. Lamps shall be prohibited inside spray booths and ducts and in any location ~r~here there is possibility of the spray coming into direct contact with the laMp of fixture. Electric motors shall not be placed inside booths or ducts. (h) Motor vehicles shall not be moved by their ocm po~,,rer *fihi2e fn the finishing roam. Electric storage b~.tteries shall be removed.' X31 - - - - - -- DIP TAIv'KS ink Dip tanks having an area~in excess of 10 square feet shall be provided +rrith approved covers arranged to close automatically in case of fire a.nd also arranged so that they can be closed manually. Smaller dip tanks shall be provided ~;rith suitable covers or +;rith asbestos blankets ?~hich can be placed over the tanks. If dip tanks are protected by an approved automatic fire extinguishing system. employing afire retardant chemical or gas or grater spray the covers specified above may be omitted. JAPANPdING AND ENAMELING 1016. Japanning and enameling drying ovens shall not be placed in contact with wood floors or other combustible material. Heating of ovens shall be ~9ne by steam coils, indirect hot air circulation through oven to outside, indirect hot oil circulating pipes, indirect gas burners or electricity. Open flames•or fires shall not be in comrmznication with the compartments urhere goods are being treated. PART II SALE AATD USE OF' DRY CLEAIv~ING LIQUIDS "Dry Cleaning" shall be known as the art, act or process of cleaning or renovat- ing Waring or other apparel, clothes and other fabrics or textiles, where inflammable liquid is used, or cleaning of anything +;rith inflammable liquid. "Inflammable Liquids" shall mean any liquid having a flash point Belo+rr lg7 degrees Fahrenheit or s6 degrees centigrade closed cup tester. 110. Dry Cleaning Permits. (e,~ No person'ahall perform any dry cleaning whether of a commercial or private nature, using more than one gallon of dry cleaning liquid or non-flammable dry cleaning liquid, without a permit therefor. (b) No permit shall be granted for any dry c heaning operation employing dry cleaning liquid except in a. plant ,conforming to the requirements hereinafter given. CONSTRUCTIOr7 OF DRY GLF.ANID?G ROOMS. No dTy c1 owning, as herein defined shall hereafter be done for hire within the City of Eugene exce~ot in a, separate building or section thereof, cut off by a fire wall constructed of brick, stone, concrete or other fire-resisting material, any opening in ?which shall be protected by +;~ire glass and metal sash, standard fire doors, curtains or shutters. Such building or section shall be not over one story and shall not exceed sixteen (16) feet in height and constructed of masonry. There shall be no basement or open space beneath the floor. A7.1 doors shall have raised sills at other openings abutting on adjacent property, a street, alley or court of width less than thirty (30 ) feet, shall be, provided with wire glass and metal sash and approved fire doors, curtains or shutters. Such building shall be well ventilated at or near the floor level, and no lights shall be permitted vrithin such build- ing or section except vapor-proof electric lights installed in accordance with the Nat- ional Electric Code. SHAFTING AND R40TORS. ATo motor, stove or spark-omitting device of any descript- ion shall be permitted. in a roam for dry cleaning. All shafting necessary for the operat- ion of machinery of any washing, drying or distilling room shall enter said room not less than six feet above floor level. STORAGE GF IIv'FLAI~~I~~IABLE LIQUIDS. Inflammable iiquids shall not be handled in open containers and all inflammable liquids shall be pumped direct into all machines, a.nd all machines shall be provided with a system of pipes whereby all inflammable liquids can be drained direct into underground storage system. Inflammable fluids shall be re- moved from washing machines, stills and extractors when machines are not in actual operat- ion. irThen steam is available, there shall be a steam line not less than one (1) inch in diameter providing for fire extinguishing purposes in the washing, drying and distilling rooms +rrith suitable controlling valves arranged on outside of room. There shall also be provided one approved fire extinguisher of not less than two and one-half gallor;s capacity for each +;~ashing, drying and distilling room. 1111. Heating Equipment. (a) Heating sha.Il be by steam or hot water only. Steam and hot +rater pipes and radiators for heating and drying purposes shall be at least one inch from all wood+~rork a.nd shall be protected by substantial metal screens arranged so as to prevent combustible goods or materials from coming in contact with sucPy pipes and radiators. (b) Boilers shall be located in a detached building or in a boiler room cut off from the dry cleaning room by a fire wall constructed of brick, stone, concrete, or other fire resisting material, vrith openings -protected by approved self closing fire doors and h?Ying sills raised at least six inches above the dry cleaning room floor. SMOKING PROHIBITED. Smoking is hereby prohibited in any washing, drying or distilling roam, and notices to that effect shall be posted in conspicuous places. 4~2 ( PART 12. PREVENTION OF DUST EXPLOSIONS. - i i 1201. The Bureau of Fire Prevention is hereby authorized to prohibit further operat- ion in any grain elevator, flour, st?rch or feed mill or pliant pulverizing cocoa, sugar, ! apices, coal, or other material producing flammable dusts where:. ~ (a.) Elevator legs, spouts, hoppers and other conveyors are not dust tight. 1 (b) Accumulations of dust are permitted in the interior of the building and a suitable dust removal system is not maintained. (c) Gpen flame or spark producing equipment is permitted in rooms containing ~ dusty atmospheres. I (d.) Pneumatic or magnetic separators are not maintained ahead of all grinding or pulverizing machines. (e} Operation is not under competent supervision. ~i (f) Machinery and parts of the crushing, drying, pulverizing and conveying 1 systems are not adequa.tPly grounded. FART 13. i AAZARDOUS CHEP~IICA.LS. i ,-- x_301, The Chief of the Bureau of Fire Frevention shall be empovrered to restrict the ~ storage, handling and sale of chemicals and chemical compounds trhich are of a. corrosive or poisonous nature, or which materially increase the fire hazard. ~r7here kept in containers i or _oackages usual to the retail trade, no general restriction shall a.pioly other than s ~~ shelving shall be substantial and storage shall be neat .and orderly. 1302. For storage of hazardous chemicals in warehouses, factories and ~Tholesale stores. t material of an oxidizing nature, such as nitrates, nitrites, chlorates, etc., shall be ~ stored in dry places, and the Chief of the Bureau of Fire Prevention may require a sep- arate room or building ~,rhen the aus,ntity stored constitutes a material hazard. i 1~ Bulk storage or storage of t7ro or more carboys of acid shall be outside in a yard or an enclosure, or properly protected on the roof of the building, or in a, special room i iprovi:ded ~sith a suitable container for the character of acid in case of breakage or leak. ~ 1 0~. The Chief of the. Bureau of Fire Prevention nay require the separation, or isolation ~ of any chemical which is of a nature vrhich in combination ~,rith other chemical or with organic matter may bring about afire or explosion or may liverate a hazardous or poison- ~ pus gas. 1 - ~ PART 1~. COP~IBUSTIBL'E FIBRES. -101. The term combustible fibres shall include cotton, sisal, henequen, ixtle, jute, hemp, to!~r, coca fibre, oakum, baled waster, kapok, hay, straw, Spanish.moss, paper and shred- ded paper, rags ar_d excelsior. - i~02. Loose fibres (not in suitably bales or pack2ges), whether housed or in the .open, shall not be stored ~sithin 100 feet of any building except as herein sp~ified. t 1h03. 1~Tot to exceed 100 cubic feet of loose combustible fibre may be kept in any buildig provided storage is in a metal-lined wooden bin, equipped with a self-closing metal-lined cover. _1~Oli. Quantities exceeding 100 ,cubic feet of loose combustible fibre, but not exceed- ; ing 500 cubic feet, may be stored in rooms or compartments having floor, walls and ceiling constructed of material possessing sufficient fire resistance to 4rithstand a standard one-hour fire test. Openings into such rooms or compartments. shall be cut off from other parts of the building by approved fire doors. 1P+0 Quantities exceeding 500 cubic feet of loose combustible fibre may be stored in approved vaults, constructed as follows: i (a) Storage vaults shall preferably be located outside of buildings. If~located ixiside, safety vents to outside air shall be provided, - (b) t'~alls, floors, and ceilings shall be constructed of brick or other approved non-combustible material. Roofs of outside vaults shall likewise be of non-combustible m material but may be so constructed as to readily give*day in case of an internal explosion. Ulhere such protection is not available steam jets or inert gas systems ap~oroved for fire extinguish- ing purposes shall be installed. 1~G5. 1`Tot to exceed 2,500 cubic feet of looses fibre may be stored in detached "loose house" suitably located, ~rrith openings properly protected against entrance of sparks. The "1-Dose house" shal_1 be used for no other purpose. 1~0 Blocks or piles of baled fibre shall be separated from adjacent storage by aisles not less than 5 feet wide; or by flash fire barriers consisting of continuous sheets of non-combustible material extending-from floor to a height of at least one foot beyond the sides of the piles. , 1+08. Sisal and other fibres in bales bound ~,uith combustible tie ropes, also jute and other fibres liable to sr,uell when wet, shall be stored to allow for ex~oansion to the extent of 20 per cent of their bulk in any direction without endangering building walls, ceilings or columns. Not less than e feet clearance shall be maintained bet~r~een sprinkler pipes and tops of piles. Not less than j feet clearance shall be left bet~rreen galls and sides of piles, except that if storage compartment is not more than 30 feet in width, one foot clearance at side ~;ralls will be sufficient, provided a ten ter aisle not less than 5 feet t,~ide is maintained. 1~-QG. Unlimited quantities of hay, straw, and other agricultural products may be stored in or near farm buildings located outside closely-built areas. PART 15. REFRIGERATIGN. 1 O1. (a} No installation of a refrigerating unit or system containing in excess of 20 pounds of refrigerant shall be made until a permit has been obtained from the Bureau of Fire Prevention, except that no permit shall be re:±uired for non-condensing refriger- ating systems using-air as a refrigerant. (b) Systems requiring a permit and containing any refrigerant ~rrhich is harmful to health and. the vapors of ~•rhich are not readily apparent through odor or irritating effect shall have added to such refrigerant a suitable leak detecting agent ~,rhich trill give ~r~arriing before dangerous concentrations are reached. This restriction shall not apply to systems employing carbon dioxide. (c) For the purioose of this ordinance a '~Toxic~' refrigerant is one falling in Under4rriters~ Laboratories, Inc. toxicity classification Groups 1 to ~+ inclusive. The following refrigerants are toxic as thus defined, or are flammable or both toxic and flammable. Except in plants used exclusively for ice making, refrigeration or cold storage no system"containing over 100 pounds of toxic ~or flam-~able refrigerant shell be" instal- led unless it conforms to the folloTrring provisions: (a) Refrigeration shall be by the indirect method, except that direct refrig- eration will be-permitted in rooms, vaults or other spaces used for storage only, or in connection ~hrith a manufacturing process located on the ground floor only fl.nd with adequate exit facilities. No brine circulating system employing a brine having a flash point 'below 1000 ~'. shall be permitted in any ].oca.tian in t;rhich an indirect system only is per- missible. (b) Each compressor shall be in -a special machinery room ~,aith suitable exit to the outside. Adequate means for ventilation sha.11 be provided by a door or tvind.ow opening to the outside or a mechanical system•of-ventilation-shall be provided. (c) Remote control shall be provided. such .that all machinery can be shut down ~,vithout entering the machinery room. •- ---•---- •---~• • (d) Suitable mask shall be provided, which shall be kept in operative condit- ion in an easily accessible case or cabinet immediately outside the machinery room. (e) All doorways betvreen the machinery"room and other -parts of the building shall be normally closed and shall be tight-fitting. No other openings between the machinery room and other parts of the building shall be permitted. 434 - - - --- -- _s _ -- =-- - - _ - - = - -__ - - (f) No open flame or spark producing device shall be permitted in any refrigerating machinery room ~•fith a system containing a flammable refrigerant. 1 0 ~ (a) No system containing over 1,000 pounds of butane, ethane, propane or ether refrigerant having a flash point belo~~o 25° F. shall be permitted vaithin the folloTrring limits: Fire zones 1 and 2. (b) No system of the intermittent absorption type containing over 1,000 pounds of refrigerant shall be permitted, and no system of the intermittent absorpt- ion type containing over 100 pounds of refrigerant shall be permitted unless the heating medium is low pressure steam. (c) Coils carrying refrigerants which are flammable or which are toxic are defined in paragraph 1501 (c), shall not be placed in air ducts or other air cowling systems, Brine or water cooled by such refrigerants may be sprayed into such air passages or may be circulated through coils located in such passages, but no such brine shall contain any flammable constituent. 150li• (a) AlI refrigerant piping, tubing and fittings shall be of a material suit- able for the refrigerant employed. Where matches are sold at retail original sealed packages may be stored on shelves. ?~t'hen such packages are broken, individual boxes shall re stored. in metal or metal lined. bins as described. in Section 1606 above. A priv~_te garage is a building or portion of a building in which one or mere vehicles or other self-propelled vehicles or other wheeled r..a.chines using volatile inflammable liquid. for fuel or power shall be housed or kept for private use and in orhich no business or industry connected, directly or indirectly +r~ith motor vehicles is carried on. A public garage is any garage to ovhich the public is invited and~or has access "to-for a purpose erith.in the scope of the business that is carried on therein, and~or where are housed for rent, care, repair, demostratiori, storage or sale, four or. more motor vehicle: or self-propel.Ied behicles or other wheeled machines using volatile inflammable liquid for fuel or po~~~er. No person, firm or corporation shall. hereafter e.stabliuh, construct or operate a. pubi.ic garage unless the building have exterior walls of masonry construction, with fireproof floors, and all ~rindou~s, doors or other openings abutting on adjacent property, or on a street, alley or court of less than thirty feet in +aidth, be provided +,~ith wire glass and metal sash, approved. fire doors, curtains or shutters; provided, no building occupied as a garage at the time of the pafisage of this act shall be affected hereby, except the provisions relating to inspection and. examination of buildings and premises, which provisions shall apply to all buildings no+r~ or hereafter used or occupied as .Tarages; and, provided, that no enlargement, extension, alteration, replacement or reconstruction of any building or any part thereof, occupied as a public garage, other than repairs as defined herein, shall be made except in conformity uaitr. the provisions of this act; provided, further, the Chief of`the Bureau of Fire Prevention may issue a permit for the exhibition or automotive vehicles in buildings other than of r~a.sonry construction +~ahen such precautions and safety plans a.s d.esigned and declared by the Chief of the Bureau of Fire Prevention shall have been complied with by the applicant for such permit. Such permit shall: state the place and. period of time for such exhibition, a.nd shall specifically provide that during such period the Chiif of the Bureau of Fire Prevention or his deputies shall direct al.l matters in regard. to the safety of human 1_ife and property in such place of exhibition and entrances thereto and exits therefrom. ELECTRIC `vIIRIidG. All wiring shall be installed in accordance +,vith the electrical code. (c) No light of any kind other than electricity shall be used for illuminating purposes in a,ny automobile garage when electricity is available. (d) All electric motors not actually a part of an automobile shall be located at least four (~+) feet above the floor, unless of approved explosion-proof type. (e) All repair shops shall be kept clean and the floor free from oily ~uaate or rags; all such r~.gs and t~raste and. combustible rubbish shall be kept in metal cans or receptacles covered +r~ith tight fitting covers. Part 18. FIRE EXITS 1801. No person shall at any time place an encumbrance of any kind t~rhatsoever before or upon a,ny~fir.e excape, balcony or ladder intended- as a means of escape from fire. It shall be the duty of every member off the police and. fire departments who shall discover any fire es.ca.pes encumbered in any manner to forvrith report to the Bureau of Fire Prevention and. the said Bureau shall immediately notify the owner and the tenant to remove such encumbrance. 1802 It shall be unla,~aful for any person to place, store or keep, or permit to be place, stored or kept under or at the bottom of any stairtrray, inside or outside, elevator ov other shaft in a.ny building, any combustible or flammable matere.ls, fluids or compounds, nor shall any such combustible or flammable materials be placed or stored or. kept in any place +,rhere ~,gtl~tion or burning taould obstruct or render hazardous, egress from a. bui~.ding. 1803• Igo obstruction shall be permitted in hallvaays of tenement houses or apartment hou.sea . 180 A7.1, doors, aisles and passageways within and leading into or out of places of assembly shall be kept free from easels, signs, standards,camnstoors, chairs, sofas, benches a.nd any other article that might obstruct or delay the exity of the audience, congregation or assemblage during the entire time during which any shoe,+, performance, service exhibition, lecture, concert, ball. or other assemblage naay be held. Clear passage from all exitys and on sid.eeialks must at a11. times be maintained outside of all places of assembly. No aisle, pase:agetr~ay or stairway in any store shall be obstructed +.aith tables, sho~•~ cases, or other obstruction during hous said ,s tore is open to the public: It shall be the duty of the Chief of the Police Department to render assistance in the enforcement of the provisions of this part and to direct and require police officers to enter all places of assembly for such purposes. 1805 MARKING OF EXITS. (a) In rooms accommodating more than seventy-five persons, required exit door?~rays, other than those normally used for entrance, shall be plainly marked by approved exity signs, sufficiently illuminated +n~hen the floor area is occupied, to be readily distinguished. (b) Directional signs, as required, shall be placed on walls or otherwise displayed in conspicuous loca~ioris to direct occupants to exits. 1806 LIGHTING OF EXITS. (a) Required exity +aays shall be kept adequately lighted at all times that the building served. thereby is occupied.. (b) ~~Ihere the nunber of persons exceeds 75 in any room the artificial lighting of the room and of the exit ways therefrom shall be by electricity so arranged a.nd supplied that interu~ot~en of supply to anyone lighting branch circuit twill not result in extinguishment of all the lights in the room or all the lights along the exit way. Such appliances may consist of automatic alarm syst"ems, automatic sprinklers, standpipe and hose fixed, s~heeled cr portable chemical extinguishers of a type suitably for the probable class of fire, or suitable asbestos bla.nkets', manual or automatic covers or the introduction of a.n inert gas. In specially hazardous processes or excessive storage appliances of more than one type may be required or special systems installed. 190 Failure to install or provide the equipment oxd.ered by the Chief of the Bureau of Fire Prevention, a.nd. to maintain it in op erative_ccr_dition at all times, shall be con- sidered. a violation punishable as indicated hereina.ftPr in this ordinance. Repeated disregard of such orders shall constitute sufficient bases for the revoking cf any p~^rmit held. Part 20 GAS APPLIANCES AI~iD CONATECTIOATS. ~ 2001 SIItTT*OFF VALVE'S. An outsir..e valve shall be installed on every gas service pipe ~ regardless of size that sup~o7.ies large stores or factories, or places of public assembly such as churches, theatres, motion picture theatres, schools, and hospitals, and on every service pipe 2 1~2 inches ar la.rger in diameter.. 1 !f 2002 Shut-off cocks and+valves shall be pl?ced in suitable stop or valve boxed man- ! holes or vau7_ts, the covers of ~;=hich shall bear the name of the cam-pany to which it iii belongs and the valves if necessary tagged to properly identify their purpose. 2003 Al ]_ gas burners §hall be p]. aced a.t ].east 3 feet belo~,, any *~roodwork or ceiling attached to trooden beams, unless the same is properly,protected by a shield, in T~rhich case the distance shall be net less than 18 ir_cries. 200- No gas bracket on any lath. and pla.gter partition or wooc'work shall be less than 5 inches in length measured from the buy°ner to -the pl=;s ter surface or oroodwork. 200 Gas connections to stoves, heaters and other appliances shall be made by metal pipe or by approved metal tubing securely fastened in place, except that for devices ~ which require a movable connection, approved, flexible tubing as s~aecified belo~t..= ma.y j be used provided there is no shut-off on the device. 2©©5 It small be unla:~~ful for any person to use, sell, expose or offer for sale, or to install of fix, any tubular connection of fabric intended for any illuminating gas fixtures, stove, heater or lamp, or ot2~er gas appliances, unless such tube connection, hose or similar device sha.l]- be approved by the Chief'~ef the Bureau of Fire Prevention in accordance with the folloGring; specifications: (a) Gas tubing shall be made up in suitable lengths with end pieces securely a.tta.cr~ed by the manufacturer. (b) A1]. gas tu'~ing must be made up of a strong gastight metal core with rubber packing and covered with a layber of good quality rubber or other suitable gas-tight material and a braided. cloth covering. Such, layers or covering or. tubb~e~ to be put on over the met-J_ ccre in such a. ,ray that it ~~rill of itself form a gas-tight ~rrall. (c) Each .length of tubing sha].1 be labeled by the mannfacturer ?•rith a tag attached to the tubing or a marking on t2-.e end piece, ,or both. The operation of the safety device +~~ihich shuts off the main gas supply, shall not depend on the closing of an electric circuit. Part 21. MI SCEI~LAr'ECUS 2101. ~'o person shall kir..d ].e or maintain ~ ny bonfire or shall knowingly furnish the materials for such fire, or autorize any such fire to be kindled or maintained on or in any street, alley, road, land or public grounds or upon any private lot, unless ' a ±nrritten permit so to do shall. first have been secured from the Bureau of Fire Prevention. 2102 No person sha]_1 detiosit ashes, smouldering coal or embers, greasy or oily substances or other matters liable ro create spontaneous ignition within ten feet of a,ny wooden or plastered wall, partition, fence, floor, side~~a].k, lur.~ber, hay, shavings, rubbish or other combustible receptacles. Such recepta.c].es, unless resting on a, non- combustible forror or on the Bound outside the building, must be placed an non-combustible stands, and in every case must be kept at least tiro feet away from any combustible vrall or iartition. - 2193 No person shall. permit to remain upon any roof or in any court, yard, vacant lc:t or open space, any acru_nmulation of vraste pager, hay, grass, straw, weeds, litter or combustible or fla.mma.ble waste or rubbish of a.ny kind. Al]. we=ds, grass, vines or other gro~•rth, +shen same endangers property, or is liable to be fir. ed, shall be cut dotirn and. removed by the otfrrer or occupant of the property it is on. 210 No person making, using storing• or having ch:.f~ge or control of any shavings, excelsior., rubbish sacks, bags, litter, hay, straUr or combustible trash, waste or fragments shal]. fail., neglect or. refuse at the close of each day to cause all such material which is not compactly baled a.nd st.cked in an orderly manner to be removed from the premises or stored in suitable vaults or in metal or metal lined covered receptacles or bins. The Chief of the Bureau of Fire Prevention shall require suitable baling presses to be installed in stores, apartment buildings, factories and simila.,r places +rrhere accumulations of paper and waste materials are not removed. a.t least every second day. 2105 The storage of empty packing cases, boxes, barrels or other similar combustible containers is fog°bid.den i•~ithout a permit exceot in the open. Provided., ho+r~ev?r, that no permit shall be required for. t're storage +r~ithin a manufacturing or other establishment of sufficient oacking cases, boxes barrels o.r other similar contairers•to properly carry on its opPraticns, but such storage shah. be orderly and not so located a.s to endanger exit from the building. Storage in the open of packing cases, bo xes, barrels or other sinila.r ~eombustible containers shall not be more than twenty feet in height, and shall be at least fifty feet from the nearest '~uil.din~•. A]_]. such storage shall be in a compact and orderly manner. 2106 Cotton batting, straw, dry vines, leaves, trees celluloid or other highly flammable materials she].]. not be used for decoration purposes in show windows or stores without a permit, provided., ho~~rever, that nothing in this section sha.l~. be held to prohibit the disp].ay,of salable goods permitted and offered for sale in the store. Electric light bulbs in stores or public halls shall not be decorated +~rith paper or other combustible materials. 2107 No person shall take into any building barn, bessel, boat or any other place where highly flammable, combustible or explosive materi8l is kept, an open flame unless such light or flame shall be +r~ell secured in a glass globe, +aire mesh cage or simi].a.r approved device. 210 All chimneys, smo'.~estacks or sirzi],ar devices for conveying smoke or hot gases to the outer air and the stoves, furnaces, fire boxes or boilers to which they are cor_nected shall be constructed and maintained in such manner as not to endanger adjacent property, and in accordance tr~ith the Building Code. 2100 No heating appa.ra.tus ~•.nth an open flame, and no artificial lighting system other than incandescent electric lights shall be used. in any warehouse for the storage 4~a - - l of rags, excelsior, hair or other. flammable or combustible material; nor in any shop or ', factory used. for the maufacture, repair or renovating of mattres~.es or bedding; nor in any establishment for the upholstery of furniture. ~ 2110 All trapdoors, except those which are automatic in their ipera,tion, in a.ny factory building or buildings used for storage shall be closed at the completion of the business of each day. Bach machine shall be connected to a.n ample blovrer or dust collecting system. 220L- Bach room urhere rubber cement is used or mixed., or flammable solvents are applied, shall be equipped.vrith a.n effective system 'of mechanical ventilation. 2205 Tire retreading shops in buildings of wooden construction or in bui?.dings used in +~~hole or in part for. human habitation or connection v?ith stores shah. be suita??ly cut off by fire partitions or fire vralls from other portions of. the building, and shall be equipped with an automatic sprinkler system. . Part 23. ALTTOi-~OJ?ILE tti'RECKI?'1G ARID JUNK YARDS 2301 A permit shall be obtained from the Chief of the Bureau of. Fire Frevention for the est-~bl.ishmsnt and maintenance of an automobile +.arecking yard. or a junk yard, and no such yard shall be located. as t^ seriously expose adjoining or adjacent properties. 2?02 r?o automobile or any part t'nereof shall be burned for vrreckir_g or sa.lv~,ge purposes in or on any premises occupied a.s a, vrr.ec'_~ing yard. 2303 At junk yards, +.ahere 1?rge quantities of. vaaste, paper, rags and other combustible materials are handled. and stored, the process shall. be carried on in a building of other than frame construction. Height shall be not over one-story, unless building is of fire- proof construction. One-story buildings shall. be provided vrith skylights in th_e roof as may be required by the Chief cf the Bureau of Fire Prevention to provide a.denuate ventilation inr,ase of fire. Vprtic~,l: openings shall be properly enclosed and vrindovr openings shall be protected. by metal frames ~.nd sash glazed with wired glass. Blower and. exhaust systems sha]_1 comply tr~ith the Standards of the National Board of Fire Under+.ariters for the instal7.ation of Bloarer and Exhaust Sustems for Lust, Stock and Vapor Removal. 2402 Provisions shall be made for the removal from the building of slabs and other waste piece of wood, either as produced or at the close of each working day. 2403 The burning of shavings, sawdust and refuse material shall be permitted only under boil-Prs, in furnaces or in properly constructed incinerators or refuse burners. A11. stacks shall be provided ~~~ith suitable spark arresters. At boilers or other points where sa.~frdust nr sha.vings are used as fuel a.~-masonry or concrete storage bin, with raised sill, shill be -provided. 2404 Fire fighting equipment, either chemical extinguishers or small hose supplied from a- suitable v~.~ater system, shall be ~orovided near any machine producing shavings or sa~~rdust. Part 25 Py'NALTIFS FOF. VIOLATION Any person, firm or eor-~ooration, which shall violate any of the provisions of this ordinance, or fail to comply with the terms of any regulation thereunder shall upon conviction in the Municipal Court, pay a fine of not to exceed $100.00 and the costs of the prosecution, and nay be imprisoned in the City jail one day for each $2.00 of the fine unpaid. (a) The application of the above penalty shall not be held to prevent the enforced re~:~oval of prohibited conditions. ~b~ Conflicting Ordinances Repealed.
