THE CITY OF EUGENE DOES ORDAIN AS FOLLOWS: Section 1. The Common Council of tiia City of Eugene hereby initiates vacation proceedings on its own authority without petition or consent of the property owners, excepting as provided by statute, of the following described property, to ~-it; The alley one-l-Lalf block long which runs East and West between Lots 2 and 3 from Oak Street to the allay running Riorth and South between 13th and ].1~.th Street, in .Block '7 of Christians s 2-,ad Addit- ion to the City of Eugene, Lane County, Oregon. Section 2. A hearing shall be held upon the proposal to vacate the alley as herein provided, and said hearing shall be had on the 8th day of April, 191x.6, at the Council Chambers in the City Hall in Eugene, Oregon, at 7;30 o~clock P.M. of said day, at which time all persons via 11 be heard upon objections or suggestions with reference to the vacation of said portion of alley, and at said time the Council will provide for the vacation of said premises or deny such vacation, and in ease the vacation is made will make provisions for any damages sustained, by local assessment. Section 3. The City Recorder be and he is hereby required to im- mediately publish for four consecutive weeks in a newspaper published in Eugene, Lane County, Oregon, the newspaper selected by him being designated as the offic- ial newspaper of the city for this purpose, notice of the proposed vacation. Such notice shall give the description of the area to be vacated as herein set out, and state the date when this ordinance was passed; tha name of any petit- ioners petitioning for said vacation; the date when the said petition,. together with any objection or remonstrances which may be made in writing and filed with the City Recorder prior to the date of said hearing, will be heard and considered. Section 1~. The City Recorder shall forthwith and within five days after the first publication of said notice, post or cause to be posted at or near each end of said proposed vacation, a copy of the foregoing notice which shall be headed "Notice of Alley Vaca.tion," and which nctice shall 'oe posted in at least two conspicuous places in such proposed vacation of such area. 4(34 -_---- --- -- The posting and the first day of publication of such notice shall be not less than twenty-ei~t da~,rs before the time set for hearing. Section 5. Whereas, the area sought to be vacated is not used as a roadway and is costly and dangerous to maintair_, and serves no property, tiie Common Council of the City of Eugene deems it necessary in the interest of the city that said portion of alley be vacated, and an emerge ncy is hereby declared to exist and it is declared to be necessary for the immediate preservation of the peace, health and safety of the City of Eugene that this ordinance take effect immediately upon its passage by the Common Council and its approval by the DSayor, and it is so ordered.
