HomeMy WebLinkAboutORDINANCE NO. 8897 4~9 ORDINANCE N0. 8897 An Ordinance submitting to the electors of the City of Eugene and to the electors of the territory hereinafter described the question "For Annexation" or "Against Annexation" of such area and ordering a special election to be held in such aroas and in the City of Eugene, on the 18th day of July, 19l~.6, designating polling places, appo~.nting fudges and clerks of electian and all acts necessary for the carrying on of said election, and declaring an emergency. THE CITY OF EUGENE DOES OFDAIN AS FOLLOWS: Section 1. That whereas more than fifteen per cent of the resident owners of property in the territory proposed to be annexed having signed and filed with the City authorities a petition requesting such new territory to be included therein, the Common Council of the City of Eugene hereby submits to the electors of the City of Eugene and to the electors of the following described area, to-wit: ComTnencing at the intersection of the mouth line of 22nd Avenue West and the West City Limits of the City of Eugene, running thence north along the West City limits to the South line of Fifteenth Avenue West, thence Westerly along the South City limits of Eugene to a point 903 feet East of Chambers Street, being the East line of the municipal air- port, thence South 520 feet to the South line of D.L.C. No.37, thence West $3.3 feet, thence South 530 feet to the center line of 18th Avenue West, if extended, thence East 571 feet to the West line of Polk Street, thence South 20 feet, thence East along the South line of Eighteenth Avenue West 378 feet to the East line of the municipal airport, thence South along the East line of the municipal airport 17i~5 feet to the South line of 22nd Avenue West, if produced west, thence East 200 feet-=to the place of beginning. the question "For Annexation" or "Against Annexation" of such territory to the City of Eugene. Section 2. The Common Council of the City of Eugene hereby orders a speoial election to be held in the City of Eugene, Oregon, and to be held in the area described, on the 18th day of July, 19.6, at which election there shall be submitted to the eleotors of said city and to the proposed annexation area for their approval or refection the proposal "For Annexation" or "Against Annexation" of said area to the City of Eugen®. Section 3. That said proposal shall be placed upon the official ballot by the City lecorder to be voted upon by the elecstors of the proposed area and by the electors of said city at said election. Section ~. The City Recorder shall provide.sueh poll books, ballot boxes, tally sheets and such other supplies for eaoh proposed area, as are neces- sary for the carrying on of the election, all of which shall be delivered to the election board. Section 5. The polls shall be opened in each of said polling places: at eight oTclock in the morning and shall be kept open until eight o~alock in the evening on said election day. Section 7. The first named Judge of said election board as provided for in this ordinance shall be Chairman of the board of which he is a member, and the ballots cast at said election shall be counted, tabulated and return to the City Recorder as provided by law. Section 8. The City Recorder is hereby authorized and directed to give ~ notice of said election by publication in a newspaper of general circulation in such corporation and in such territory so proposed to be annexed, for the period i of four weeks prior to such election, also by posting notices `thereof in four 4f1 public places within such corporation and four public places in the territory pro- posed to be annexed for a like period. Such notice shall distinctly state the proposition to be so submitted and shall designate especially the boundaries of the territory so proposed to be annexed and the electors shall be invited thereby to vote upon such proposition by placing upon their ballots the words "For Annexation" or "Against Annexation".- Section 9. The Judgos and Clerks, before entering upon the dis- charge of their duties at such election shall each take and subscribe before an officer authorized to administer the same, an oath, that he will honestly and faithfully discharge his duties as such Judge or Clerk. In case of the absence or inability of any Judge or Clerk so appointed to act at such eleotion, then the qualified electors present at the polls, before proceeding to vote, may choose an elector to act in his place from among the number, who shall duly qualify as aforesaid before entering upon the discharge of his duties as Judge or Clerk of such election. WHEREAS, it is desired to submit to the electors of the City'of Eugene and the electors of the proposed annexed area a proposal for annexation, and WHEREAS, tho sanitary conditions, water supply and electric supply are inadequate and constitute a menace to the health and safety of the people of the proposed annexed area, an emergency is therefore declared to exist and it is necessary for the immediate preservation of the pease, health and safety of the City of Eugene that this ordinance take effect immediately upon its passage a1d approval by the Mayor, and iT' IS SO ORDERED.
