NO 8900 An Ordinance adopting the plans and specifications 'of the City Engineer for the construction of sewers as follows; , Van Buren Street - Lewis to Clark Street Jackson Street - Sycamore to Clark Avenue Cedar Street - Cheshire to Clark Avenue Adams Strest - Lewis to Clark ?venue Ash Street - Lewis to Clark Avenue Cheshire Avenue - Jackson to Adams Street Clark Avenue - Jackson to Adams Street First Avenue - Jackson to Adams Street Cheshire .Avenue - Van Buren to Jaokson Street all in Riverwood addition to the City of Eugene, Oregon; and declaring an emergency. WHEREAS, on the 13th day of May, 1916, the Common :Council of the City of Eugene passed Ordinance No 8899 for the construction of sewers as described and set forth in the caption hereof, and Wh~EREAS, Seaticn 3 of said Ordinance directed the City Engineer to make plans and specifications for the construction of said suers and file the same with the City Recorder, and WHEREAS, in accordance with such instructions the City Engineer has; prepared said plans and specifications and filed the same with the City Recorder of said City of Eugene on the 13th day of May, 191~b, and the Connnon Council of the City of Eugene having examined and approved the same, and being duly advised in the premises, THE CITY OF EUGENE DOES ORDAIIu AS FOLLOWS; Section 1. That the plans and specifications of the City Engineer for the construction of sewers to be laid as follows Van Buren Street - Lewis to Clark Avenue Jaokson Street - Sycamore to Clark Avenue Cedar Street -- Cheshire to Clark $venue Adams Strest - Lewis to Clark Avenue Ash Street - Lewis to Clark Avenue Cheshire Avenue - Jackson to Adams Street Clark Avenue - Jackson to Adams Street First Avenue - Jackson to Adams Street Cheshire Avenue - Van Buren to Jackson Strest being eight inch to ten inch sewers serving the property herein, all in the City of Eugene, Oregon; filed with the City Recorder on the lath day of May, 1916, be and the same are in all things ratified, approved and adopted, and that said sewers be constructed in accordance therewith. Section 2. That the City Recorder be and he is hereby. instructed to give notice to can tractors and to property owners as provided by the Chester of the City of Elzgene for the letting of contracts far the construction of sewers. Section 3. That the Common Council of the City of Eugene dose hereby declare that the bids shall be advertised for separately for each of the streets set out here3.n, and that bids shall be invited for each separate street and for the entire group, and that the oontract for the construction of said sewers shall be let in one contract for all of them or in separate contracts for one or more of them as the council shall deem best and the City Recorder is hereby directed to state in the notice to the contractors and property owners that the contract for the improvement shall be let either as separate contraots for one or more of the sewers herein set out, or in one contract for the group. Section I~. That the work on said improvement shall commence within ten days after the letting of the contraot or contracts and shall be completed within thirty days thereafter. Seotion 5. The bidder receiving the contract for said improvement shall execute a good and sufficient bond with one er more sureties to be approved by the Street Committee in the sum of eighty per Dent (SO/) oP the oontract prise, for the faithful performance of the aontraat. Section 6. Ea.oh per3on, firm, company or corporation bidding upon said improvement shall accompany his bid with a certified check in the sum of 5 per cent of the amount bid as evidence of good faith and to guarantee the entering into a oontract in accordanoe with the bid submitted by him and the execution of the bond herein provided for. Seotion 7. Whereas, the improvement contemplated and provided for by this ordinance is a necessary improvement and the sanitary conditions of th® property is bad, the constructions of said sewers is declared essential to the health and safety of the residents of said district, and it is therefore declared that an emergency exists, and it is necessary for the preservation of the public peace, health and safety that this ordinance .take effect immediately upon its passage by the ~~ommon Council and approval by~the Mayor. An Ordinance approving and adopting the plans and specifications of the City Engineer for the improve- ment of in the City of Eugene, Oregon, by directing the City Recorder to • advertise for bids for the construction of said improvement in accordance with such plans and specifica- tions, and notifying property owners when and where the bids therefor will be opened and considered. WHEREAS, the Common Council of the said City of Eugene, on the day of 192 ,passed Ordinance No. for the improvement of . in the City of Eugene, by and said Ordinance was approved by the Mayor of the City on the day of , 192 ;and, WHEREAS, Section 3 of said Ordinance directs the City Engineer to make and prepare complete plans and specifications for the improvement of said as specified in said Ordinance, and, WHEREAS, plans and specifications. have been so prepared by the "City Engineer and have been examined by the members of the Common Council of the City and found to be satisfactory ' THE CITY OF EUGENE -DOES ORDAIN AS FOLLOWS: ~- - Section 1. That the plans and specifications of the City Engineer for the improvement of in the City of Eugene, by paving the same and doing such other work as may be necessary to completely im- prove the same are in all things approved and adopted, and the said shall be improved in accordance therewith. Section 2. That the -City Recorder is instructed to give notice to contractors and property owners, as .provided in Section 53, 54 and 55-B, of ,the. Charter of the City of Eugene, inviting bids for the improve- ment of said as prescribed in and in conformity to said plans and specifications. Section 3. -That the Common Council declares that the said improvement and the whole thereof shall be let as one contract, and the City Recorder is directed to state in the notice to contractors and property owners that said improvement will be let in one contract, and to also state therein the time and place when and where bids for the construction of said improvement will be opened and considered by the Common Council, and, that at such time and place property owners may file remonstrances against letting said con- - tract. Section 4. That the party whose bid is accepted for said improvement shall sign a contract for said work within ten days from the time of the receipt by him of the notification of the acceptance of his bid, and the work thereon shall be commenced within ten days after the letting of said contract, and shall be completed within sixty days thereafter, unless an extension of the time therefor be granted by the Com- mon Council. The party whose bid is accepted shall also execute and deliver to the city a good and sufficient bond, with one or more sureties to be approved by the ~ Committee of the City, ire an amount equal to eighty per cent of his contract price, as.security for the faithful and satisfactory ful- fillment of his contract. Section 5. That each party bidding for said improvement shall accompany his bid with a certified ' check or cash in an amount equal to five per cent of the amount of his bid, as evidence of good faith, and said check, or the proceeds thereof, or said money shall be retained by the City until a written contract is ' finally made, and fully executed and the bond furnished and delivered, all to be done within ten days after ' the award of said contract. ~ Section 6. WHEREAS, the improvement contemplated and provided for by this ordinance, is a necessary improvement, and the streets to be improved are in such condition that their immediate improvement is essential to their safety, it is, therefore, declared that an emergency exists and that it is necessary for the immediate preservation of the public peace, health and safety, that this ordinance take effect at once, and it is ordered that this act shall take effect immediately upon its passage by the Council and approval by the Mayor.
