EXTENSION OF TEMPORARY AMENDMENT OF EUGENE FIRE CODE
ADMINISTRATIVE RULE R-8.010FC ADOPTED BY ADMINISTRATIVE
ORDER NO. 52-16-01.
The City Manager of the City of Eugene finds that:
A. Section 8.010 of the Eugene Code, 1971, authorizes the City Manager to
administratively adopt a fire code for the City of Eugene. Pursuant to that authority, and in
accordance with the procedures set forth in Section 2.019 of the Eugene Code, 1971, on December
22, 2014, Administrative Order No. 52-14-02-F was issued adopting Eugene Fire Code
Administrative Rule R-8.01 OFC. That Rule amended the Oregon 2014 Fire Code Amendments to
the 2012 International Fire Code.
B. On March 16, 2015, Administrative Order No. 52-15-02 was issued adopting
temporary amendments to the Fire Code Rule until September 12, 2015. The amendments were
made in order to exempt from the permitting and code requirements all tents 400 square feet or
smaller, regardless of the number of small tents used for an event.
C. On August 26, 2015, Administrative Order No. 52-15-06 was issued effective
September 12, 2015, reaffirming and extending the temporary Fire Code Rule amendment until
March 10, 2016.
D. In March of 2016, Administrative Order No. 52-16-01 was issued revising the
temporary Fire Code Rule amendments to provide that tents 400 square feet or smaller, regardless
of the number of small tents, are exempt from Section 3103 (not exempt from entire Chapter 31
as provided by Administrative Order No. 52-15-06). That Order became effective on March 10,
2016, and will expire on September 6, 2016.
E. The temporary Fire Code Rule amendments established by Administrative Order
No. 52-16-01 should be extended because more time is needed to address issues concerning these
Rule amendments. Temporary Rules are authorized by EC 2.019(5). -
NOW THEREFORE, the temporary Fire Code Rule amendments made to sections
105.6.43 and 3103.2 of Eugene Fire Code Administrative Rule R-8.010FC by Administrative
Order No. 52-16-01 are extended and reaffirmed as set out below.
This temporary Rule shall become effective on September 6, 2016, and shall remain in
effect until March 4, 2017 (180 days from the effective date of this Order) unless replaced earlier
by an emergency rule, temporary rule, or permanent rule adopted in accordance with the provisions
of EC 2.019.

105.6.43 Temporary membrane structures and tents. An operational permit issued -by
the Eugene Springfield Fire Marshal's Office is required to operate an air -supported temporary
membrane structure, a tent having an area in excess of 1500 square feet or an occupant load of 50
or more, or multiple tents that are individually 400 square feet or larger with an aggregate area in
excess of 1500 square feet.
3103.2 Approval required and compliance. Tents and membrane structures having an
area in excess of 1500 square feet or an occupant load of 50 or more, or multiple tents that are
individually 400 square feet or larger with an aggregate area in excess of 1500 square feet shall
not be erected, operated or maintained for any purpose without first obtaining a permit and
approval from the fire code official and must comply with the provisions of this chapter. Tents
and membrane structures having an area of 400 square feet to 1499 square feet do not require a
permit prior to erection, operation or maintenance, but must comply with the provisions of this
chapter. Individual tents and membrane structures of less than 400 square feet and multiple tents
and membrane structures of less than 400 square feet, regardless of the total aggregate square
footage, are exempt from Section 3103. .
