THE CITY OF EUGENE DOES ORDAIN AS FOLLOWS: Section 1. That the survey, plat and report of the City Engineer upon the proposed opening and establishment of Tyler Street between Twelfth Avenue West and Fourteenth Avenue West in Eugene, Oregon, made and filed by him with the City Recorder on April 8, 19l~6, pursuant to the resolution_~of the Common Council of the City, passed on April 8, 191}6, is deemed satisfactory and is hereby adopted as so made in the words and figures following, to-wit: GENTLEMEN: TO THE HONORABLE A~AYOR AND COMPAON COUNCIL OF THE CITY OF EUGENE, OREGON Pursuant to the resolution of April 8, 191x.6, I herewith submit a report of the survey for the opening of Tyler ";,rest, between Twelfth Avenue West and Fourteenth Avenue Vlest, in Eugene, Oregon. I have made a survey of the proposed opening and have marked the boundaries thereof. This report contains; First; A full and complete description of such street and boundaries thereof, and of the portion of each tract of land to be appropriated therefor. property. Halloek Beginning at a point on the South line of 13th Avenue I'~est 333.5 feet Vest of the West line of Van Buren Street if extended South, running thence West along the South line of 13th Avenue, 66 feet, trance South 1b0 feet, thence East 66 feet, thence North 160 feet to the place of beginning in the City of Eugene, Lane County, Oregon . Beginning at a point on the South line of 12_th Avenue at a point 331x. feet West of the intersection of the Vest line of Van Buren Street and the South line of 12th Avenue in the City of Eugene, Lane County, Oregon; running thence South 331 feet more or less to the Al orth line cf 13th Avenue, Lhence West 33 feet, thence 4~2 North 331 feet, thence East 33 feet to the place of beginning in Lane County, Oregon. Section 2. That to open and establish said street, it will be necessary to acquire the land as sh own by said report and the ~Gty of Eugene does hereby determine to acquire said land mentioned and described in said report for the purpose of opening, extending and establishing said Tyler Street between Twelfth Avenue tiVest and Fourteenth Avenue West in Eugene, Oregon. (Section 2. That to open and establish said street, it will be necessary to acquire the land as shown by said report and the City of Eugene does hereby determine to acquire said land mentioned and described in said report for the purpose of opening, extending and establishing said Tyler Street between 7wuelfth Avenue West and Fourteenth Avenue West in rugene, Oregon.) Duplication. Section 3. That Wm. R. Robertson, James R. Rodman, Sr., and F. M. Cashman three disinterested free--holders of the City of Eugene and-each possessing the qualifi- cations of jurors of the Circuit Court of Lane County, Oregon, are appointed as viewers to view such proposed street and make an assessment of the damages and benefits as r~rovided in Section ~ of Chapter 9`z of the Charter of the City of Eugene. Section 1~. That said viewers are directed to meet on the 21a.th day of June, i i i i i 1g1.~6, at 9:30 o~elock in the Council Chambers of the City Hall in the City of Eugene, and the City ~tecorder is directed to cause a notice to property owners by publication for at ~,~ least ten days successively prior to the spy day assigned for said viewers to meet in a newspaper published in tiie City of Eugene, giving the names of and the time and place appointed for them to meet and specify with convenient certainty the boundaries, termini or other description of the said proposed street, and the boundaries or other description of the parcels of private prcperty to be appropriated for said purpose. Section 5. That the :City Recorder is directed to send by mail postpaid, a copy of each notice to each of the property owners. whose property is proposed to be appropriated or to the agent of such ovrner where the postoffice address ofsuch otRmer or agent is knov+n to him, and if' such postoffice address be unlrnovm to him, then such notice shall be directed to such owner or agent at Eugene, Oregon, as provided in Section 3 of Chapter 9 of the Charter of the City of Eugene. Section 6. That it is necessary for the convenience of the citizens of the City of Eugene, that said street be opened and extended and an emergency is therefore declared to be for the immediate preservation of tho. peace, health and safety of the City of Eugene that this Ordinanoe become effective immediately upon its passage by tYLe Common Council and approval by the i4:~ayor.
