THE CITY OF EUGENE DOES ORflAIN AS FOLUJZ~S Section 1. (a) The term, "person'; wher~:ver used. in this Ordinance shall mean and include a person, a firm, a corporation and any association under which busi- ness is transacted, and the singular number shall include the plural. (b) The term, "sewer cleaning device«, whenever used in this Ordinance, shall mean and include any mechanical equipment, tool or device whatso- ever used in the process of cleaning private, commercial or residential sewer lines. _ Section 2. Fret and after the passage of this Ordinance it shall be un- lawful for any person to perform or offer to perform services or ~nrork in the process of cleaning private, commercial or residential sewer lines by mechanical device without first obtaining a license therefor in the manner hereinafter provided. Fro- vided, however, that this Ordinance shall not aq~ply to any person holding a valid license under the provisions of the City of Eugene's Ordinance No. 8366, passed by the Common Council on November 13, 1933, and approved by the Mayor of said .City on November 11t, 1933 • Section 3. Any person desiring to obtain a license to operate a sewer cleaning device in the City of Eugene shall make application therefor at the office of the City Recorder on blanks to be furnished for that purpose, and shall describe in general terms the sewer cleaning device to be licensed. Each license sh all be approved by the City Manager. anc~Ior the City Recorder before issuance thereof for the particular device so licensed. Provided, however, the City Manager and/or the City Recorder may, at his discretion, with the concurrence of the. City Engineer, re- ject any and all applications for license hereunder for any reason or cause deemed sufficient for the protection of the public safety and welfare of the inhabitants t of the City of Eixgene . section 1~. A license fee of $x,25.00 per fiscal year shall be charged for each and every sewer cleaning device so licensed hereunder, pzvvided, however, that said annual license fee may, upon the application of the applicant be payable qua rte rly in advance . Section 5. Upon the approval of the application for license hereunder and upon the payment of such license fee, the City Recorder shall issue to each applicant a suitable license which shall be carried upon the person operating any sewer cleaning device licensed hereunder at all times that such device is being operated. 5~2 ~ - - _ - - -- --rc -- - Section 6. Any person violating any of the provisions of this Ordinance shall, upon conviction thereof in the Municipal Court of the City of Eugene, or .~ upon a plea of guilty, be punished by fine not exceeding ~p200.00 and costs of prosecution, and may be imprisoned in the City Jail one day for each $2.00 of such fine unpaid. Any sewer cleaning device as herein described r~hich shall be operated Within the City of Eugene without a license first having been obtained therefor, shall be subject to confiscation. Section 7. Whereas sewer cleaning devices as described in this Ordinance are now being operated within the City of Eugene and it is hereby deemed to be necessary for the immediate preservation .of the public peace, safety and health of the City of Eugene that this Ordinance take effect immediately upon its passage, therefore an emergency is hereby declared to exist and this Ordinance shall become effective immediately upon its passage by the Common Council and approval by the Mayor.
