'~IHEREAS, heretofore and on the 9th day of December, 1946, the Common Council of the City~of Eugene, passed an Ordinance setting a hearing for the 13th day of January, 1947, at the Council Chambers, at which time and place protests and re- monstrances could be heard as to the proposed vacation of the following premises, to wit: That certain platted a,lleyvsay running North and South through the block bounded by 13th 1'ivenue East and 14th Avenue East on the north and south respectively, and Emerald and Beech Streets on the V7est and East respectively, in said City cf Eugene; and, V~HEREAS, due notice was duly and regiil.arly given of said hearing and a hearing was held pursuant to sa~_d Ordinance in the Council Chambers of the City Hall in Eugene, on Monday, the 13th day of January, 1947, at 7:30 o'clock P.~,{., and at said time the Council heard all objections; and ViH~IEREAS, all persons otiming property abutting upon said alley proposed to be vacated have consented to said vacation and have applied for the same . The Common Council of the City of Eugene finds that due a.nd regular notice of said hearing was published and posted as required by law and that no valid objection has been made at said hearing or filed. That the consent of the owners of the abutting property has been duly and regularly filed in said proceed- ing and that the public interest will not be prejudiced by the vacation of said por- tion of alley. Section 2. That said hearing was held on the 13th day of January, 1947, at 7:30 o'clock 1'. M., in the Council Chambers of the City Hall of Eugene, Lane County, Oregon, and that all matters necessary to be done iri the premises have been duly and regularly completed. Section 3. That the following described area, to-wit: That certain platted alleyway running PJorth and South .through +,.1~e Block bounded by 13th Avenue East and 14th Avenue East on the 1'Jorth and South respectively, and Emerald and Beech Streets on the V~(est arrd East, respectively, in said City of Eugene, be and the same is hereby vacated and the area so vacated, being a portion cf the public alley, shall revert to the abutting property owners pursuant to the statutes 5~6 of the State of Oregon, reserving, hotirever, unto the City of Eugene and any of its agencies, the perpetual right to maintain any public utility or structures novr or hereafter located upon and within the area vacated, and to lay down and construct at any time the City of Eugene or any of its agencies shall deem necessary or con- venient, any public utilit3T within said area, and reserving the right to enter upon said vacated area for the purposes aforesaid. Section !~. The Recorder be and he is hereby directed to file a certified copy of this Ordinance with the Recorder of Lane County, Oregon, together with a map or plat of said property and that a certified copy of this ordinance shall be filed with the County Assessor, arda~ther certified copy of this ordinance shall be filed with the County Surveyor.
