An Ordinance amending Section Thirteen of the Ordinance No. 8113, entitled;
"An Ordinance to create or divide the City into
Districts within some of which it shall be lawful
and within others of which it shall be unlawful
to erect, construct, alter or maintain certain
buildings, or to carry on certain trades or callings
or within which the height and bulk of future build'
ings shall be limited, and providing for setback
lines, and providing for a penalty for the violation
thereof."
passed by the Common Council April 8 „ 1935, and approved by the Mayor April 9, 1935,
J by extending the provision as to setback lines.
THE CITY OF EU CEIdE DOES ORDAIN AS FOLLOWS:
Section 1. That Section 13 of Ordinance Pdo. 813 entitled;
"An Ordinance to create or divide the City into
Districts within some of which it shall be lawful,
And within others of which it shall be unlawful
to erect, construct, alter or maintain certain
buildings, or to carry on certain trades or callings,
or within v~rhich the height and bulk of future build-
ings shall be limited, and providing for setback
lines, and providing for a penalty for the violation
thereof,"
passed by the Common Council April 8, 1935, and approved by the Mayor April 9, 1935,
be and the same is hereby amended so as to add the following:
Setback line is hereby established upon and along
the South side of the State of Oregon Highway right
of way line immediately South of Franklin Boulevard
from the South line of 11th Avenue East easterly to the
City Limits, of 52 fast, and no building or structure shall
be permitted nearer to said Highway right of way line than
as herein provided, except that the Common Council may,
upon application of a property owner, by special ordinance
or resolution temporarily change or alter the setback line
as to a particular property.
The City Engineer be and he is hereby authorized and directed to place
the foregoing setback line upon the Use Map of the City of Eugene and immediately
draft such line upon the Use District 11Iap and the said lines be and they are
hereby established as the setback lines from said South line of 11th Avenue East
easterly to the City Limits, along the South side of the State Highway right of
vray adjacent to Franklin Boulevard.
Section 2. T~VIiEREAS, buildings are being erected which are not in
conformity ti~rith structures already around the streets, thus greatly injuring the
general appearance of the city and the property rights of persons who have already
built, therefore an emergency is declared to exist and it is necessary for the
immediate preservation of the peace, health and safety of the City that this
Ordinance take effect immediately upon its passage by the Common Council and
approved by the Mayor and it is so orderod.
