ORDINANCE NO 9012
An Ordinance wmending Ordinance No. 884 of the City of Eugene,
Entitled:
"An Ordinance providing for the establishment of a Bureau
of Fire Prevention" providing officers therefor and defin-
ing their povrers and duties, and prescribing regulations
for fire prevention and life safety in corJlection with
hazardous materials and processes .IT,
passed by the Common Council on the 11th day of February, 1946, and approved
by the Mayor of said City on the 12th day of February, 1946, by adding a new section
thereto designated as Section No. 2111 prohibiting smoking in certain buildings
and structures and providing for the posting and announcing of such restriction,
and declaring an emergency.
THE CITY OF EUGEJ.llE DOES ORDAIN AS FOLLOWS:
Section 1. That Ordinance No. 8874- of the City of Eugene, Lane County,
Oregon, be and the swme is hereby amended by adding thereto an additional section
Ul1der Part 21 and numbered Sec~ion 2111, in words a~nd figures as follows:
Section 2111.
vThenever in the opinion of the Chief of the Bureau or Fire Prevention,
concurred in by the Chief of the Fire Department, smoking by persons 'will create
a fire hazard or increase an existing fire hazard in any building, structure or
covering when being used by any assemblage of persons, the Chief of the Bureau
of Fire Prevention shall immediately designate such building, structurec or covering
as unsafe to permit smoking therein during any assemblage of persons. The Chief
of the Bureau of FirePrevention shall post suitable signs at and near each public
entrance to any such building, structure or covering so designated to the effect
that "smoking is prohibited." Thereafter and so long as such building, structure or
covering is so designated and posted it shall be unlawful for any person to smoke
therein during any assemblage of persons; and it shall be unlawful for the person
or Management in charge of any such building, structure or covering so designated
and posted, to permit any person to smoke therein during any assemblage of persons.
Provided, hO\'I[ ever, the Chief of the Bureau of Fire Prevention may, with the
concurrence of the Chief of the Fire Department, designate roams or portions of any
building, structure or covering when being used by any assemblage of persons, where
smoking may be permitted; and smoking by persons in any such rooms or portions so
designated may be permitted during any assemblage of persons.
Section 2. ~fuereas, persons are smoking during assemblages of persons
in uns~ie buildings and structures and it is hereby deemed to be necessary for the
immediate preservation of the public peace, health and safety of the City of Eugene

that this Ordinance take effect immediately upon its passage~ therefore an emergency
is hereby declared to exist and this Ordinance shall become effective immediately upon
its passage by the Common Council and approval by the Mayor~ and it is so ordered.
