HomeMy WebLinkAboutORDINANCE NO. 9026~ 8'7 -- - - - -- . - - - --- --- - r ORDINANCE N0. 9026 An Ordinance amending Ordinance No. 81+13 of the City of Eugene, entitled; "An Ordinance to create or divide the City into Districts within same of which it shall be lawful, and within others of which it shall be unlawful to erect, construct, alter or maintain certain buildings, or to carry on certain trades or callings, or within which the height and bulk of future buildings shall be limited, and providing for setback lines, and pro- viding for a penalty for the violation thereof." passed by the Common Council April 8, 1935s and approved by the Mayor April g, 1935• WHEREAS, under the direction of the Common Council of the City of Eugene, the City Planning Commission has .prepared a tentative report and held hearings thereon and has adopted the tentative report as their final and permanent report and trans- mitted the same to the City Council with recommendation that the same be enacted into an Ordinance NOW, THEREFORE, THE CITY OF EU(~1JE DOES ORDAIN AS FOLLOWS: Section 1. That Ordinance No. 81.13 entitled; "An Ordinance to create or divide the City into Districts within soma of which it shall be lawful, and within others of which it shall be unlawful to erect, construct, alter or maintain certain build- ings, or to carry on certain. trades or callings, or within-which the height and bulk of future build-. ings shall be limited, and providing for setback lines, and providing for a penalty for the violatiarz thereof." - passed by the Common Cotancil April 8, 1935, and approved by the Mayor April 9, 1935: be and the same is hereby amended in the follat~ring particulars; That the classification of; The Vest 1.~9 feet of Lot 1 in Block 2 and the West Li.9 feet of the P7orth 10 feet of Lot 2 of Block 2, all in Hendricks Amended Addition to the City of Eugene, Lane County, Oregon, be and the same is hereby designated as business classification and zoning, provided, hrn~vever, that a building sot back line is hereby established upon and along the East side of the above specifically described tract of real property of five feet and no building or structure shall be permitted neaxer to the East line of said tract than as herein provided, except the Common. Council may, upon application of a property cnmer, by special ordinance or res~alution, temporarily change or alter the setback line as to any particular part of said tract. Section 2. That the City Engineer be and he is hereby directed to cause the ~p attached to Ordinance No. 81.13, to show the foregoing change of classification of areas and buildings setback line, and to note thereon the rule with respect to buildings in business zones.
