VVI~REAS, under the direction of the Common Council of the City of Eugene t the City PlA»r~rg Comn3.ssion has prepared a tentative report and held hearings thereon L ~ and has adopted the tentative report as their final and permanent report and transmitted i ~ s i the same to the City Council with recommendation that the same be enacted into an Ordin~ ` r101'P, THEREFORE, THE CITY OF EUGENE DOES ORDAIN AS FOLLOIVS : Section 1. That Ordinance No. 8l.~.3, entitled; i "An Ordinance to create or divide the City into Districts within some of which it shall be lawful, and within others of which it shall be unlawful to erect, construct, alter or maintain certain buildings, or to carry on certain trades or callings, or within which the height and bulk of future buildings shall be limited, and providing for setback lines, and providing for a penalty for the violation thereof.tt passed by the Cormion Council April 8, 1935s and approved by the Mayor April 9, 1935, be and the same is hereby amended in the following particulars; That the classification of; Lots 1 through 6; Block 32, Fairmount Amended Addition; Lots 17 through 21~, Block 3t~, Fairmount Amended Addition; and the West 33 feet of Lot 25, Block 3L~, Fairmount Amended Addition to Eugene, Oregon, be and the same is hereby designated as business classification and zoning, provided, hot~rever, that a building set back line of 25 feet is hereby established upon and along the Southerly boundary of said tract, and no building or structure shall be permitted near to the Southerly line of said tract than as herein provided,'except the Common Council may, upon application of a property owner, by special ordinance or resolution, t temporarily change or alter the setback line as to any particular part of said tract. Section 2. That the City Engineer be and he is hereby cti.rected to cause the .. , map attached to Ordinance No. 8LF13, to show the foregoing change of classification of areas and building setback line, and to note thereon the rule with respect to buildings in business zones.
