THE CITY OF EUGENE DOES ORDAIN AS FOLLOWS: Section 1. That the survey, plat aril report of the City Engineer upon the proposed opening upon the proposed opening of Twenty-fourth Avenue East from Alder Street to Harris Street, in Eugene, Oregon, made and filed by him with the City Recorder on November 6,~ 1947, pursuant to the Resolution of the Common Council of the City of Eugene, passed on September 8, ~ 194?, is deemed satisfactory and is hereby adopted as so made in the words and figures following; to-wit: TO THE HONORABLE MAYOR AD?D CONII~ION COUP~ICIL OF THE 1 GE[JTLEMIIV: CITY OF EUG~JE, OREGON Pursuant to the resolution of Sept ember ~?th, 1947, I herer~~th submit a report of the survey for the opening of Twent y-fourth Avenue from Alder Street to Harris Street in Eugene, Oregon. I have made a survey of proposed opening an~i have marked the boundaries thereof. This report contains: Fi rst: A full and complete. description of such Street and boundaries thereof, and of the portion of each tract of land to be appropriated therefore. Second: A plat showing the pro posed opening together with adjacent property. Beginning at a point 154.6 feet vrest of the northeast corner of Lot 6 of I'altman Plat and running then ce north 66 feet; thence West 14 feet more or less to the east line of a tract of land owner b~~ the City of Eugene; thence S. O1° O8~ Tr1. along the east boundary of said tract of land owned by the City of Eugene a distance of 66 feet; thence east 14 feet more or less to the place of beginning. 2. Cit~T of Eul~ene to the Public . for street purposes . a. Beginning at the northeast corner of Lot 6 of NTaltman Plat, and running thence west 154.6 feet; thence north 66 feet; then ce east 153.9 feet to the west margin of Harris Street; and thence south along the west margin of Harris Street a di stanc e of 66 feet to the place of beginning . b. Beginning at the northwest corner of Lot 2, Block 1, Tiff's Plat and running thence east 446.12 feet; thence N. Olo 08~ E. 66 feet; thence West 446.12 feet to the east margin of Alder Street; and thence South along the east margin of Alder Street a distance of 66 feet to the place of beginning. 1 Section 2. That to open said street, it will be necessary to acouire the land as shova7 by said report and the City of Eugene does hereby determine to acqui re said land mentioned and described in said report for the purpose of opening Twenty-fourth Avenue from Alder to Harris Street in Eugene, Oregon. ~g .-- Section 3. That Z~1. R~ Robertson, Harvey L, Hilton, and Clarence M. Urey, three ~ ' disinterested free-holders of the City of the City of Eugene and each possdssion the quali- ~ I ! fications of jurors. of the Circuit Court of the County of Lane, State of Oregon, are appointed I I k ~ as viewers to view such proposed street and make an assessment of the damages and-benefits as 1 4 provided in Section 4 of Chapter 9~ of the Charter of the City of Eugene. Section 4. That said viewers are directed to meet on the 25th day of November, 1947, at 10:00 A.M. o'clock in the Council Chambers of the City Ha]1 in the City of Eugene, and the f~ City Recorder is directed to cause a notice to property owners by publication for at least ten days successively prior to the said day assigned for said viewers to meet, in a newspaper published in the city of Eugene,or by posting such notice in three public places, giving the i names of and the time and place appointed for them to meet and specifying with convenient certainty the boundaries, termini or other description of the said proposed street, and the boundaries or other description of the parcels of private property to be appropriated for said purpose Section 5. That the City Recorder is directed to send by mail postpaid, a copy of•each notice to each of the property owners whose property is proposed to be appropriated or to the I~ agent of such owner where the postoffice address of such owner or agent is known to him, and I if such postoffice address be unknown to him, then such notice shall be directed to such owner I i or agent at Eugene, Oregon, as provided in Section 3 of Chapter q of the Charter of the City of Eugene. Section 6. That it is necessary for the convenience of the citizens of the City of Eugene, that said street be opened and an emergency is therefore declared to exist, and it is therefore declared to be for the imriiediate preservation of the peace, health and safety of the City of Eugene that this Ordinance become effective immediately upon its passage by the Corrmion Council and approval ~y the Mayor.
