WHEREAS, The, City of Eugene has imposed upon it the duty of policing, inspecting a,nd
regulating various theatrical and other e:~hibitions, shows and other public amusements,
requiring additional operation cost to tre City, and responsibility for the welfare of its

~ citizens, and -
GTHEREAS, theatrical and othe7~ exhibitions, shows and other public amusements have been
operated in the City, often taking large sums of money out of the common resources of the

~~ City, and _

ti WHEREAS, the Common Council deems it in the public interest that some return should be ~-
made for the privilege enjoyed, the Common Council eneacts tre follo+aing:

An Ordinance levying and imposing a license tax u~oon theatrical and
fi other exhibitions, shows, and other public amusements, primarily for
regulation, and also for revenue, fixing the amount, and providing
for the collection thereof , to be iri lieu of all other city licenses
upon theatrical and other exhibitions, shows and other amusements,
prescribing penalties, and reyoealing all ordinances and parts of
II ordinances in conflict herewith.
j THE CITY OF' EUGENE DOES ORDAIN AS FOLLOWS:

'~ Section 1. It shall be unlawful for any person, firm, association or ~orooration, to

II operate within the City of Eugene, any theatrical or other exhibition, slow or other public
~~ amusement without having fir^.t secured from the City Recorder of the city a license so to

~ do.

'~ ~ Section 2. The City Recorder shall prepare an application form to be subscribed by

~f applicants, giving the ap plicant~s name or names, residence address or addresses, place of
it business, the character of entertainment and the period of time which the entertainment
will be sho~m and the admission charge.

'j Section 3. Ig the Recorder shall find that the applicant has complied with all the
I
other ordinances and repu?.a.tions of the City, he shall thereupon, upon payment to him of
I
li X1.00, issue a license to the applicant and keep a suitable record of all of the informa-
~ tion contained in the application. So long os the licensee sh~.ll comply with all the laws
!~
'~! and regulations of the city and with the terms of this ordinance, he shall be permitted to
operate in the City of Eugene.
i Section ~+. (a) There is hereby levied and imposed upon every theatrical, and other
exhibitions, sho*rr, and other public amusement operating in the City of Eugene, a license
~ tax for regulatory and revenue purposes.
_ (b) Said license tax shall be measured and determined by computing .three per cent
upon the total of the admission charges collected by the licensee.

~ (c) Licensees showing for periods of. one day up to two weeks, shall make a daily

{ statement to the City Recorder of the admission fees collected and accompany the same

i ?~rith a payment of the license t a.x.
(d) Licensees operating permanently in the City shall file with the Recorder monthly
statements showing the admission fees for the month, together with a computation of the tax
under this ordin=nce and accompany the same with payment of the license ta.x.

Section 5. The tax_ imposed by this ordinance shall be deemed to be held in trust by
the licensee until the same shag have been paid to the City Recorder as hereinafter pro-
vided.
Section 6. Any licensees failing to promptly account and remit to the City Recorder
the license charge herein provided, shall be personally liable to the City for said funds,,

and in addition thereto shall be deemed guilty of a violation of this ordinance.
j Secti on 7. Nothing herein contained sha 11 be deemed to impair or lessen the regulatory
provisions of the various ordinances of the city Frith respect to the amusements herein

~ licensed. Provided, however, that no other or further license charge shall be imposed upon

any licensee hereunder.
Section &. That all ordinances and parts of ordinances in conflict herewith, and
particularly Ordinance #860 and Ordinance #g51g are hereby repealed.
Section a. Any person, firm, association or corporation violating any of the provis-
ions of this ordinance, either of omission or commission, shall upon conviction thereof
before the municipal court, be subject to a fine of not to exceed X200.00 and upon default
of payment, may be imprisoned in the city jail for one day for each $2.00 of the fine un-
paid; Such conviction shall automatically revoke the license of such person, firm, asso-
ciation or corporation, to be reinstated. only by affirmative action by the Council.
