~ An Ordinance. to construct a sanitary sewer on the East side of Moss Street and the North

~~ side of Mission Avenue bett~rePn T~rrenty-third Avenue and Oak Grove Drive.
TN.E CITY OF ECTG~TE DOES ORDAIrT AS FOLLOWS:

~~ Section 1. That the Common Council of the City of Eugene, Line County, Oregon, does

~~ hereby declare its intenti on to construct a sanitary sewer on the East side of Moss Street
and the North side of mission Avenue betureen T~,aenty-third Avenue and Oak Grove Drive, and
h making such. other and further improvements in connection there-with as may bP necessary and
i~ proper to a properly constructed seTrrer all in accordance urith the plans and specifications
i~
j~ to be prepared by the city engineer a,s hereinafter specified.
~~ Section 2. That the costs of said construction shall be assessed and be borne by the
i~
~~ property adjacent to said construction except street intersections which will be baid. by
~~
~~ the city, a,n d there shall be included as a part of the costs thereof, the engineers charges
! for his services thereon not to exceed five per cent of the contract price therefor.
~~ Section That the City Engineer is hereby directed to make and prepare plans and
~~; apecifica.tion~`for the said construction as provided in Section One of this Ordinance and
file the same with the City Recorder.
Section ~. WHEREAS, the construction contemplated a.nd provided for by this Ord.ina.nce,
is a necessary construction and the system to be improved is in such a condition that its
I~ immediate improvement is essential to its safety, it is therefore, d.ecl=_red that a.n emer-
gency exists and that it is necessary for the i~ned.iate preservation of the public peace, ~.
health and safety, that this ordinance take effect at once, and it is ordered that this
act shall take effect immediately upon passage by the Council and approval by the Mayor.
