Recorder to advertise for bids for the construction of said sevrer in ',' accordance with such plans and specifications, and notifying property owners when =:nd where the bid therefor vrill be opened and considered. `~rTHEREAS, the Com.*~on Council of the said City of Eugene, on the Sth day of March, 1~li8, passed Ordinance No. Q11?~ for the construction of a sanitary sewer on the East side of A4oss Street and the North side of Mission Avenue bet~~reen Twenty-third Avenue and Oak Grove Drive, in ~~ ~; the City of Eugene, and said ordinance was approved by the Mayor of the City on the 9th day ~, of March, 19~-".•8; and '; WHEREAS, Section j of said Ordinance directs the City Engineer to make and prepare com- ' I plete plans and specifications for the construction of said sevrer as specified in s~.id i j ordinance, and ~~ ~ i , WHEREAS, plans and, s.^~ecifications have been so prepared by the City Engineer and ba.ve i~ been examined by the members of the Common Council of the City and. found to be satisfactory: i THE CITY OF EUGENE DOES ORDAIN AS FOLLOWS: ; ~ Section 1. That the plans and. specifications of the City Engineer for the construction '~ of a sanitary se~;rer on the East side of Moss Street and the North side of Mission Avenue I ' i bet~-reen Twenty-third. Avenue and Oak Grove Drive in the City of Eugene, by paving the same ~~ and doing such work as may be necessary to completely construct the same are in all things i~ ~! approved and adopted, and the said se~~.~er shall be constructed in accordance therewith. ~~ Section 2. That the City Recorder be instructed to give notice to contractors and ;' i ~ property okmers, as provided in Section 53, 5~+ and 55-8, of the Charter of the City of 'I'~ ~, f Eugene, inviting bids for the construction of said sewer as prescribed in azd in conformity l ~i to said. plans and specifications. i . Section 3. That the Common Council declared. that the said. construction and. the whole thereof shall be let as one contract, and the City Recorder is directed to state in the I ~ notice to contractors and property owners that said construction will be let in one con- ~' tract, and to also state therein the time and place when and where bids for the construction ';~, of said se<<rer Drill be opened and considered by the Common Council, and, that at such time ~ and place property ot~rners may file- remonstrances against letting said. contract. ~i 1. i Section Z. That the party vrhose bid is accepted. for said construction shall sign a I ~ j contract for said vrork ~,ithin ten days from the time of the receipt by him of the notifi- cation of the acceptance of his bid, and the vrork thereon shall be commenced within ten lii ~~~ days after the letting of said, contract, and shall be completed trrithin sixty days thereafter, i unless an extension of the time therefor be ranted. b the Common Council. The I' g y party vrhose ,,, ~, bid is accepted shall also execute a.nd deliver to the city a good and sufficient bond, with i '~ 59 one or more sureties to be approved by the Finance Committee of the City, in an amount equal to eighty per cent of his contract price, as security for the fa.itrful and satis- factory fulfillment of his contract. Section 5. That each ioarty bidding for said construction shall accompany his bid with a certified check or cash in an amount equal to five per cent of the amount of his bid, a.s evidence of good faith, and said check, or the proceeds thereof, or said money shall be retained by the City until a written contract is finally made, and fully exe- cuted and the bond furnished. and delivered, all to be done within ten days after the award of said contract. Section 6. 'vTHEREAS, the construction contemplated end provided for by this ordin- 1 Cl 1 ante, is a necessary construction and the se~n~er system to be improved is in such condi- tion that its immediate construction is essential to its safety, it is therefore, de- Glared than an emergency exists and that it is necessary for the immediate preservation of the public peace, health and safety, that this ordinance take effect at once, and it is ordered that this z.ct shall take effect immediately upon its passage by the Council and approval by the Mayor .
