An Ordinance to regulate sevrer construction, repair or reconstruction, and requiring
', application for permits, and providing a ~~enal_ty for violation thereof, repealing Ordinances
or parts of Ordinances in~conflict therewith, and providing for a bond and license, and ~
~ declaring an emergency.
BE IT ORDAINED By TI-~; CO?~~1I,40r1 COUr1CII, OF Tf~E; CITY OF EUGEP?E, OREGON:
Section 1. No person, firm, or corporation shall construct or reconstruct, any sani-
tary sewer within the City* of Eugene on private property, or in public ways, without first

making application and securing a permit therefor.
Section c. Applications for permits to construct or reconstruct sanitary servers shall
, be in tivriting on a form provided by the Building Zepartment, grid shall give the location of

the property, the name of the otivner, the nave of the person or firm engaged to construct,
or reconstruct, the proposed sanitary sewer, and such other information or plans as may
be required by the Building Department. ,
Section 3 . All applications to construct airy sanitary sever shall be accompanied by
a fee of ~z.50 (if more than 50~ of an existing sewer line is to be reconstructed, then
it shall be classed as new construction).
All applications to reconstruct any sanitary sevrer shall be accompanied by a fee of
X1.00 (if not less than ~0~ of an existing sewer line is to be reconstructed, then it '~
shall he classed as repairs).
If the work involved does not require the laying of a new line, it shall be classed
as a repair job, and no permit shall be required.

Section 5• Upon approval of the application the Building Department shall issue a ''
permit to construct, or reconstruct, a server line, which perriit shall. epeci_fy vvhere the

Section 6. Reasonable notice shall be given to the Plumbing Inspector to inspect
all work in connecti on with the construction or reconstruction of any sanitary sevrer line ~~
while the work is still uncovered.
Section 7. Applicants for permits to construct, or reconstruct, any sanitary sewer ~,
must also comply with the provisions of any ordinance regulating and requiring permits
'~~
for the making of cuts or excavations in, on, or under streets and alleys.
~ Section ~ . The aforementioned regulations do rot in any way affect or govern the con-
struction of sanitary servers vvithin the public streets which are done by regular contract ,

and under the supervision of the City Engineer. ~
Section 9. Before any person, firm or corporation other than the owner or a licensed '~
~ lumber shall en a e in the business of constru t'
~ P , g g c ~.ng or reconstructing san~.tary sewers,
or make sewer connecti ons, a license shall be secured in the sum of w2>.00, and a surety

bond shall be filed vrith the City Recorder in the sum of X7250.00. Said surety bond
shall first be approved by the City Attorney as to the form and legality thereof, and
be clear that the person, firm or corporation named therein will compl~* with the pro-
visions of all ordinances of the City of Eugene, and the laws, rules and regulations of
the Oregon Mate Board of health applicable in the City of Eugene.
Section 10. Any person found guilty of v~.olating any one of the provisions of this
ordinance shall be punished by a fine of not more than $p100.00.
Section 11. Inasmuch as the provisions of this ordinance are such as to affect

the peace, health, safety and general welfare of the inhabitants of the City of Eugene,
Oregon, an emergency is hereby declared to exist, and the provisions of the Ordinance
shall be in full force and effect immediately upon its passage by the Common Council
and approval by the Mayor.
