That the CoMMOn Council of, the City of Eugene hereby submits to the elect- ors of the folloti~ring described area in the City of Eugene, to--vrit: Beginning at a point on the present City Limits line of the City of Eugene, Lane County, Oregon, said point being the intersection of the East line of the alley in Block 31 of College Hill Park Addition in Section 6, Township 18 South, Range 3 Vlest of the V~illamette Meridian, an~I the South City Limits of the City of Eu- ' gene; thence East along tY~ South City Limits line to the ?Vest line of Alder Street; thence ~ ou.th along theJest J.ine of Alder Street and the present City ~ Limits to the North line of 25th Avenue; thence '~~est along the ~+orth line of 25th Avenue and the present ci ty Limits one block more or less to the ?:rest line of Hilyard Street; thence South along the priest line of Hilyard Street and the present City Limits to the Aortheast corner of Lot 11, Block 38, of Frasier- i Hyland Addition; thence ~"fest to the Northeast corner of Lot 12, Block 23, of Frasier-Hyland Addition; thence North along the ;test line of Willamette Street to a point East of the Northeast corner of Lot 12, Block 22, Frasier-Hyland Addition; thence Vtest to the Northeast corner of Lot 12, Block 15, of Frasier- Hyland Addition; thence North along ,the East side of Flock 15 of Frasier-Hy- ~and Addition to t he Easterly Northwest corner of said Addition; thence Plorth !~ along the East side of Lots 15, ll~, 13, and 12 feet of Lot 12, in Block 31, of College Hill Park Addition; thence East to the East to the East side of the alley in Block of said Addition; thence North along the East side of said alley ~ to the point of beginning, all property lying v-ithin Sections 5 and 6 of Town- ship 18 South, Range 3 ~'Iest of the V~Iillamette hreridian; for cllzestions "For Annexation" of 'Against Annexation" of such territory to the City of Eugene . Section 2. The Common Council of the Cit~T of EugP,ne hereof orders a special election to be held in the City of Eugene, Oregon, and to be held in the area described in Section 1, on the 21st day of I~ay, 1g1~8, at vrhach election there shall be submitted to theelectors of said city and to the proposed annexation area for their approval or rejection the pro- posal "For Annexation" or "Against Annexation" of said area to the City of Eugene. Section 3. That said proposal shall be placed upon +,he official ballot by the City Recorder to be voted upon by the electors of the proposed area and by the electors of said city at said election. Section !~. The Ci ty Rscorder~ shall provide such poll books, ballot boxes, tally 1 sheets and such other supplies for each polling place, both vrithin the City of Eugene and the proposed area, as are necessary f or the carrying on of the election, all of which shall be delivered to the election board. Section 5. The following are hereby designated as the polling places for said elec- j tion in the City of Eugene, one to be in each precinct of said City and the following are i ~2 hereb~T designated as the polling places in the propossd annexation area, and the Common Council does hereby appoint the judges and clerks to serve in each of said polling places as herein designated, +„o-writ: In the following list of Judges and Clerks, the first paned sha]1 be a Judge and the Chairman of the election board; the second named shall be a Judge and the next three shall be designated as first, second and third Clerks: Section 6. Tlie polls shall be opened in each of said polling places at eight o'clock in the morning and shall be kept open until eight o'clock in the evening on said election day. Section 7. The first named Judge of said election board as provided for in this Ord- finance shall be Chairman of the board of which he is a member, and the ballots cast at said election shall. be counted, tabulated and returned to the City kecorder as provided by law. Section 8. The City necorder is hereby authorized and directed to give notice of said election by publication in a nevrspaper of general circulation in such corporation and in such territory so proposed to be annexed once each week for the period of four weeks prior to such election, also by posting notices thereof in four public places in the territory proposed to be annexed for a like period. Such notice shall distinctly state the proposition to be so submitted and shall designate especially the boundaries of the territory so proposed to be anrered and the electors shall be invited thereby to vote up- on such proposi tion by placing upon their ballots the words "For Annexation" or "Against Ii it Annexation". k~ i~ Section 9. The Judges and Clerks, Y>efore entering upon the discharge of their duties at such election shall each take and subscribe before an officer authorized to administer the same, an oath, and he will honestly and faithfully discharge his duties as such Judge ~ or Clerk . In case of the absence or inability of any Judge o r Clerk so appoin ted to act at such election, tr~en the qualified electors present at the polls, before proceeding to vote, ma,y* choose and elector to act in his place from among the munber, who shall qualify as aforesaid before entering upon the discharge of. his duties as Judge or Clerk of s'ach election. iPIHEREAS, it is desired to submit to the electors of the City of Eugene ar-d the electors of the area he reinbefore described a proposal for annexation, and P'F-~REAS, the sanitar~T conditions, water supply and electric supply are inadequate and constitute a menace to the health and safety of t}ie people in the area hereinbefore described, an emergency is therefore delared to exist and it is necessary* for the immediate preserva- tion of the peace, health and safety of the City of Eugene that this ordinance take effect D 83 immediately upon its passage and approval by the Mayor, and IT IS SO ORDERED. 1 Passed by the C~mMOn Council this 22nd day of march, 1948. /s/ _ Henry F.
