J ` ~I Section 2. That the said sowers shall be constr~zc;ted of first class cement, vitrified +~ j I ~ pipe, or other suitable materiaJ_ accord ~.ng to the plans anti specifications of the City . ' h Engineer. I~ Secti-on 3. The City Engineer `s hereby directed to survey out the location of said ~ sewers, and prepare plans and specifications and a profile thereof and to file the same with ~~ j the City 1~.ecorder. 1 I Section 4. The constri.iction of said sewers shall include all necessar~r manholes, caves, I~ ~ and all things necessary' and convenient for the complr~te building thereof. I!~ ~ ~ j~ Section ~. The cost of the construction of sa_i_d sewers shall be borne b~T and shall j i ~ be asse~sed to tYie lots, parts cf lots a.nd acr age properly liable therefor, and benefitted ~l { b,-,~ the construction thereof in proportion to the benefits accruing to e~~ch lot, part of lot { j or acreage properly liable as shall be ascertain~;d. a.nd determined by the Common Council of ~j the City cf Eugene, except :street intersections, which will be paid for bar the City, and j{ I tyre shall be included as a part of the costs thereof, the Engi_neer's char.€;es for his j~ l I+ services thereon not to exceed. 5; of the contract, price therefor. it i I, I Section 6. Upon the completion of the sewers, the Common Council shall ascertain the ~~ I cost thereof and asse;,s that portion thereof against the lots, parts of lots or acreage pro- it jl perly liable therofcr or benefitted t}sereby n accordance with the provisions of the Char f~~ j ter of the City of Eugene, and vrhen sa;.d costs are so assessed the same shall be entered Il I~ 111 ~I 'I I 0 C 89 1 1 '1 in the City Lien Docket, and be further enforced as provided b,r the City Charter. Section 7. Whereas, the improvement contemplated and provided for by this ordinance is a necessary improvement and the district of the city in which said sewers are to be constructed is in such a conditior_ that the construction of said sewers is essential to the health and safety of the residents of said district, it is therefore, declared that an emergency exists and. it i s necessary for the immediate presertTati on of the public peace, health and safety, that this ordinance .take effect immedi?tely upon its passage by tkie Council a.nd approval by the mayor.
