Section 2. That the City Recorder be, and he i_s hereby, instructed to give notice 1 to contractors and property owners as provided in Sect~.ons 52, 53, 5~, 55, 56, 56B and r7 92 ._ 1 ~, of the Charter of the City of Eugene, inviting bids for the construction of said sewers t~ as prescribed in and in conformity to said plans and specifications. i~ ° i Section 3. Thz.t the Common Council declared that the said construction and the whole ~1 thereof shall be let as one contract and the City Recorder is directed to state in the ~ ~i notice to contractors and property owners that said contract will be let in one contract, j~ and to also state therein the time and place vrhen and where bids for the construction of ~~ said sewers will be opened and considered by the Conu*~on Council, and that .at, such time and place propertS- owners may file remonstrances against letting said contract. h ~~ Section Lt. That the part) whose bid is accepted for said construction si gn a contract ~~ I~ for said vrork_ within ten days from the time of the receipt by him of the notification of ~, ~~ the acceptance of his bid, and the vrork thereon shall be commenced within ten days after ~~ the letting of said contract, and. shall be completed within sixty days thereafter, unless i~ ~I an extension of the time therefor be granted by the Common Council. Section 5. That each party bidding. for said construction shall accompany his bid vri+~z a certified check or cash in an amount equal to five per cent of the amount of his bid, as evidence of good faith, end said check, or the proceeds thereof, or said money shall be retained by the City until a. vrritten contract ; s finally made, and folly executed and. the bond furnished and delivered, all to be done within ten days after the avrard of said contract. Section 6. c~1H.ii~AS, the construction contemplated and provided for by this ordinance, is a necessary construction and the sevrer system to be improved is in such condition that its immediate improvement is essential to ~'fs safety, it is therefore, declared that an emer- gency exists and that it i_s necessary for. the immediate preservation of the public peace, health and safety, that this ordinance take effect at once, and it is ordered that this act sha.11 take effect immediately upon its passage by the Council and a~roval by the Kayor.
