That the City Recorder he, and he is hereb;;.*, instructed to give notice to i~ ' contractors and propert~T owners as provided in Sections 52, 53, 54, 55 56 56P and 57 of ~ , , i the Charter of tl~ City of Eugene, inviting bids for the construction of said sewers as I i prescribed in and in conformity to said plans and specific„tioris . I ~3ection 3. 1^hat the Common Council declared that the said construction and the whole I thereof shall be let as one contract and the City Recorder is directed to state in the ~ i !~ I ,` ~ ~~ ;' ~6 notice to contractors and pro pert;, o~ners that said contract vrill be let in one contract, and to also state therein the time and place vrhen and where bids for the constri.~ction of said sewers will be opened and considered by the Common Council, and that at such time and place property owners may file remonstrances against letting said contract, Section I~ . That the party vrhose bid is accepted for said construction sign a con- tract for said work within ten days from the time of the receipt b~* him of the notifica- ~! ~l tion of the acceptance of his bid, and the work thereon shall be commenced within ten ii it days after the letting of said contract, and shall be completed Urithin sixty days there- lI j~ after, unless an e~aension of the time therefor be granted by the Common Council. That each party bidding for said construction shall accompany his bid with a certified deck or cash in an amount equal to five per cent- of the amount of his bid, as evidence of good faith, and said check, or the }proceeds thereof, or. said money, shall be retained by the City unti_1_ a ti^rritten contract i s f~~na? 1 y made, and fully executed a*~d the bond furnished ar_d delivered, all to be done within tPn da~,~s after the award of said contract„ Section 6. VTHERF.~S, the construction contemplated and provided for by this Ordin- ante is a necessary construction and tkie serer system to be improved is in such condition that its immediate improvement is essential to its safety, it is, therefore, declared that an emergency exists and that it is necessary for the immedj_a.te preservation of the public peace, health ant'. safety, that this f~rdinance take effect at once, and i t is ordered that .this act shall take effect immediately upon i.ts passage by the Council and approval by the ~a yo r .
