HomeMy WebLinkAboutORDINANCE NO. 9165~'~~ ORDINANCE AJO. 9165 An Ordinance initiating the vacation of the following described premises, to-wit: A part of Clark Avenue betvreen Monroe and Adams Street more particularly . described as follows: Commencing at a point on the South line of Clark Avenue 20 feet Southwesterly from the Northeast corner of Lot 5, Block 6, Riverurood Addition, running thence South 51~° `V'est 95 feet, thence on a crave to the left having a radius of 30 feet to a point 71 feet North, 28° Ytest of the Southwest corner of Lot l~, Block 6, Riverwood Addition, thence South 28° East 22 feet, thence on a curve to the right having a radius of 40 feet to a point I~0 feet South 1~7° 30' West of the northwest corner of Lot 5, Block 6, Riverwood Addition, thence North 1t7° 30' East 90 feet to the place of beginning, 1 and calling a hearing and directing thatnotice be given. . THE CITY OF EUG~~JE DOES ORDAIN AS FC)LLOf-~S: Section 1. I'he Common Council of the pity of Eugene hereby initiates vacation pro- ceedings on its oxn authority without petition or consent of the property owners, ex- cepting as provided by statutes, of the following described property, to-tivit: A part of Clark l~venue between Monroe arxi Adams Street more particularly described as follows: Commencing at a point on the South line of Clark Avenue 20 feet Southwesterly from the Northeast corner of Lot 5, Block 6, River~vood Addition, running thence South 5!~° T+IPst 95 feet, thence on a . curve to the left having a radius of 30 feet to a point 71 feet North, 28° West of the Southwest corner of Lot 1~, Block 6,.Riverwood Addition, thence South 28° East 22 feet, thence ~n a curve to the right having a radius of !t0 feet to a point 40 feet South 1~7° 30' West of the Northwest corner of lot 5, Block 6, Rivex~ood Addition, thence North 1~7° 30' East 90 feet to the place of beginning. Section 2. A hearing shall be held upon the proposal to vacate said premises~as 1 0 [I herein provided, and said hearing shall be held on the.l2th day of July, 19l~8, at 7:30 o'clock P.M. of said day, at wh~.ch time all persons will be heard upon objections or suggestions with reference to the vacation of said portion of said street and at said time the Council will provide for the vacation of said premises or deny such vacation, i and in case the vacation is made will make provisions for any damages sustained by local ~ assessment . Section 3. The City Recorder be, and he is hereby, required to immediately publish for four consecutive weeks in a newspaper published in Eugene, Lane County, Oregon, notice of the proposed vacation. Such notice shall give the description of the area to be va- cated as herein set out, and state the date when this ordinance was passed; the name of any petitioners petitioning for said vacation; the date when the said petition, together with any objections or remonstrances which may be made in writing and filed vrith the City Recorder prior to the date of said hearing, will be heard and considered. ~ Section !t. .The City Recorder shall forthwith and within five days after the first publication of said notice, post or cause to be posted at or near each end of said pro- posed vacation, a copy of the foregoing notice, which shall be headed "Notice of Street Vacation' and which notice shall be posted in at least two conspicuous places in such proposed vacation or such area. The posting and the first day of publication of such notice shall not be less than twenty4-eight days before the time set for hearing.
